About approval of provisions of republican public institution "Committee of quality control and safety of goods and services of the Ministry of Health of the Republic of Kazakhstan" and its territorial subdivisions

According to the subitem 6) of Item 1 of Article 35, the subitem 3) of Item 2 of article 44 of the Law of the Republic of Kazakhstan of April 6, 2016 "About legal acts" and the order of the Government of the Republic of Kazakhstan of April 10, 2019 to No. 177 "About some questions of the Ministry of Health of the Republic of Kazakhstan", I ORDER:

1. Approve enclosed:

1) the Provision of republican public institution "Committee of quality control and safety of goods and services of the Ministry of Health of the Republic of Kazakhstan" according to appendix 1 to this order;

2) the Provision of republican public institution "Inspection department of quality and safety of goods and services of Akmola area of Committee of quality control and safety of goods and services of the Ministry of Health of the Republic of Kazakhstan" according to appendix 2 to this order;

3) the Provision of republican public institution "Inspection department of quality and safety of goods and services of the Aktyubinsk region of Committee of quality control and safety of goods and services of the Ministry of Health of the Republic of Kazakhstan" according to appendix 3 to this order;

2. To provide to committee of quality control and safety of goods and services of the Ministry of Health of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan within ten calendar days after day of adoption of this order:

1) the direction it the copy in electronic form in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" the Ministries of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Health of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Health of the Republic of Kazakhstan.

4. This order becomes effective from the date of its first official publication.

Provision of republican public institution "Committee of quality control and safety of goods and services of the Ministry of Health of the Republic of Kazakhstan"

Chapter 1. General provisions

1. The republican public institution "Committee of quality control and safety of goods and services of the Ministry of Health of the Republic of Kazakhstan" (further - Committee) is the department of the Ministry of Health of the Republic of Kazakhstan (further - the Ministry) performing management in spheres of protection of public health, sanitary and epidemiologic wellbeing of the population, quality of the rendered medical services, drug circulation and medical products, control and supervision of observance of the requirements established by technical regulations and regulating documents, and also in the field of safety of food products (further - the regulated sphere), performing regulating, realizable and control and supervising functions within competence of Committee.

2. The committee performs the activities according to the Constitution and the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.

3. The committee is legal entity in form of business of public institution, has seals and stamps with the name in state language, forms of the established sample, according to the legislation of the Republic of Kazakhstan of the account in bodies of treasury.

4. The committee enters the civil relations from own name.

5. The committee has the right to act as the party of the civil relations on behalf of the state if it is authorized on it according to the legislation.

6. The committee on questions of the competence of the procedure established by the legislation makes the decisions which are drawn up by orders of the head of Committee and other acts, stipulated by the legislation the Republic of Kazakhstan.

7. The structure and limit of the number of staff of Committee affirm according to the current legislation.

8. Location of the legal entity - Republic of Kazakhstan, 010000, Nour-Sultan's city, area Esil, Prospekt Mang_l_k El, house 8, office building "House of the ministries", 10th entrance.

9. Full name of state body - Republican public institution "Committee of quality control and safety of goods and services of the Ministry of Health of the Republic of Kazakhstan".

10. This Provision is the constituent document of Committee.

11. Financing of activities of Committee is performed from the republican budget.

12. The committee is forbidden to enter contractual relations with subjects of entrepreneurship regarding accomplishment of the obligations which are functions of Committee.

If the Committee by legal acts is granted the right to perform the activities which are bringing in incomes, then income gained from such activities go to the income of the government budget.

Chapter 2. Main objectives, functions, rights and obligations of Committee

13. Tasks:

1) implementation of regulating, realizable and control and supervising functions concerning protection of public health, sanitary and epidemiologic wellbeing of the population, quality of the rendered medical services, drug circulation and medical products, control and supervision of observance of the requirements established by technical regulations and regulating documents in the field of safety of food products participates in accomplishment of strategic functions of the Ministry within competence;

2) realization of public administration in the field of the organization of providing the population and the organizations of health care with safe, effective and high-quality medicines and medical products;

3) quality assurance and availability of the state services in the regulated sphere;

4) implementation of other tasks assigned to Committee within the competence.

