About approval of the Regulations on Committee of forestry and fauna of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan

According to the order of the Government of the Republic of Kazakhstan of July 5, 2019 No. 479 "Some questions of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan", the subitem 6) of Item 1 of the Powers of the responsible secretary approved by the Presidential decree of the Republic of Kazakhstan of July 27, 2007 No. 372, I ORDER:

1. Approve the enclosed Regulations on Committee of forestry and fauna of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan.

2. To provide to committee of forestry and fauna of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) the direction of the copy of this order in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan;

3) acceptance of other measures following from this order.

3. To impose control of execution of this order on the supervising vice-minister of ecology, geology and natural resources of the Republic of Kazakhstan.

4. This order becomes effective from the date of its signing.

Regulations on Committee of forestry and fauna of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan

Chapter 1. General provisions

1. The republican public institution "Committee of forestry and fauna of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan" (further - Committee) is the state body and department within competence of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan (further - the Ministry) performing the strategic, regulating, realizable and control functions in the field of forestry, protection, reproduction and use of fauna and especially protected natural territories assigned to it by the Constitution, the laws, other regulatory legal acts of the Republic of Kazakhstan and this Provision.

2. The committee performs the activities according to the Constitution and the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.

3. The committee is legal entity in form of business of public institution, has seals and stamps with the name in state language, forms of the established sample, according to the legislation of the Republic of Kazakhstan of the account in bodies of treasury.

4. The committee enters the civil relations from own name.

5. The committee has the right to act as the party of the civil relations on behalf of the state if it is authorized on it according to the legislation.

6. The committee on questions of the competence of the procedure established by the legislation makes the decisions which are drawn up by orders of the chairman of Committee and other acts, stipulated by the legislation the Republic of Kazakhstan.

7. The structure and limit of the number of staff of Committee affirm according to the current legislation of the Republic of Kazakhstan.

8. Location of the legal entity: Republic of Kazakhstan, 010000, Nour-Sultan's city, Esilsky district, Ulitsa Mang_l_k El, house 8, office building "House of the ministries".

9. Full name of state body - republican public institution "Committee of forestry and fauna of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan".

10. This Provision is the constituent document of Committee.

11. Financing of activities of Committee is performed only from the republican budget.

12. The committee is forbidden to enter contractual relations with subjects of entrepreneurship regarding accomplishment of the obligations which are powers of Committee.

If the Committee by legal acts is granted the right to perform the activities which are bringing in incomes, then income gained from such activities go to the income of the government budget.

Chapter 2. Tasks, rights and obligations of Committee

13. Tasks:

accomplishment of strategic, realizable and control functions in the field of forestry, protection, reproduction and use of fauna and especially protected natural territories.

14. Rights and obligations:

1) to adopt regulatory legal acts, obligatory for execution, within the competence;

2) to request and receive in the procedure established by the legislation from state bodies, the organizations, their officials necessary information and materials;

3) to perform other rights and obligations, stipulated by the legislation the Republic of Kazakhstan.

4) to provide availability of standards of the state services;

5) to provide knowledge of receivers of the state services of procedure for rendering the state services;

6) to participate in provision of the relevant information in authorized body on quality evaluation of rendering the state services and control of quality of rendering the state services, authorized body in the field of informatization for evaluating quality of rendering the state services;

7) to participate in provision of the relevant information to the non-profit organizations which are carrying out public monitoring in the procedure established by the legislation;

8) to consider claims and addresses of receivers of the state services;

9) to observe the legislation of the Republic of Kazakhstan, it is right also the interests of physical persons and legal entities protected by the law;

Timely and qualitatively to carry out 10) assigned according to this Provision and the legislation of the Republic of Kazakhstan to Committee of function.

