About approval of Fire safety regulations for the companies of the coal industry of Ukraine

In pursuance of the Law of Ukraine "About fire safety", Item 80 of Measures for increase in labor safety on coal mines (appendix 2 to the Program of increase in the labor safety on coal mines approved by the resolution of the Cabinet of Ministers of Ukraine of July 6, 2002 N 939, in edition of the resolution of the Cabinet of Ministers of Ukraine of February 18, 2004 N186 I ORDER:

1. Approve the attached "Fire safety regulations for the companies of the coal industry of Ukraine" (further - Rules) and to enact them after registration in the Ministry of Justice of Ukraine.

2. Approve Regulations on procedure for investigation of the underground fires on coal mines which are applied.

3. In accordance with the established procedure to submit to department on emergency situations and labor protection (Yashchenko I. O.) this order on state registration.

4. Recognize as such N123 "About Approval of Fire Safety Regulations for the Companies of the Coal Industry of the Ukrainian RSR" which terminated the order of the Ministry of the coal industry of the Ukrainian RSR of June 4, 1970.

5. To send to department on emergency situations and labor protection (Yashchenko I. O.) after state registration in the Ministry of Justice of Ukraine to State department of fire safety of the Ministry of Emergency Situations of Ukraine required materials for inclusion of Rules in the state register and the automated databank of information fund of regulations concerning fire safety.

6. To impose control of execution of this order on the deputy minister Shevtsov M. I.

Fire safety regulations for the companies of the coal industry of Ukraine

1. General provisions

1.1. Fire safety regulations (further - Rules) are developed for the companies of the coal industry of Ukraine on development of NAPB A. 01.001-95, GNAOP 1.1.30-1.01-00, GNAOP 12.11. - 1.01-94, NAOP 1.1.30-1.03-90 also consider provision of the Law of Ukraine "About fire safety" of December 17, 1993 and "The mountain law of Ukraine" of October 6, 1999.

1.2. Rules establish requirements of fire safety for the operating, under construction, reconstructed or liquidated coal companies: mines (elevated and underground complexes), cuts, enrichment and briquette factories.

Requirements of these Rules are aimed at providing organizational, technical and other measures of the prevention of the fires, safety of people, decrease in possible loss of property and reduction of negative effects in case of their origin, creation of conditions for successful suppression of the fires at the companies of the coal industry of Ukraine.

1.3. Rules are obligatory for execution by the companies, organizations, organizations irrespective of patterns of ownership, officials, workers of coal industry.

1.4. Ensuring fire safety of the coal companies (further - the companies) is assigned to their heads or persons authorized by heads if another is not provided by the relevant agreement.

1.5. Financing of works of new construction, reconstruction, restoration, capital repairs of buildings and other superficial objects, expansion and technical pereosnashchaniye of the companies can be carried out only in the presence of positive expert opinions of the State fire supervision of the Ministry of Emergency Situations of Ukraine (daleegospozharnadzor) as component of complex state examination.

1.6. State examination (check) of the design estimates concerning fire safety is carried out according to the procedure, established by the legislation.

1.7. The beginning of work of the new company, putting into operation of the new, reconstructed production and other superficial facilities, introduction of new technologies, transfer to production of samples of new fire-dangerous machines, mechanisms, the equipment and products, lease of rooms without the permission of bodies of the Gospozharnadzor are prohibited.

Issue of permission is performed according to requirements of NAPB B.07.018-01.

1.8. Products of fire-proof appointment, and also products to which requirements of fire safety are established shall have the certificate of conformity or the certificate on recognition of compliance.

1.9. Provision of services and performance of works of fire-proof appointment are performed according to licensed conditions and procedure for control of their observance which affirm the joint order of the special representative of body for questions of licensing and State department of fire safety of the Ministry of Emergency Situations of Ukraine.

1.10. The official and physical persons guilty of violation of these Rules bear the administrative, criminal and other responsibility according to the current legislation of Ukraine.

4. Organizational measures for ensuring fire safety of the companies

4.1. Fire safety of the companies it shall be provided at stage of technical designing according to the existing regulating documentation.

4.2. At the company his head who the order appoints officials (including deputy managers) on ensuring fire safety of the company, certain buildings, constructions, rooms, sites, the processing and engineering equipment, responsible for fire safety, and also for content and operation of technical means of fire protection is responsible for condition of fire protection.

Obligations on ensuring fire safety, content and operation of means of fire protection shall be displayed in the corresponding job descriptions, charters of the companies.

