About modification of the order of the acting minister on investments and development of the Republic of Kazakhstan of October 16, 2015 No. 994 "About approval of Rules of certification and issue of the certificate of type"

I ORDER:

1. Bring in the order of the acting minister on investments and development of the Republic of Kazakhstan of October 16, 2015 No. 994 "About approval of Rules of certification and issue of the certificate of type" (it is registered in the Register of state registration of regulatory legal acts for No. 12812, it is published on January 18, 2016 in information system of law of Ad_let) the following change:

The rules of certification and issue of the certificate of type approved by the specified order to state in edition according to appendix to this order.

2. To provide to committee of civil aviation of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan;

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

4. This order becomes effective since August 1, 2019 and is subject to official publication.

Rules of certification and issue of the certificate of type

Chapter 1. General provisions

1. These rules of certification and issue of the certificate of type (further - Rules) are developed according to subitem 41-20) of Item 1 of article 14 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further - the Law) and determine procedure for certification and issue of the certificate of type.

2. The terms and determinations used in these rules:

1) the contractor (manufacturer) - the organization performing designing, construction of prototypes of the aircraft equipment and release of serial aircrafts (further - AF), engines and the equipment;

2) developer - the physical person or legal entity performing development of the civil aircraft;

3) production tests - finishing sample of the aircraft, its characteristics and operational documentation to compliance to requirements of certified basis;

4) the state testing - demonstration of compliance of sample of the civil aircraft to airworthiness standards;

5) the request - the written appeal of the applicant to authorized organization in the field of civil aviation for receipt of the Certificate of type on sample of the civil aircraft;

6) the operator - the physical person or legal entity which is engaged in operation of civil aircrafts or offering the services in this area;

7) operational documentation - documentation regulating flight and technical operation of the aircraft and component, including maintenance, and containing operational restrictions, procedures and recommendations;

8) operating tests - testing of sample of the aircraft in the course of its operation on the earth and in air in different climatic (physical) conditions;

9) the holder Sertifikata of type is the developer who received from authorized organization in the field of civil aviation the Certificate of type on aircraft sample;

10) the certificate of type - the document confirming compliance with airworthiness standards of design like the civil aircraft.

3. For certification like the civil aircraft collection according to the procedure and the size determined by the Code of the Republic of Kazakhstan of December 25, 2017 "About taxes and other obligatory payments in the budget" (Tax code) is levied. Certification like the civil aircraft is performed after payment in the government budget of the specified collection.

4. In the course of serial production the holder Sertifikata of type organizes storage of sets of working design documentation and provides author's control of serial production, preserving stability of properties of materials, engineering procedures, permanencies of characteristics of details and nodes for serially made copies of the certified sample.

5. Prior to conducting production tests of sample of the civil aircraft the developer and the manufacturer draw up the form, the passport of compliance of this copy of working design documentation. The state testing of the civil aircraft begin only in the presence of the specified documents.

6. Production tests of sample of the civil aircraft are carried out on readiness of copy of the aircraft, its components and systems for carrying out testing.

7. The developer sends to authorized organization in the field of civil aviation information, reports on metrological support and technical documentation on readiness of sample of the aircraft for conducting production tests.

8. Production tests are carried out for the purpose of:

1) bringing design of sample of the civil aircraft, its characteristics and operational documentation to compliance with airworthiness standards in the expected service conditions;

2) establishments of standard design of especially responsible functional systems of the civil aircraft (glider, the chassis, management system, aerodynamic characteristics, brake, hydraulic, electric and other systems) influencing the flight validity;

3) establishments of possibility of presentation of the civil aircraft for carrying out the state testing.

9. The program of production tests, including laboratory, bench, ground, flight and special researches, are developed and affirm developer within 15 (fifteen) calendar days from the moment of its registration.

10. If it is determined that in case of the revealed discrepancies and shortcomings of sample of the civil aircraft further conducting production tests is connected with risk, the authorized organization in the field of civil aviation makes the decision on suspension of testing. Production tests are resumed after elimination by developer of the revealed discrepancies and submission of supporting documents.