15. Functions:

1) is performed by ownership and use of the state forest fund within the competence established by the Government of the Republic of Kazakhstan;

Develops 2) and realizes offers on forming of the state forest policy;

Organizes 3) and provides protection, protection, reproduction of the woods and afforestation, regulates forest utilization in the territory of the state forest fund which is under its functional authority;

4) exercises by checks the state control and supervision of condition, protection, protection, use of forest fund, reproduction of the woods and afforestation;

5) exercises the state control and supervision of accomplishment of actions for protection of the woods against wreckers and diseases, timeliness of the taken measures for the prevention of origin, distribution, accuracy of accounting and forecasting of the centers of wreckers and diseases of the wood, easing and death of plantings from adverse effects of natural, anthropogenous nature;

6) exercises the state control and supervision of withdrawal of cutting areas;

7) exercises the state control and supervision of observance of rules of leave of wood on root and cabins of the wood, other rules of forest utilization on sites of the state forest fund;

8) exercises the state control and supervision of observance of forest seed division into districts, rules of procurement, conversion, storage and use of forest seeds and control of their quality, maintaining nursery economy on sites of the state forest fund;

9) exercises the state control and supervision of use of lands of forest fund according to their purpose and protection of these lands;

10) exercises the state control and supervision of observance of procedure for use of the state forest fund in case of construction works, mining, laying of communications and accomplishment of other works which are not connected with forest management and forest utilization;

11) provides development and approves settlement cutting areas on sites of the state forest fund and age of cabins;

12) develops rules of conducting the state accounting of forest fund, the state forest inventory, the state monitoring of the woods and forest management in the territory of the state forest fund and provides their maintaining;

13) international cooperation in the field of protection performs, protection, reproduction of the woods, afforestation and forest utilization according to the principles established by the international treaties ratified by the Republic of Kazakhstan;

14) the report of the head of the structural unit of local executive body of area, city of the republican value, the capital knowing forestry hears and also heads of forest organizations and the nature protection organizations for condition, protection, protection, use of forest fund, reproduction of the woods and afforestation;

Stops 15), limits, stops the forest utilization right on sites of the state forest fund, and also the works constituting danger to condition and reproduction of the woods which are under its authority according to the legislation of the Republic of Kazakhstan;

16) determines the directions of scientific and technical development, organizes scientific research and design and exploration work in the field of protection, protection and uses of forest fund, reproduction of the woods and afforestation, forest selection and forest seed farming;

Organizes 17) and holds tenders for provision of forest resources in long-term forest utilization on the sites of the state forest fund which are under its authority with participation of representatives of local representative and executive bodies of area, city of republican value, the capital;

18) considers cases on administrative offenses in the field of the forest legislation of the Republic of Kazakhstan, the legislation of the Republic of Kazakhstan in the field of protection, reproduction and use of fauna and especially protected natural territories;

19) performs coordination and methodical management of local executive bodies of areas, the cities of republican value, the capital knowing forestry and also forest organizations and the nature protection organizations for protection, protection, use of forest fund, reproduction of the woods and afforestation;

20) approves forest management projects;

Creates 21) according to rules of leave of wood on root on sites of the state forest fund and approves annual amounts of cabins of the wood in the territory of the state forest fund;

22) is approved by forest seed division into districts;

23) provides to forest users sites under construction objects on the lands of the state forest fund which are under its authority where forest resources are provided in long-term forest utilization for the improving, recreational, historical and cultural, tourist and sports purposes; needs of hunting economy; collateral forest use;

24) develops base rates for calculation of the extent of the harm done by violation of the forest legislation of the Republic of Kazakhstan;

25) determines requirements to the plans of fire-proof actions developed by forest users in case of long-term forest utilization;

26) exercises the state control of the local executive bodies of areas, the cities of republican value, the capital knowing forestry and which are especially protected by the natural territories;

27) makes the decision on prohibition of cabins of the wood on sites of the state forest fund in case of threat of degradation or death of the woods;

28) performs cross-industry coordination of activities of state bodies in the field of especially protected natural territories;

29) realizes state policy in the field of especially protected natural territories;

30) exercises by checks the state control and supervision of observance of the modes of protection in the woods of especially protected natural territories;

31) makes offers on creation and expansion of especially protected natural territories of republican value, and also transfer of lands of especially protected natural territories to lands of inventory only in the cases established by part two of Item 2 of article 23 of the Law of the Republic of Kazakhstan of July 7, 2006 "About especially protected natural territories" within the competence;

32) is developed by procedure and makes offers on abolition of the state natural wildlife areas of republican and local value and the state reserved zones of republican value and reduction of their territory;