14. Functions:

1) development of offers on forming and realization of state policy within the competence of the regulated sphere;

2) taking measures to suspension of operations or separate types of activity of the individual entrepreneur or legal entity according to the legislation of the Republic of Kazakhstan;

3) participation and conducting the state sanitary and epidemiologic examination of projects, issue by its results, and also based on results of check and (or) preventive control of the sanitary and epidemiologic conclusions according to the legislation of the Republic of Kazakhstan;

4) implementation within the competence of the state control of observance by licensees of the legislation of the Republic of Kazakhstan;

5) rendering, coordination, monitoring of the state services in the regulated sphere, issue of allowing documents, suspension of their action, and also deprivation (response) according to the legislation of the Republic of Kazakhstan;

6) decision making about suspension of medical application of medicine, medical products by suspension of action of the registration certificate of medicine, medical products, and also you will lock medical application and retirement or suspension of medical application of series (batch) of medicines and medical products;

7) providing the organization of carrying out social researches by determination of degree of satisfaction of citizens with level and quality of the provided medical care according to the legislation of the Republic of Kazakhstan on the state social order, grants and awards for non-governmental organizations in the Republic of Kazakhstan;

8) carrying out certification of heads of local authorities of public administration of health care of areas, cities of republican value and capital and their deputies, heads of the organizations, their deputies, and also heads of branches;

9) implementation of state regulation of the prices of medicines and medical products according to the legislation;

10) implementation of the state control of activities of subjects of health care;

11) implementation of the state control in the field of drug circulation and medical products, sanitary and epidemiologic wellbeing of the population, rendering medical services, and also behind drug trafficking, psychotropic substances and precursors in the field of health care;

12) recognition of standards of the international and foreign pharmacopeias, and also pharmacopoeian Articles (monographs) and other documents on standardization on medicines, medical products of foreign states;

13) control of activities of subjects of rendering services of traditional medicine, traditional medicine (healing);

14) conducting external examination of quality of medical services;

15) implementation of monitoring within the competences;

16) accreditation of the medical organizations on the right of performing clinical trials pharmacological and medicines and medical products;

17) accreditation of test laboratories on the right of carrying out preclinical (not clinical) researches of biologically active agents, medical products;

18) accreditation of the test laboratories performing exclusive activities for examination and assessment of safety and quality of medicines and medical products;

19) implementation of pharmaceutical inspections;

20) consideration of appeals of physical persons and legal entities on the questions entering competence of Committee;

21) implementation of the state sanitary and epidemiologic control and supervision in the territory of the Republic of Kazakhstan;

22) introduction of restrictive actions, including quarantine, with special conditions of economic or other activity and life of the population;

23) implementation of licensing of allowing procedures and acceptance of notifications according to the Law of the Republic of Kazakhstan "About permissions and notifications";

24) prohibition of import, production, application and realization in the territory of the Republic of Kazakhstan products, held for use and applications by the population, and also in business and (or) other activity according to the procedure, established by the legislation of the Republic of Kazakhstan;

25) prohibition of production, application and realization of new types of raw materials, products, chemicals, processing equipment, mechanisms, processes, tools, in case of recognition their life-threatening and human health;

26) safety of food products;

27) the organization and holding actions for sanitary protection of the territory of the republic from drift and spread of infectious, parasitic diseases;

28) the organization carrying out researches and testing within the competence;

29) implementation of forming and implementation of the state social order on carrying out researches, information and educational work and the consulting help to the population concerning sanitary and epidemiologic wellbeing of the population;

30) the organization and holding sanitary and anti-epidemic (sanitary and preventive) actions at check points through the Frontier of the Republic of Kazakhstan matching with customs border of the Customs union, except for automobile check points, sanitary and quarantine control of the passengers, crews, crews of train, vehicles, loads constituting health hazard of the population for the purpose of non-admission of delivery and distribution in the corresponding territory of infectious, parasitic diseases, and also substances and products potentially hazardous to health of the person;

31) control and supervision of fulfillment of requirements of the legislation of the Republic of Kazakhstan on prevention of iodine-deficiency diseases;

32) implementation of epidemiological control of infectious and parasitic diseases;

33) control of observance of the requirements established by technical regulations and regulating documents on products and services, implementable consumers;

34) conducting checks of the vehicles used to transportation of passengers, foodstuff, food staples, economic drinking water, radioactive, dangerous, chemical and toxic materials, conditions of transportation of passengers and loads;

35) the organization, coordination and implementation of the state control of observance of the requirements established by the legislation of the Republic of Kazakhstan on safety of the food products which are subject to sanitary and epidemiological surveillance;

