About approval of the state program of the Russian Federation "Complex development of the rural territories" and about introduction of amendments to some acts of the Government of the Russian Federation

The government of the Russian Federation decides:

1. Approve enclosed:

state program of the Russian Federation "Complex development of the rural territories";

changes which are made to acts of the Government of the Russian Federation.

2. To the Ministry of Agriculture of the Russian Federation to place the state program of the Russian Federation "Complex development of the rural territories" on the official site and on the portal of state programs of the Russian Federation on the Internet in 2 weeks time from the date of official publication of this resolution.

3. Recommend to executive bodies of subjects of the Russian Federation to develop and approve the state programs of subjects of the Russian Federation directed to goal achievement of the state program of the Russian Federation "Complex development of the rural territories" approved by this resolution.

4. To the Ministry of Agriculture of the Russian Federation, the Ministry of Finance of the Russian Federation and the Ministry of Economic Development of the Russian Federation when forming the draft of the federal budget for 2020 and for planning period of 2021 and 2022 to provide financing of the state program of the Russian Federation "Complex development of the rural territories".

5. The Item of 2 changes approved by this resolution becomes effective since January 1, 2020.

Appendix №. 3

to the state program of the Russian Federation "Complex development of the rural territories"

Rules of provision and distribution of subsidies from the federal budget to budgets of subjects of the Russian Federation on improvement of housing conditions of the citizens living in the rural territories

1. These rules establish procedure and conditions of provision and distribution of subsidies from the federal budget to budgets of subjects of the Russian Federation on actions for improvement of housing conditions of the citizens of the Russian Federation (further - citizens) living in the rural territories (further - subsidies).

The rural territories in these rules are understood as the rural settlements or rural settlements and the mezhselenny territories combined by the general territory in borders of the municipal district, the rural settlements, working settlements which are part of city districts (except for city districts in the territory of which there are administrative centers of subjects of the Russian Federation), residential locations and intracity municipalities  of Sevastopol. The list of such rural settlements and working settlements in the territory of the subject of the Russian Federation is determined by the supreme executive body of the government of the subject of the Russian Federation or executive body of the subject of the Russian Federation, authorized supreme executive body of the government of the subject of the Russian Federation (further - executive body).

The specified concept does not include intracity municipalities of of Moscow and St. Petersburg.

2. Subsidies are provided for the purpose of providing financial support in case of execution of payment commitments of the subjects of the Russian Federation arising in case of implementation of actions of state programs of subjects of the Russian Federation (subprogrammes of state programs of the subjects of the Russian Federation) aimed at the complex development of the rural territories including actions for improvement of housing conditions of the citizens living in the rural territories providing to citizens of social payments on construction (acquisition) of housing (further - social payments) according to the procedure and on conditions which are established according to appendix.

3. The subsidy is provided in case of observance of the following conditions:

a) availability of the legal acts of the subject of the Russian Federation approving the list of actions for the purpose of which joint financing the subsidy, according to requirements of regulatory legal acts of the Russian Federation is provided;

b) availability in the budget of the subject of the Russian Federation of budgetary appropriations on execution of payment commitment of the subject of the Russian Federation which joint financing is performed from the federal budget, in the amount necessary for its execution including the size of the subsidy planned to provision from the federal budget, and procedure for determination of amounts of the specified assignments if other is not established by acts of the President of the Russian Federation or the Government of the Russian Federation;

c) agreement signature between the Ministry of Agriculture of the Russian Federation and the supreme executive body of the government of the subject of the Russian Federation about provision of subsidy (further - the agreement) according to Item 10 of Rules of forming, provision and distribution of subsidies from the federal budget to budgets of the subjects of the Russian Federation approved by the order of the Government of the Russian Federation of September 30, 2014 No. 999 "About forming, provision and distribution of subsidies from the federal budget to budgets of subjects of the Russian Federation" (further - Rules of provision of subsidies).