33) approves the sizes of rates for the services provided by especially protected natural territories of republican value with the status of the legal entity which are under its authority according to the legislation of the Republic of Kazakhstan;

Approves 34) natural-science and feasibility statements on creation and expansion of especially protected natural territories of republican value;

35) is approved symbolics (emblems and flag) of the nature protection organization, and also by procedure for development and use of symbolics (emblems and flag) of nature protection organization;

36) approves provisions of the nature protection organizations which are under its authority;

37) approves fishing amounts on the water objects which are part of especially protected natural territories with the status of the legal entity;

38) considers reports of the central and local executive bodies concerning condition, protection, protection, use and financing of especially protected natural territories which are under their authority;

39) will organize project development natural-science and feasibility statements on creation and expansion of especially protected natural territories of republican value which are under its authority, ecological corridors and their approval;

40) performs management of especially protected natural territories which are under its authority, ensuring carrying out their protection, protection and recovery, and also scientific research;

41) will organize scientific activities in especially protected natural territories of republican value;

42) is conducted by the state inventory of especially protected natural territories;

43) exercise the state control and supervision of condition, protection, protection and use of especially protected natural territories and objects of the state natural and reserved fund which are under their authority;

44) is performed by approval of general schemes of the organization of the territory of the Republic of Kazakhstan, interregional schemes of territorial development, complex schemes of town-planning planning and other town-planning documentation mentioning the territories of ecological corridors;

45) is performed by production on cases on administrative offenses within the competence established by the laws of the Republic of Kazakhstan;

46) performs issue of import permits on the territory of the Republic of Kazakhstan, export and (or) re-export from the territory of the Republic of Kazakhstan of the animal species falling under operation of the Convention on international trade in the types of wild fauna and flora which are under the threat of disappearance;

Develops 47) and approves form of the reporting under certification of the hunter;

48) issues permissions to production of introduction, reintroduction, hybridization of animals;

Will organize 49) and (or) provides carrying out scientific research and design and exploration work in the field of protection, reproduction and use of fauna;

50) will be organized by conducting the state accounting, the inventory and monitoring of fauna;

51) realizes state policy in the field of protection, reproduction and use of fauna;

Conducts 52), places and quarterly updates the register of zoological collections on Internet resource;

53) exercises the state control of observance of procedure of introduction, reintroduction, and hybridization of animals;

54) is checked by activities of users fauna for the purpose of determination of observance of requirements of the legislation of the Republic of Kazakhstan in the field of protection, reproduction and use of fauna;

55) exercises the state control and supervision in the field of protection, reproduction and use of fauna;

56) exercises control of observance of rules of maintaining hunting economy;

57) exercises control of observance of rules of hunting;

58) exercises control of observance of regulations and standard rates in the field of protection, reproduction and use of fauna;

59) exercises control and supervision of accomplishment of actions for protection, reproduction and use of fauna;

60) exercises control and supervision of observance of the set restrictions and prohibitions on use of fauna;

61) coordinates the feasibility statement and the design estimates developed by the subjects performing the economic and other activity specified in Items 1 and 2 of article 17 of the Law of the Republic of Kazakhstan of July 9, 2004 "About protection, reproduction and use of fauna";

62) is issued by the conclusion (the allowing document) for export from customs area of the Eurasian Economic Union of wild live animals, including rare and being under the threat of disappearance;

Will organize 63) and provides reproduction and the state accounting of fauna in reserve fund of hunting grounds;

64) makes the decision on introduction of restrictions and prohibitions on use of objects of fauna, their parts and derivatives, transfer of fixed terms of use and (or) prohibition on use of fauna objects, establishes places and terms of their use based on the biological reasons issued by the relevant scientific organizations, which are subject to the state environmental assessment;

65) provides information on procedure for rendering the state services in Single contact center concerning rendering the state services;

66) exercises the state control and supervision of local executive bodies in the field of protection, reproduction and use of fauna.

67) is stopped by activities of physical persons and legal entities in case of identification of violations of the law of the Republic of Kazakhstan in the field of especially protected natural territories, protection, reproduction and use of fauna, the forest legislation of the Republic of Kazakhstan;

68) performs other functions provided by the laws of the Republic of Kazakhstan, acts of the President, the Government of the Republic of Kazakhstan and the Minister of ecology, geology and natural resources of the Republic of Kazakhstan.