4.3. Heads of the companies (employers), and also lessees for ensuring fire safety of the companies, shall:

develop complex measures for ensuring fire safety, implement achievements of science and technology, positive experience;

according to regulations on fire safety to develop and approve provisions, instructions (appendix 1), other regulations existing within the company, to exercise constant control behind their execution;

provide observance of fire-proof requirements of standards, regulations, rules, and also fulfillment of requirements of orders and resolutions of bodies of the Gospozharnadzor and the Public militarized mine-rescue service in the coal industry (further - GVGSS);

organize training of workers in fire safety regulations and measures for their providing;

periodically at least once a quarter to check condition of fire safety of object;

contain in good repair means of fire protection and communication, the fire fighting equipment, the equipment and stock, not to allow their use not to destination;

perform measures for implementation of automatic means of identification and suppression of the fires, use for this purpose of production automatic equipment;

to timely inform fire protection and mine-rescue service on defects of the fire fighting equipment, fire protection systems, water supply, and also road blocking and drives in the territory;

organize studying by personnel of these Rules and the instructions developed on their basis, carrying out fire-proof instructing and training fire technically in minimum according to NAPB B.02.005-94;

represent upon the demand of officials of the Gospozharnadzor and GVGSS data and documents on condition of fire safety of objects and products, and also on the fires which happened, but their effects;

establish and to constantly control fire prevention regime, procedure for carrying out hot and flammable work at the company;

accept (in borders of the rights granted to them) adequate measures of response to the facts of violations or failure to carry out by officials and other workers of the fire prevention regime set at this company, requirements of the fire safety regulations and regulations existing in this sphere;

provide to the common directorship liquidation of the fires and other accidents;

in each case of the fire which occurred at the company to organize work of the commission on investigation of causes of the fire, to develop and perform necessary preventive fire prevention;

create, as necessary, according to established procedure of division of fire protection and material and technical resources, necessary for their functioning (for the companies of the coal industry located on surface).

4.4. Person responsible for fire safety shall:

know about fire risk of engineering procedure;

provide observance by all workers (service personnel) of the established requirements of fire safety;

provide venues of hot and flammable work with appropriate means of fire extinguishing and signs of safety;

not allow conducting temporary works using naked flame without registration in accordance with the established procedure of permission (work permit);

not allow blocking up of passes and approaches to the fire equipment, and also emergency exits and passes to rescue means;

provide operational content and permanent readiness for action of available fire extinguishing means, bonds and alarm systems, collective and individual remedies;

report immediately in case of the fire or emergency divisions of rescue service or GVGSS, to start at the same time the organization of liquidation of the fire by available forces and means, and also evacuation of people.

4.5. Employees of the companies shall:

nobility and follow requirements of these Rules and the instructions of rather fire safety developed on their basis, and also support the set fire prevention regime;

be able to use emergency firefighting equipment and to know their location;

in case of fire identification immediately to report about it to the head of object or the mountain dispatcher;

start fire extinguishing by means, available on object.

4.6. Liquidation of the fire shall be carried out according to PLA which is developed at each company according to requirements of GNAOP 1.1.30-5.17-02.

4.7. Factory jobs shall be performed according to projects, passports, technological schemes.

Projects of objects of the company shall pass the examination on compliance to regulations on fire safety in bodies of the Gospozharnadzor, and Sections of projects from fire protection of mines and the prevention of the fires from self-ignition of coal shall pass the examination in Research institution of mine-rescue case and fire safety "Respirator" (further - NIIGD "Respirator").

4.8. PPZ of the mine shall meet the special requirements (appendix 2).

4.9. At each company shall function two independent to communication type according to requirements of GNAOP 1.1.30-1.01-00.

4.10. In case of the fire PLA shall be enacted. Responsible works manager is the chief engineer of the mine (coal mine), and before its arrival - the shift mountain dispatcher. Their orders for all persons and the organizations which participate in fire liquidation are obligatory for accomplishment.

4.11. Operation of mining machines, mechanisms, electric equipments, devices, the equipment, remedies and materials is possible in the presence of permission of the State committee of Ukraine on supervision of labor protection (further - Gosnadzorokhrantruda) and sanitary and epidemiologic service of the Ministry of Health of Ukraine (further Gossanepidsluzhba).