4. Subsidies are provided within limits of the budget obligations brought in accordance with the established procedure to the Ministry of Agriculture of the Russian Federation as the receiver of funds of the federal budget for the purposes specified in Item 2 of these rules.

5. Selection criteria of subjects of the Russian Federation for provision of subsidies are:

a) availability of summary participant lists of actions for improvement of housing conditions of the citizens living in the rural territories - receivers of social payments on the corresponding financial period (further - participants of actions) which form is established by the Ministry of Agriculture of the Russian Federation (further - summary lists);

b) availability of the request for provision of subsidy for the next financial year and planning period which form is established by the Ministry of Agriculture of the Russian Federation (further - the request).

6. In case of distribution of subsidies between budgets of subjects of the Russian Federation the subsidy size in the next financial year cannot exceed the size of funds for execution in the next financial year of payment commitment of the subject of the Russian Federation for the purpose of which joint financing the subsidy, taking into account limit of joint financing of payment commitment of the subject of the Russian Federation from the federal budget is provided.

7. The size of the subsidy provided to the budget of i-go of the subject of the Russian Federation for the corresponding financial year (Ci) is determined by formula:

where:

Vmin - the minimum size of the subsidy provided to the budget of i-go of the subject of the Russian Federation, the making 1 million rubles. If the size of means of the federal budget provided by the request is less than minimum size of subsidy, the subsidy is provided in the amount of, specified in the request;

Vfb - amount of the budgetary appropriations provided by the Federal Law on the federal budget for the next financial year and planning period to the Ministry of Agriculture of the Russian Federation on actions for improvement of housing conditions of the citizens living in the rural territories;

n - the number of the subjects of the Russian Federation who submitted requests;

DNUI - the share of participants of the actions included in summary lists, in i-m the subject of the Russian Federation in total number of participants of actions in the Russian Federation, determined by data of executive bodies for the next financial year;

Yi - limit of joint financing of payment commitment of i-go of the subject of the Russian Federation from the federal budget for the next financial year (as a percentage) determined according to Item 13 of Rules of provision of subsidies.

8. The subsidy size determined according to Item 7 of these rules is specified according to requests.

If the subsidy size determined according to Item 7 of these rules is more than size of means requested in the request, the size of subsidy is subject to reducing to the size of means specified in the request.

The released means are redistributed between budgets of the subjects of the Russian Federation having the right to subsidies according to these rules in proportion to the size of subsidies determined according to Item 7 of these rules.

If when forming the federal law draft about the federal budget for the next financial year and planning period the subject of the Russian Federation till August 1 of the current financial year provides to the Ministry of Agriculture of the Russian Federation the address containing information on lack of the need for subsidy in full or in its part, the unclaimed subsidy is distributed between budgets of other subjects of the Russian Federation having the right to subsidy according to these rules.

9. Distribution (redistribution) of subsidies between budgets of subjects of the Russian Federation affirms the Federal Law on the federal budget for the corresponding financial year and planning period.

10. The subsidy is provided based on the agreement prepared (created) with use of the state integrated management information system public finance "The electronic budget" for the standard form approved by the Ministry of Finance of the Russian Federation.

The subject of the Russian Federation has the right to increase amount of budgetary appropriations by financial provision of payment commitments of the subject of the Russian Federation for the purpose of which joint financing the subsidy, including for the purpose of achievement of measure value of effectiveness of use of subsidy determined by the agreement that will not entail emergence of obligations on increase in the size of subsidy is provided to the budget of the subject of the Russian Federation.

11. The executive body represents to the Ministry of Agriculture of the Russian Federation data on the course of implementation of actions on improvement of housing conditions of the citizens living in the rural territories in form and in time which are established by the Ministry of Agriculture of the Russian Federation.

12. Transfer of subsidies is performed in accordance with the established procedure into the accounts opened for territorial authorities of the Federal Treasury in organizations of the Central bank of the Russian Federation for accounting of transactions with means of budgets of subjects of the Russian Federation.