11. The state testing of sample of the civil aircraft are carried out according to the plan approved by developer with participation of authorized organization in the field of civil aviation. The developer notifies authorized organization in the field of civil aviation in 5 (five) calendar days prior to testing on terms of carrying out the state testing. By results of the state testing by authorized organization in the field of civil aviation and developer the joint conclusion prepares in any form.

Operating tests of sample of the civil aircraft are carried out by the developer in different climatic (physical) conditions according to the schedule developed and approved by developer.

12. On completion of production, state and operating tests the developer sends to authorized organization in the field of civil aviation the following documents:

1) the table of correspondences of sample of the civil aircraft to airworthiness standards corrected by results of the production and operating tests approved by developer;

2) the set of operational documentation specified by results of production, state and operating tests;

3) the notification that control and the current sets of working design documentation of sample of the aircraft (numbers of sets are specified) are modified by results of production and operating tests reflect standard design of sample of the civil aircraft, are suitable for serial production of sample of the civil aircraft of this type, are approved and are stored at the developer and the manufacturer.

13. The operator enters any changes into design and operational documentation only on approval of these changes of the holder Sertifikata of type.

14. The requirements to environmental protection established by Appendix 16 to the Convention on international civil aviation extend to civil aircrafts (Chicago, 1944) (further - the Convention).

15. Requirements to environmental protection join in certified regulations of the civil aircraft as independent Sections.

16. Compliance of sample of the civil aircraft to requirements to environmental protection makes sure the Certificate like the aircraft on noise on the area. The authorized organization in the field of civil aviation recognizes the certificates on issue of engines issued by the state of developer and also the certificates on issue issued by the authorized certifying organization of other state provided that requirements according to which certification was made are at least strict, than the provisions containing in volume 2 of Appendix 16 to the Convention.

Chapter 2. Procedure for certification and issue of the certificate of type

Paragraph 1. Carrying out certification

17. The civil aircraft of new design (new type) intended for serial production is subject to certification by authorized organization in the field of civil aviation on compliance to its airworthiness standards operating in the Republic of Kazakhstan and shall have the certificate of type issued by authorized organization in the field of civil aviation after passing of production, state and operating tests by it.

18. For carrying out certified works and issue of the certificate of type it is carried out according to requirements of the document ICAO "Management on the flight validity" (Doc. 9760) the developer submits to authorized organization in the field of civil aviation through the web portal of "the electronic government" www.egov.kz, www.elicensе.kz the request in any form with submission of the following documents:

1) management on flight operation;

2) forms;

3) drawings (sketches) of the main power nodes, including nodes of fixture of wing, plumage, the engine, chassis, with indication of the main sizes and brand of material;

4) schemes of fuel and brake systems, electric equipments, management systems;

5) photos of sample (in front, sideways, behind); from above;

6) technical documentation with the short description of schemes, systems, the main characteristics expected service conditions and restrictions in which range the sample, and also the list of Chapters, Sections and Items of the airworthiness standards extended to this sample, the special specifications concerning its flight validity and requirements to environmental protection will be certified;

7) the copy of the document confirming payment of collection for certification like the civil aircraft.

Data on identity documents, on state registration (re-registration) of the legal entity, on state registration as the individual entrepreneur, the service provider receives from the corresponding state information systems through lock of "the electronic government". The authorized organization in the field of civil aviation carries out certification of sample of the aircraft.

Paragraph 2. Recognition of the certificate of type, issued by foreign state

19. The certificate of type issued by foreign state, the international organization in the field of the civil aviation performing certification of aircrafts is recognized authorized organization in the field of civil aviation provided that requirements according to which the certificate of type is issued conforms to standards of International Civil Aviation Organization (further - ICAO) and to the airworthiness standards established in the Republic of Kazakhstan.

Paragraph 3. Certified inspection

20. Certified inspection is performed with use of the instructive material developed by authorized organization in the field of civil aviation for aviation inspectors.