4.12. At each company (the order, the instruction) the corresponding fire prevention regime shall be set, including:

place of smoking, instruction for use naked flame, heating devices;

procedure for carrying out hot and flammable work;

rules of journey and parking of vehicles;

places for storage and admissible amount of raw materials and coal which at the same time are in production placements and on the territories (in storage locations);

procedure for collection of coal dust and waste, storages of the oiled overalls and rags, cleaning of air ducts of ventilating systems of deposits;

procedure for disconnection from network of electroinstallations in case of the fire;

inspection routine and closings of rooms after completion of work;

procedure for passing by officials of training and examination concerning fire safety, and also carrying out with workers of fire-proof instructing and training sessions fire technically to minimum with appointment responsible for their carrying out (appendix 3);

procedure for the organization and servicing of available technical means of fire protection (fire-proof water supply system, pumping points, installations of the fire alarm and automatic fire extinguishing, smoke removal, fire extinguishers, etc.);

procedure for carrying out scheduled preventive maintenance and surveys of electroinstallations, heating, ventilating, processing and other engineering equipment;

actions of workers in case of fire detection.

Employees of the company shall be informed of these requirements on instructing, during passing of fire and technical minimum. Statements from the order (instruction) with basic provisions need to be hung out on foregrounds.

4.13. In buildings which have two floors more in case of simultaneous stay on the floor more than five persons shall be developed and hung out on foregrounds plans (schemes) of evacuation of people in case of the fire (appendix 4)

4.14 In case of change of the layout or functional purpose of structures (rooms, buildings), the production technology, the staff list of the company the administration shall provide timely adjustment of plans of evacuation and instructions.

4.15. At each company the procedure (scheme) for the notification of people about the fire with which it is necessary to acquaint all workers shall be established.

In rooms on foregrounds about phones it is necessary to hang out plates with designation of phone number for challenge of fire protection.

4.16. At each company the all-object instruction on measures of fire safety shall be developed and approved with bodies of the Gospozharnadzor.

This instruction shall be studied during fire-proof instructing, passing of fire and technical minimum, and also in system of inservice training and to be hung out on foregrounds.

4.17. Instructions in which it is necessary to determine shall be developed for workers of protection (security guards, porters, persons on duty and to that similar) by administration of the company: their obligations on control of observance of fire prevention regime, survey of the territory and rooms, mode of operation during identification of the fire, operation of means of the fire alarm and automatic fire extinguishing and also to specify which of officials of administration needs to be called at night in case of fire.

4.18. Officials of the companies (heads and specialists) prior to accomplishment of the obligations and periodically (once in three years) shall undergo training and examination in the specialized educational and methodical center for fire safety in case of NIIGD "Respirator" according to the program which is approved by the Ministry of Fuel and Energy of Ukraine (further - Mintoplivenergo) and is approved from Gosnadzorokhrantrud and State department of fire safety of the Ministry of Emergency Situations of Ukraine.

4.19. All workers during employment and on place of employment shall undergo instructing in questions of fire safety (further - fire-proof instructing). The procedure for the organization and carrying out fire-proof instructing, training fire technically in minimum and examinations of the worker is established by NAPB B.02.005-94.

Training fire technically in minimum shall be provided according to the special program (appendix 5) which considers specifics of the company, and also it is approved with the Gospozharnadzor, NIIGD "Respirator" and it is approved as the director. Training persons who were trained also shall instruct, and have certificates of the educational and methodical center in case of NIIGD "Respirator".

Results of instructing shall be displayed in the magazine of registration (appendix 6).

The admission to work of persons who were not trained examination, instructing in questions of fire safety, is prohibited.

4.20. Persons who are employed with the raised fire risk shall previously (prior to independent performance of work) to undergo special training (fire and technical minimum) and to have the corresponding qualification certificates (appendix 7).

Workers who are engaged at works with the raised fire risk shall undergo examination of the corresponding regulations on fire safety in training centers on advanced training of specialists once a year.

5. General requirements of fire safety to the territories, buildings, rooms and constructions of the companies

5.1. Content of the territories

5.1.1. The territory of the company, fire-proof gaps between buildings, constructions, storage areas of materials, the equipment shall be kept constantly clean and be cleared systematically of garbage, production wastes, container, the fallen-down foliage which need to be taken out to specially allotted places regularly.

5.1.2. Fire-proof gaps between houses, constructions, the open areas for storage of materials and the equipment shall conform to requirements of construction regulations. They are not allowed to be used for the parking of transport, construction of temporary buildings and constructions and so forth.

