In pursuance of article 19 of the Law of Ukraine "About power industry" and for the purpose of ensuring reliable protection of energy objects I ORDER:

1. Approve the Instruction about procedure for acquisition, transportation, storage, accounting and use of firearms and ammunition to it, special means of self-defense, and also devices of national production for shooting of the cartridges equipped with throwing shells of nonlethal action, rubber or similar on the properties, and the specified cartridges by the divisions of the departmental militarized and sentry protection performing protection of power generation facilities which is applied.

2. To heads of the companies, organizations and organizations of power industry to take the above-mentioned Instruction to steady accomplishment.

3. To impose the organization and control over the implementation of this order on the deputy minister Cech S. M. and the chief of the state company "Management of the Departmental Militarized Protection" Farenyuk B. Ya.

1. General provisions

1.1. This Instruction is developed according to requirements of Art. 19 of the Law of Ukraine "About power industry", resolutions of the Cabinet of Ministers of Ukraine of October 12, 1992 N575 "About Approval of the Regulations on Procedure for Use of Firearms", of September 7, 1993 N706 "About Procedure for Sale, Acquisition, Registration, Accounting and Application of the Special Means of Self-defense Loaded with Substances Tear and Irritant Action" and Instructions about procedure for production, acquisition, storage, accounting, transportation and use of fire, pneumatic and cold weapon, devices of national production for shooting of the cartridges equipped with throwing shells of nonlethal action, rubber or similar on the properties, and the specified cartridges, and also ammunition to weapon and explosive materials, Ukraine approved by the order of the Ministry of Internal Affairs of 21.08.98 of N622 and registered 07.10.98 for N637/3077 (with changes and amendments), also determines procedure for acquisition, transportation, storage, accounting and use of firearms and ammunition to it, devices of national production for shooting of the cartridges equipped with throwing shells of nonlethal action, rubber or similar on the properties, and the specified cartridges (further - devices), and also rubber bludgeons, handcuffs and barrels with substances tear and irritant action (further special means of self-defense) divisions of the departmental militarized and sentry protection (further - divisions of protection) which perform protection of power generation facilities.

1.2. Employees of divisions of protection for ensuring protection of power generation facilities, particular loads and money which belong to the companies, organizations and the organizations of power industry arm with firearms - automatic machines, carbines, guns (revolvers) and special means of self-defense, employees of divisions sentry with okhranygladkostvolny firearms, gas weapon, devices and special means of self-defense.

1.3. For the work connected with use of firearms and devices during execution of service duties persons which reached 21-year age and capable for health reasons business and moral qualities are accepted in coordination with bodies of the Ministry of Internal Affairs of Ukraine to perform such work, and for work with special means - persons which reached 18-year age.

1.4. Responsibility for accounting, storage and use of firearms, ammunition to it and devices, are born by the division managers of protection having permission to storage of departmental firearms, ammunition and devices and also the officials designated by the order of the division manager responsible for accounting, storage and use of firearms, ammunition to it and devices.

2. Acquisition of firearms, ammunition and devices

2.1. Divisions of protection perform acquisition and storage of firearms, ammunition to it and devices only on permissions of territorial authorities of internal affairs of Ukraine and under obligatory approval of the state company "Management of the Departmental Militarized Protection" (further - GP "Managements of VOHR").

2.2. Regulations of weapon and ammunition which are provided for arms of divisions of protection are given in appendix 1 to this Instruction.

Regulations of devices are established according to appendix 2.

2.3. For acquisition of firearms and ammunition to it division managers of protection give GP "Management of VOHR" till June 5 of the current year the request (appendix 3) in duplicate who shall be approved as the director, and also is approved with territorial authority of the Ministry of Internal Affairs of Ukraine and is certified by seals of the company and territorial authority of the Ministry of Internal Affairs of Ukraine.

The Ministry of Fuel and Energy of Ukraine through GP "Management of VOHR" not later than on July 20 the current year sends to the Ministry of Internal Affairs of Ukraine the generalized request for acquisition of firearms and ammunition.

2.4. For acquisition of devices division managers of protection submit GP "Management of VOHR" the application in duplicate who shall be approved as the director, and also is approved with territorial authority of the Ministry of Internal Affairs of Ukraine and is certified by seals of the company and territorial authority of the Ministry of Internal Affairs of Ukraine.