21. When carrying out certified inspection are checked:

1) standard design of AF;

2) equipment, adjusting nodes, etc.;

3) flight technical characteristic;

4) documentation flight testing;

5) operational restrictions;

6) drawings and specifications of configuration of product and equipment.

22. Inspection is made for the purpose of determination of compliance of design to requirements of the Airworthiness standard of the civil aircrafts of the Republic of Kazakhstan approved by the order of the acting minister on investments and development of the Republic of Kazakhstan of March 27, 2015 No. 367 (it is registered in the Register of state registration of regulatory legal acts No. 12038, it is published on October 8, 2015 in information system of law of Ad_let).

23. By results of the carried-out works the authorized organization in the field of civil aviation draws up the statement (further - the Act) about compliance (discrepancy) of sample of the aircraft to airworthiness standards in form, according to appendix 1 to these rules in duplicate with indication of actual state of sample of the aircraft, conclusions, recommendations and the conclusion about possibility (impossibility) of issue of the Certificate of type, one copy of the act is transferred to developer.

24. In case of detection of discrepancies when carrying out certified inspection of sample of the aircraft to airworthiness standards, the developer within 15 (fifteen) calendar days from the date of signing of the act represents in form, according to appendix 4 to these rules of corrective actions on their elimination for approval by authorized organization in the field of civil aviation.

After elimination of discrepancies, the developer represents to authorized organization in the field of civil aviation about accomplishment of corrective actions in the terms established by the plan with appendix of confirmatory documentation.

25. The authorized organization in the field of civil aviation makes the decision on issue of the Certificate of type provided that the aircraft meets airworthiness standards.

Paragraph 4. Issue (refusal in issue) the certificate of type

26. The authorized organization in the field of civil aviation based on positive results of the production, state and operating tests establishing compliance of standard design of sample of the aircraft to airworthiness standards within 22 (twenty two) working days from the moment of receipt of the act issues the Certificate of type.

27. The certificate of type is issued in form, according to appendix 2 to these rules. The map of data on form, according to appendix 3 to these rules which contains information on standard design of sample, the operational restrictions and other conditions concerning the flight validity of sample is attached to the Certificate of type. The certificate of type is issued for unrestricted term.

28. In case of removal from operation of sample of the aircraft the decision of authorized organization in the field of civil aviation the Certificate of type on this sample is cancelled.

29. In case of change of the approved type design (standard design) of the civil aircraft or its operational technical documentation influencing the flight validity, this type of the aircraft is subject to additional certification by authorized organization in the field of civil aviation for receipt of amendment to the certificate of type.

30. For issue of the additional certificate of type (ACT) on the main changes in standard design of the aircraft for developers of the modifications of AF which are not his initial developer, necessary condition of issue (or recognitions) DST is availability of the agreement between developer of the aircraft and developer on DST about separation of responsibility for author's maintenance.

31. The refusal in issue of the Certificate of type is made in cases if:

1) the document package provided by developer does not correspond Item 20 of these rules;

2) there does not correspond the result of the production, state and operating tests establishing compliance of standard design of sample of the aircraft to airworthiness standards.

32. The authorized organization in the field of civil aviation within 2 (two) working days from the moment of receipt of documents of developer for issue of the Certificate of type checks completeness of the submitted documents.

In case of representation of incomplete document package by developer in authorized organization in the field of civil aviation in the specified terms gives the motivated answer about refusal in further review of the statement.

Paragraph 5. Suspension of action of the certificate of type

33. The authorized organization in the field of civil aviation suspends the Certificate of type in case of identification of the shortcomings menacing to safety of flights before elimination of such shortcomings.

34. In case of suspension of action of the Certificate of type the authorized organization in the field of civil aviation without delay informs on the made decision of developer and the operators operating this type of the aircraft, and also service of aeronautical information.

35. Renewal of action of the Certificate of type is performed by authorized organization in the field of civil aviation only after elimination by developer of the revealed shortcomings and carrying out the production, state and operating tests confirming aircraft sample compliance to requirements of airworthiness standards.
