2) within ten calendar days from the date of state registration of this order the direction in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

Rules of certification and issue of the air operator certificate of civil aircrafts

Chapter 1. General provisions

1. These rules of certification and issue of the air operator certificate of civil aircrafts (further - Rules) are developed according to requirements of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further - the Law) Appendices 6 Conventions on the international civil aviation ratified by the resolution of the Supreme Council of the Republic of Kazakhstan of July 2, 1992.

2. Rules determine procedure for certification, issue, suspension and withdrawal of the air operator certificate of civil aircrafts (further - the air operator certificate) the airlines performing commercial transportations of passengers, baggage, load and mailings (airborne transportations).

3. The air operator certificate is issued for a period of two years with indication of area and effective period, and is not subject to transfer to other person.

4. The airline which for the first time received the air operator certificate granting the right of accomplishment of the international commercial transportations is registered in International Civil Aviation Organization (further - ICAO). The trigram code and conditional telephone call sign is assigned for airline.

Registration is performed by means of the inquiry sent by authorized organization civil aviation (further - authorized organization) in ICAO.

5. For certification of the operator of civil aircrafts collection according to the procedure and the size, determined by the subitem 1) of Item 7 of article 554 of the Code of the Republic of Kazakhstan of December 25, 2017 "About taxes and other obligatory payments in the budget (Tax code)" is levied.

6. Certification is performed in the following procedure:

1) the stage preceding application;

2) giving by the applicant in authorized organization of the request with documents;

3) assessment of documentation and decision making;

4) carrying out certified inspection of the applicant by authorized organization;

5) decision making and issue (refusal in issue) the air operator certificate.

7. Aggregate term of certification and issue of the air operator certificate - sixty four working days from the moment of application.

8. In Rules the following terms and determinations are used:

1) the air operator certificate of civil aircrafts - the document issued by authorized organization (authorized body), certifying the operator's compliance to certified requirements and Rules;

2) the request - the appeal of the applicant to authorized organization for receipt of the air operator certificate of civil aircrafts (further - the request);

3) the applicant - the physical person or legal entity of the Republic of Kazakhstan which addressed to authorized organization for receipt of the air operator certificate of civil aircrafts;