13. If the subject of the Russian Federation as of December 31 of year of provision of subsidy allows violations of the obligations provided by the agreement according to the subitem "b" of Item 10 of Rules of provision of subsidies and about day of submission of the report on achievement of measure value of effectiveness of use of subsidy specified in Item 15 of these rules according to the agreement in the year following after year of provision of subsidy, the specified violations are not eliminated, the size of the means which are subject to return from the budget of the subject of the Russian Federation to the federal budget till June 1 of the year following after year of provision of subsidy is calculated according to Items 16 - 18 Rules of provision of subsidies.

14. Release of subjects of the Russian Federation from application of measures of responsibility, stipulated in Item 13 these rules, and also return of means from the budget of the subject of the Russian Federation in the federal budget are performed according to Item 20 of Rules of provision of subsidies.

15. Efficiency of use of subsidies is estimated annually by the Ministry of Agriculture of the Russian Federation on the basis of indicator of effectiveness of use of subsidy - amount of input (acquisition) of housing for the citizens living in the rural territories.

16. The efficiency evaluation of use of subsidies is made by comparison of actually reached measure values of effectiveness of use of subsidies for the corresponding year with the measure values of effectiveness of use of subsidies provided by agreements.

17. In case of violation by the subject of the Russian Federation of conditions of provision of subsidy, and also non-return by the subject of the Russian Federation of means in the federal budget according to the procedure and on conditions which are established by Rules of provision of subsidies the budget enforcement measures provided by the budget legislation of the Russian Federation are applied to it.

18. Responsibility for reliability of the data represented to the Ministry of Agriculture of the Russian Federation and observance of conditions of provision of subsidies is assigned to executive body.

19. Control of observance by subjects of the Russian Federation of conditions of provision of subsidies is exercised by the Ministry of Agriculture of the Russian Federation and bodies of the state financial control.

 

Appendix

to Rules of provision and distribution of subsidies from the federal budget to budgets of subjects of the Russian Federation on improvement of housing conditions of the citizens living in the rural territories

Regulations on provision of social payments on construction (acquisition) of housing to the citizens living in the rural territories

I. General provisions

1. This Provision establishes procedure for provision of social payments on construction (acquisition) of housing, including by participation in shared-equity construction, to the citizens of the Russian Federation (further - citizens) who are living and working at the rural territories or showed willingness to move to the permanent residence on the rural territories and to work there (further - social payments).

2. Social payments to citizens are provided at the expense of means of the federal budget, budget of the subject of the Russian Federation and (or) local budgets.

3. Social payments are not provided to citizens, and also the members of their families who earlier exercised the right to improvement of housing conditions in the rural territories with use of means of social payments or other form of the state support at the expense of the means of the federal budget, budget of the subject of the Russian Federation and (or) local budgets provided on improvement of housing conditions.

Social payments on improvement of housing conditions in the rural territories are not provided to citizens before whom the state has obligations on provision of housing in accordance with the legislation of the Russian Federation.

II. Procedure for provision of social payments

4. The citizen is understood as the physical person who is the citizen of the Russian Federation. His spouse (spouse), and also the children including adopted and parents treat members of the family of the citizen for the purpose of this provision constantly living (registered at the place of residence) together with him. Other relatives and disabled dependents are recognized members of the family of the citizen if they are installed by him to premises in the place of his residence. In exceptional cases other persons can be recognized as members of the family of this citizen judicially.

the citizen who moved to the rural territories in borders of the respective municipal district (the city district), to whom works or performs individual business activity in the field of agro-industrial complex, or the social sphere, or in the organizations performing veterinary activities for farm animals (principle place of employment) from other municipal district or the city district (except for the city district in the territory of which there is administrative center of the respective municipal district);

having own and (or) borrowed funds in the amount of at least 30 percent of the settlement construction cost (acquisition) of housing determined according to Item 15 of this provision, and also the means necessary for construction (acquisition) of housing in case, stipulated in Item the 20th this provision.