Chapter 3. The status and powers of the Chairman of Committee under the organization of its activities

16. Management of Committee is performed of the chairman of Committee who bears the personal responsibility for accomplishment of the tasks assigned to Committee and implementation of the powers by it.

17. The chairman of Committee is appointed to position and dismissed according to the legislation of the Republic of Kazakhstan.

18. The chairman of Committee has deputies who are appointed to positions and are dismissed according to the legislation of the Republic of Kazakhstan.

19. Powers of the chairman of Committee:

1) within the competence signs orders;

2) according to the legislation appoints to positions and dismisses employees of Committee, (except for workers whose questions of employment relationships according to legal acts are carried to competence of higher state bodies and officials);

3) in coordination with the Ministry appoints to positions and dismisses heads of the subordinated organizations and their deputies;

4) No. 232-O is excluded according to the Order of the Chief of staff of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan of 22.06.2022

5) No. 232-O is excluded according to the Order of the Chief of staff of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan of 22.06.2022

6) appoints to positions and dismisses deputy managers of territorial subdivisions;

7) makes the offer in the Ministry on encouragement and attraction to disciplinary responsibility of heads territorial;

8) determines obligations and powers of the deputies, heads of structural divisions, territorial authorities and subordinated organizations of Committee;

9) within the competence takes the measures directed to anti-corruption in Committee and bears the personal responsibility for taking measures to anti-corruption;

Encourages 10) and imposes authority punishments on employees of Committee (except for workers whose questions of employment relationships according to legal acts are carried to competence of higher state bodies and officials), and also on heads of the subordinated organizations and their deputies;

11) resolves sending issues (except for sending the abroad), rendering financial support, preparation, retraining and advanced training, encouragement, payment of allowances to heads of territorial subdivisions;

12) in the procedure established by the legislation resolves issues of sending, provision of leaves, rendering financial support, preparation (retraining), advanced training, payment of allowances and awarding of deputies of territorial authorities, heads of the subordinated organizations and their deputies, and also employees of Committee (except for workers whose questions of employment relationships according to legal acts are carried to competence of higher state bodies and officials);

13) in the procedure established by the legislation resolves issues of assignment of obligations of heads of territorial authority of Committee on the deputy manager or other employee of territorial authority for the period of its absence;

14) approves Provisions of structural divisions of Committee and within the competence constituent documents of the subordinated organizations of Committee, and also provision of the territorial authorities which are under authority of Committee;

15) approves job descriptions of staff of Committee, heads of the subordinated organizations and their deputies (except for workers whose questions of employment relationships according to legal acts are carried to competence of higher state bodies and officials);

16) approves structure and staff lists of the subordinated organizations of Committee;

17) develops offers on forming of state policy in the regulated sphere;

18) determines competence and order of interaction of territorial authorities with Committee;

Cancels 19) or stops completely or in part operation of acts of territorial authorities and subordinated organizations;

20) is represented by Committee in state bodies and other organizations without power of attorney;

21) performs the common directorship of financial and economic activities and carrying out public procurements in Committee;

22) performs other powers according to the laws and acts of the President of the Republic of Kazakhstan.

Execution of powers of the chairman of Committee in the period of its absence is performed by person replacing it according to the current legislation of the Republic of Kazakhstan.

20. The chairman of Committee determines powers of the deputies according to the current legislation.

Chapter 4. Property of Committee

21. The committee can have on the right of operational management the isolated property in cases, stipulated by the legislation.

The property of Committee is created at the expense of the property given it by the owner and also the property (including money expenditure) acquired as a result of own activities, and other sources which are not prohibited by the legislation of the Republic of Kazakhstan.

22. The property assigned to Committee belongs to republican property.

23. The committee has no right to alienate independently or to dispose otherwise of the property assigned to it and the property acquired at the expense of the means issued to it according to the plan of financing if other is not established by the legislation.

Chapter 5. Reorganization and abolition of Committee

24. Reorganization and abolition of Committee are performed according to the legislation of the Republic of Kazakhstan.