36) representation of the Republic of Kazakhstan in the international organizations and associations for health care, including safety of the food products which are subject to sanitary and epidemiological surveillance, drug circulation and medical products;

37) work on evidence-based confirmation of safety of dietary supplements to food;

38) introduction of offers on cancellation, change of the acts adopted by state bodies violating the law of the Republic of Kazakhstan in the regulated sphere and also their reduction into compliance with the legislation of the Republic of Kazakhstan;

39) issue of instructions about elimination of violations of requirements of the legislation of the Republic of Kazakhstan in the regulated sphere;

40) challenge physical, officials, legal representatives of legal entities for consideration of the facts of violation of the law of the Republic of Kazakhstan within the competence;

41) suspension or prohibition of application of products of baby food, food and dietary supplements to food, genetically modified objects, materials and products contacting to water and food, chemicals, the separate types of products and substances making harmful effects on health of the person;

42) the direction of the persons which are potential sources of spread of infectious and parasitic diseases, and also being in contact with infectious patients on physical examination with their discharge from work before receipt of results of laboratory inspection;

43) the direction according to indications on hospitalization of persons which are sources of infectious and parasitic diseases;

44) determination of the territory or its part, free from diseases or with the low level of prevalence of diseases;

45) control in the regulated sphere in the form of check and preventive control and supervision according to the current legislation of the Republic of Kazakhstan;

46) implementation of radiation control in the field of sanitary and epidemiologic wellbeing of the population in the territory of the Republic of Kazakhstan;

47) adoption of resolutions on temporary discharge from work of the persons which are belonging to dekretirovanny national groups, being source of infectious and parasitic diseases, and also who timely did not have obligatory medical examinations;

48) suspension before elimination of violations of regulatory legal acts in the field of sanitary and epidemiologic wellbeing of the population and hygienic standard rates of separate work types, the operation operating, which is based or the reconstructed objects according to the legislation of the Republic of Kazakhstan on administrative offenses;

49) the requirement of performing obligatory vaccination of the population, preventive and focal disinfection, disinsection and deratization in rooms and on vehicles, the territories, in the centers of infectious and parasitic diseases;

50) establishment and change of the size of sanitary protection zones;

51) participation in the organization and holding republican and regional seminars, scientific and practical conferences on questions in the regulated sphere, planning and budget implementation, financial accounting and public procurements;

52) maintaining the register of potentially dangerous chemical, biological substances prohibited to application in the Republic of Kazakhstan;

53) recognition of sanitary and anti-epidemic (sanitary and preventive) actions of other countries equivalent if these actions provide the proper level of sanitary and epidemiologic wellbeing of the population in the territory of the Republic of Kazakhstan;

54) excitement, hearing of cases about administrative offenses according to the procedure, established by the Code of the Republic of Kazakhstan "About administrative offenses";

55) conducting investigations of violations of the law in the field of sanitary and epidemiologic wellbeing of the population;

56) marginal forming of prices and markups;

57) participation in development and approval of regulatory legal acts within competence;

58) approval of regulatory legal acts according to the legislation of the Republic of Kazakhstan;

59) creation at check points through the Frontier of the Republic of Kazakhstan matching with customs border of the Eurasian Economic Union, sanitary and quarantine Items;

60) approval of compliance of processes (stages) of development (creation), production (production), turnover, utilization and destruction of food products, compliance of the machines and the equipment, materials and products used in case of development (creation), production (production), turnover, utilization and destruction, to the requirements established by the legislation of the Republic of Kazakhstan on safety of food products with issue of the sanitary and epidemiologic conclusion;

61) interaction with state bodies, physical persons and legal entities, non-governmental organizations within competence;

62) implementation of coordination and control of activities of territorial subdivisions of Committee;

63) implementation of functions of authorized body on management of the corresponding industry (sphere) of public administration of the organizations subordinated to Committee;

64) coordination of organization activity of health care, performing activities in the regulated sphere;

65) adoption of acts of the established violations of requirements of the legislation of the Republic of Kazakhstan;

66) the organization and carrying out within the competence of sanitary and antiepidemiological and sanitary and preventive actions in case of food poisonings, infectious, parasitic and other diseases;

67) accreditation of the organization on the right of carrying out accreditation of subjects of health care;

68) creation and ensuring functioning of electronic information resources and information systems, information and communication networks in the regulated sphere, the organization of access of physical persons and legal entities to them according to the legislation of the Republic of Kazakhstan in the field of informatization;

69) implementation of other functions provided by the laws, acts of the President and the Government of the Republic of Kazakhstan.

