About approval of Rules of ornithological ensuring flights of the state aircraft of the Republic of Kazakhstan

According to the subitem 27) of article 15 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" I ORDER:

1. Approve the enclosed Rules of ornithological ensuring flights of the state aircraft of the Republic of Kazakhstan.

2. To provide to management of the commander-in-chief Silami of air defense of Armed Forces of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction of the copy of this order in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" the Ministries of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan in the Kazakh and Russian languages within ten calendar days from the date of state registration;

3) placement of this order on Internet resource of the Ministry of Defence of the Republic of Kazakhstan after its first official publication;

4) the direction of data in Legal department of the Ministry of Defence of the Republic of Kazakhstan on execution of the actions provided by subitems 1), 2) and 3) of this Item within ten calendar days from the date of state registration.

3. To impose control of execution of this order on heads of governing bodies of the state aircraft of the Republic of Kazakhstan.

4. Bring this order to officials in the part concerning them.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of ornithological ensuring flights of the state aircraft of the Republic of Kazakhstan

Chapter 1. General provisions

1. Rules of ornithological ensuring flights of the state aircraft of the Republic of Kazakhstan (further - Rules) are developed according to the subitem 27) of article 15 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft".

2. The main terms and determinations used in these rules:

1) air unit (military unit, structural division) - the republican public institution performing production of flights of aircrafts (further - AF) destructive, bombing, attack, transport, army and educational state aircraft of the Republic of Kazakhstan, their operation, repair and storage, aviation managements, departments, aviation commandant's offices, air stores parks, structural divisions of the Ministry of Defence of the Republic of Kazakhstan (further - MO RK), law-enforcement bodies of the Republic of Kazakhstan and Air service of Committee of homeland security of the Republic of Kazakhstan (further - the EXPERT of KNB RK) which include the divisions operating pilotless aircrafts (further - BVS), and also training centers on training of aviation personnel, training centers of combat training and fighting application of BVS;

2) aviation ornithology - applied discipline of general ornithology which is engaged in studying of fauna, ecology, behavior and migration of birds in the part concerning safety of flights and also development and implementation of actions for prevention of collisions of AF with birds;

3) difficult ornithological situation - stay or appearance of birds on the way of movement of AF (on landing strip in case of running start and run or trajectory of flight) which can lead to collision with it;

4) migratory birds - which departing for the winter from this area to another and coming back only in the spring for laying of eggs and removal of posterity;

5) birds - one of the most widespread classes of vertebrate animals which absolute majority has capability to fly. By modern calculations the number of bird species does not exceed 8600.

Large number, wide circulation, their flights (migrations) cause considerable danger to AF;

6) flock of birds - set of the individuals having during the long period of time general space of life activity;

7) the wintering birds - arriving to this area for the winter, and fly away in the spring;

8) ornithology - the Section of zoology of vertebrata studying birds, their embryology, morphology, ecology, systematics and geographical distribution;

9) avifauna - set of the birds inhabiting certain territory or meeting on it during any period of year;

10) ornithological situation is the actual distribution, quantitative and specific structure, nature of dwelling and behavior of birds in air and on the earth, in the place and time;

11) settled birds - living in this area all the year round. Are very close to the settled wandering birds. They also live in certain area, but since the second half of summer and till next spring, move in search of food;

12) ornithological ensuring flights - complex of the actions directed to prevention of collisions of AF with birds.

3. The actions plan on ornithological ensuring flights is developed by meteorological division of military unit (further - meteodivision).

4. The actions plan includes identification and liquidation of the conditions promoting concentration of birds in airfield (helidrome) and the territory adjoining to it, training with specialists of meteodivision (further - meteospecialists) on aviation and ornithological subject and other specifics of ensuring flights.

5. Meteospecialists in airfields and persons responsible for ornithological providing at least once in 2 years are attracted on rates (charges) according to rate of combat training (the program of special preparation) and at least once in 5 years improve skills on specialization courses.

5-1. In airfields of joint basing in coordination with management of the airport meteospecialists and persons, the spring and autumn periods, responsible for ornithological providing, pass practical training on experience exchange, on the organization of direct interaction with the regular aviation ornithologist of the airport and to actions for procedure for identification and elimination of conditions of the birds promoting concentration.

6. Meteospecialists, the duty engineer-weather forecaster when ensuring flights in airfield (helidrome) of basing performs:

1) ensuring flights for the purpose of safety of flights in the ornithological relation according to these rules;

2) analysis and forecast of ornithological situation;

3) submission of information to the commander (the senior of flight change) and aircrew about ornithological situation in airfield (helidrome);

4) consultations and training with aircrew, group of management, officers of fighting management (further - OBU) and with staff of meteorological service (division), near drive radio marker Item, distant drive radio marker Item;

5) control of correctness and timeliness of taking measures to prevention of collisions of AF with birds.

7. Classes are given in aviation ornithology, before the spring and autumn periods of year. On classes in aviation ornithology are studied:

1) features of ornithological situation during different seasons of year around airfield and helidrome (specific structure, places of accumulation and the main routes of flights of the birds constituting danger to flights of AF);

2) distribution of cases of collisions of AF with birds in this airfield (helidrome) on seasons of year, the periods of days, heights;

3) the organization in airfield (helidrome) of ornithological ensuring flights;

4) visual and radar observations of ornithological situation around airfield (helidrome);

5) liquidation around airfield (helidrome) of the conditions promoting concentration of birds;

6) actions of crews in flight on reduction of probability and danger of collisions of AF with birds;

7) effects of collisions of AF with birds (material damage, dangerous situations in flight).

For the organization and teaching ornithological safety of flights in airfield (helidrome), the chairman of the non-staff ornithological commission answers.
