About establishment of Rates of service fee on aeronautical servicing of aircrafts in airspace of Ukraine

According to the resolution of the Cabinet of Ministers of Ukraine of December 25, 1996 to No. 1548 "About establishment of powers of executive bodies and executive bodies of city councils concerning price regulation (rates)", to the paragraph to third the subitem 36 of item 4 of the Regulations on the Ministry of infrastructure of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of June 30, 2015 No. 460, for the purpose of enhancement of the state tariff policy in the transport sphere I ORDER:

1. Approve Rates of service fee on aeronautical servicing of aircrafts in airspace of Ukraine which are applied.

2. To provide to the state company of servicing of air traffic of Ukraine publication of Rates of service fee on aeronautical servicing of aircrafts in airspace of Ukraine in the collection of aeronautical information (AIP) of Ukraine.

3. Declare invalid the order of the Ministry of Transport and Communications of Ukraine of September 15, 2010 No. 669 "About establishment of Rates of service fee on aeronautical servicing of aircrafts in airspace of Ukraine", registered in the Ministry of Justice of Ukraine on September 24, 2010 for No. 844/18139.

4. To provide to department of the air transportation:

1) submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure;

2) promulgation of this order on the official website of the Ministry of infrastructure of Ukraine.

5. This order becomes effective from the date of its official publication.

6. I reserve control of execution of this order.

Rates of service fee on aeronautical servicing of aircrafts in airspace of Ukraine

1. For services on aeronautical to servicing (further - ANO) aircrafts (further - AF) in airspace of regions of flight information of Ukraine (further - VP RPI) on route, and also on the way and around airfield, levies payment according to the rates.

2. Single rates of payment are established irrespective of national identity of AF and pattern of ownership of the operator.

3. The size of service fee on ANO on route for flight in VP RPI is calculated on formula

where:	r	-	the size of service fee on ANO on route;
	t	-	single rate of service fee on ANO on route;
	n	-	quantity of units of servicing of such flight.

For each specific flight the quantity of units of servicing (n) is determined by formula

n = d x p,

where:	d	-	distance coefficient for VP RPI;
	p	-	weight coefficient for the corresponding AF.

The distance coefficient for VP RPI (d) is determined by division into the 100th of ortodromichesky kilometric distance between airfield of departure within VP RPI or point of entry into VP RPI and the airport of the first landing within VP RPI or VP RPI exit point.

The Ortodromichesky distance which is taken into account decreases by 20 kilometers for each take-off and for each landing to the territories of Ukraine.

The weight coefficient for the corresponding AF (p) expressed by number with two decimal signs after comma is determined as square root from share from division on 50th maximum certified the take-off mass of AF (in metric tons, with one decimal sign after comma) specified in the Management on flight operation of AF (AFM) or, in case of its absence, in other equivalent official document, by formula

the maximum certified take-off mass of AF (further - MTOW) in metric tons, with one decimal sign after comma, specified in the Management on flight operation of AF (AFM) or, in case of its absence, in other equivalent official document in which the producer of the corresponding AF determines MTOW.

If MTOW of this AF is unknown, for calculation of weight coefficient the mass of the heaviest known AF of the same type undertakes.

If for one AF there are several MTOW values, the weight coefficient is determined on the basis of the greatest MTOW permitted for this AF by the state of its registration.

If the operator uses two or more AF of different modifications of one type, for calculation of weight coefficient for each of this AF average MTOW value of all its AF of this type is used.

Changes concerning the AF park of the operator shall be reviewed at least once a year.

4. The single rate of service fee on ANO on route (t) for flights in VP RPI within the geographical coordinates determined in appendix to these Rates is established in the amount of 25, 00 euros.

The single rate of service fee on ANO on route (t) for flights in VP RPI, except VP RPI within the geographical coordinates determined in appendix to these Rates is established in the amount of 51, 10 euros.

5. The size of service fee by ANO on the way and around airfield is determined by formula

	T	-	single rate of service fee on ANO on the way and around airfield;
	N	-	the quantity of units of servicing expressed by number with two decimal signs after comma which is determined as private from division on 50th maximum certified the take-off mass of AF which is built in 0,70, degree on formula

MTOW of AF in metric tons (with one decimal sign after comma) specified in the Management on flight operation of AF (AFM) or, in case of its absence, in other equivalent official document in which the producer of the corresponding AF determines MTOW. If MTOW of this AF is unknown, for calculation the mass of the heaviest known AF of the same type undertakes.

The single rate of service fee on ANO on the way and around airfield (T) is established (for all types of servicing of air traffic) in the amount of 290, 00 euros for flights for the international airports "Boryspil" and "Kiev / Zhulyany" and in the amount of 411, 00 euros for all other airports of Ukraine.

6. Single rates of service fee on ANO VS in VP RPI are established excluding tax on value added. Charge of tax amounts on value added is made according to the current legislation of Ukraine.

7. Such categories of flights are exempted from service fee on ANO:

the flights performed by AF with the most admissible take-off weight less than two metric tons;

flights which are performed with official mission only for transportation of royal persons and direct members of their families, Heads of States and Governments, ministers. In all cases it shall be confirmed with the status of flight in the corresponding flight plan;

flights for the purpose of search and rescuing which are carried out on the instructions of competent authorities;

flights which terminate in airfield of departure and are performed without intermediate landings;

flights for check and testing of the equipment which is used as land aeronautical means;

educational and training flights which are carried out only for receipt of the certificate of aviation personnel or increase in skill level of crew members about what it is specified in flight plan, and at the same time are performed only within VP RPI and not used for transportation of passengers, load, movement or transfer of AF;

flights of AF which are entered in the Register of the state aircrafts of Ukraine and are carried out with non-commercial purpose;

humanitarian flights which status is determined by authorized state body of Ukraine.