5.1.3. On sites of the territory of the companies where accumulation of combustible gases or vapors is possible, journey of cars and other transport is prohibited.

5.1.4. In the territory of the company on foregrounds plates with number of challenge of fire protection, signs which mark location of emergency firefighting equipment, traffic patterns of transport whom it is necessary to specify arrangement of buildings, water sources shall be established.

5.1.5. The main roads, drives, passes shall have hard surface. Arranging entrances for fire trucks to buildings, constructions and water sources on soil them it is necessary to strengthen slag, gravel or other local materials for entrance possibility in any time of the year.

5.1.6. Railway lines, temporary trenches and ditches shall not complicate movement of fire trucks. For this purpose in the right places convenient moving, always free for journey of fire trucks shall be equipped.

5.1.7. Roads, drives and passes to buildings, constructions, fire water sources, approaches to external fire-escapes, fire stock, the equipment and fire extinguishing means shall be always free, contain in good repair, to be cleared of snow in the winter.

It is forbidden to reduce randomly the normalized width of roads and drives.

5.1.8. Entrance gate on the territory of the company which open by means of the electric drive shall have the devices allowing to open them manually.

5.1.9. The territory of the company shall have external lighting which provides bystry finding of fire-escapes, the fire-fighting equipment, entrances to buildings and constructions.

5.2. Content of buildings, rooms and constructions of the mine

5.2.1. It is forbidden to smoke and use naked flame in underground developments, nadshakhtny buildings, rooms lamp, sorting, on the surface of the mine than 30 m from the diffuser of the fan and buildings of vent installations, about the mouth of developments which come to the land surface, and also in not specially established places are closer.

5.2.2. In buildings, rooms and constructions of the mine it is forbidden:

clean the room and wash clothes using gasoline, kerosene, other LVZh and GZh;

warm the frozen heating pipes blowtorches and by other methods using naked flame;

scatter and leave untidy the oiled materials. They need to be moved away in metal boxes, to close closely covers, and after completion of work to delete from the placement to specially allotted places for utilization.

5.2.3. All buildings, rooms and constructions need to be cleared of combustible garbage, production wastes in time and to keep constantly clean. Terms of cleaning are established by production schedules or instructions.

5.3. Deduction of evacuation ways and exits

5.3.1. Evacuation ways and exits shall be kept by free, not be encumbered and in case of the fire to ensure safety during evacuation of all people who are in the mine and nadshakhtny buildings.

The quantity and the sizes of emergency exits from the mine, buildings and rooms, their constructive and planning solutions, conditions of lighting, ensuring not smoke, extent of ways of evacuation, their facing shall conform to fire-proof requirements of construction regulations.

5.3.2. Indoors, which has one emergency exit, stay no more as 50 persons is allowed.

5.3.3. Doors on the ways of evacuation shall open in the direction of exit from buildings (rooms).

The device of doors with opening in the middle of the room in case of simultaneous stay in it no more than 15 persons, and also from platforms of external evacuation ladders is allowed (except for doors which conduct to the air area of nezadymlivanny staircase).

5.3.4. Staircases, ladders, corridors, passes and other ways of evacuation shall be equipped with evacuation lighting according to requirements of construction regulations and GNAOP 0.00-1.32-01. Lamps of evacuation lighting shall turn on with approach of twilight in case of stay in buildings of people.

Ways of evacuation which have no natural lighting shall be lit constantly with electrolamps (in the presence of people).

5.3.5. Not allowed

arrange on the ways of evacuation thresholds, ledges, tourniquets, sliding, podnimalny, revolving doors and other devices which interfere with free evacuation of people;

encumber ways of evacuation (corridors, passes, ladder marches and platforms, lobbies, halls, platforms and so forth) with furniture, the equipment, different materials even if they do not reduce normative width;

hammer, make, lock from within on suspended locks, bolt connections and other locks which hard open external evacuation doors of buildings.

6. Electrotechnical economy of the mine. Underground garages. Compressor installations and air ducts. Communication and alarm system. Lightning protection and grounding. Mine lighting

6.1. General requirements

6.1.1. Applied in mines electric equipment (cables) and utility power systems during operation shall provide electrical safety of workers of the mine, and also explosion - and fire safety.

6.1.2. Mine electroinstallations on the surface of mines, including in buildings and constructions of coal and pedigree complexes, shall conform to requirements of GNAOP 0.00-1.32-01, of PTE, standards, construction to regulations and rules.

6.2. Conditions of use of electric equipment

6.2.1.