15. Rights and obligations:

1) to request and receive in the procedure established by the legislation from state bodies, officials, physical persons and legal entities information on questions in the regulated sphere;

2) to take a legal action in case of failure to carry out or inadequate accomplishment by physical persons and legal entities of legal requirements or instructions, the resolutions issued by officials of Committee and its territorial subdivisions;

3) to give methodological and advisory help to territorial subdivisions and the subordinated organizations in the regulated sphere;

4) to carry out information and explanatory work on questions in the regulated sphere;

To create 5) advisory and consultative and commissions of experts (working groups) within the competence;

6) to determine priority activities for the organizations subordinated to Committee financed from the budget;

7) to keep financial accounting and to create the financial reporting;

8) not to disclose information, component commercial, office, other, protected by the law, the secret received when implementing the powers, except as specified, established by the laws of the Republic of Kazakhstan;

9) to carry out the analysis of application of the legislation of the Republic of Kazakhstan in the regulated sphere;

To involve 10) in conducting checks and examinations of specialists from other organizations in the procedure established by the legislation;

11) to make offers on cancellation, change of the acts adopted by state bodies violating the law of the Republic of Kazakhstan in the regulated sphere, and also their reduction in compliance with the legislation of the Republic of Kazakhstan;

12) to observe the legislation of the Republic of Kazakhstan, it is right also the interests of physical persons and legal entities protected by the law;

13) to perform other rights and obligations provided by the current legislation of the Republic of Kazakhstan.

Chapter 3. Organization of activities of Committee

16. Management of Committee is performed of the head who bears the personal responsibility for accomplishment of the tasks assigned to Committee and implementation of the functions by it.

17. The head of Committee is appointed to position and dismissed according to the legislation of the Republic of Kazakhstan.

18. The head of Committee has deputies who are appointed to positions and are dismissed according to the legislation of the Republic of Kazakhstan.

19. Powers of the Head of Committee:

1) according to the legislation appoints to positions and dismisses:

employees of Committee, except for workers whose questions of employment relationships are carried to competence of higher state bodies and officials;

the first heads of the subordinated organizations of Committee in coordination with the Ministry;

deputy first heads of the subordinated organizations of Committee;

2) in the procedure established by the legislation resolves issues of sending, provision of leaves, rendering financial support, preparation (retraining), advanced training, encouragement, payment of allowances and awarding, and also attraction to disciplinary responsibility of employees of Committee, the first heads of the subordinated organizations of Committee, except for workers whose questions of employment relationships are carried to competence of higher state bodies and officials;

3) approves job responsibilities of employees of Committee, the first heads of the subordinated organizations of Committee;

4) approves provisions of structural, district and city territorial subdivisions of Committee, and also qualification requirements to managerial state positions of the case "B";

Approves 5), makes changes and additions to provisions (charters) of the subordinated organizations of Committee, except for the republican state companies which are carried to competence of authorized body on state-owned property;

6) is approved by regulations of work of Committee;

7) performs management of activities of the subordinated organizations and territorial subdivisions of Committee;

8) within the competence signs orders of Committee;

9) is represented by Committee in all state bodies and other organizations according to the legislation;

10) takes the measures directed to anti-corruption;

11) presents candidacies for appointment to positions of deputy managers of Committee;

12) signs the documents sent on behalf of Committee to other state bodies on the questions entering competence of Committee;

13) performs other powers according to the legislation of the Republic of Kazakhstan.

Execution of powers of the Head of Committee in the period of its absence is performed by person replacing it according to the current legislation.

20. The head of Committee determines powers of the deputies according to the current legislation.

Chapter 4. Property of Committee

21. The committee can have on the right of operational management the isolated property in cases, stipulated by the legislation.

The property of Committee is created at the expense of the property transferred to it by the state and also the property (including cash incomes) acquired as a result of own activities and other sources which are not prohibited by the legislation of the Republic of Kazakhstan.

22. The property assigned to Committee belongs to republican property.

23. The committee has no right to alienate independently or to dispose otherwise of the property assigned to it and the property acquired at the expense of the means issued to it according to the plan of financing if other is not established by the legislation.

Chapter 5. Reorganization and abolition of Committee

24. Reorganization and abolition of Committee are performed according to the legislation of the Republic of Kazakhstan.
