The government of the Russian Federation decides:

1. Approve the enclosed Rules of provision of subsidies from the federal budget to legal entities (except for the public (municipal) institutions) and to the individual entrepreneurs performing actions for assistance to development of additional education of children and for the organization of rest of children and their improvement.

2. Recognize to invalid:

the order of the Government of the Russian Federation of December 30, 2015 No. 1501 "About approval of Rules of provision of subsidies from the federal budget to the organizations performing actions for assistance to development of additional education of children" (The Russian Federation Code, 2016, No. 2, the Art. 375);

Item of 345 changes which are made to acts of the Government of the Russian Federation in connection with abolition of Federal Service for Financial and Budgetary Supervision, approved by the order of the Government of the Russian Federation of May 25, 2016 No. 464 "About introduction of amendments to some acts of the Government of the Russian Federation in connection with abolition of Federal Service for Financial and Budgetary Supervision" (The Russian Federation Code, 2016, No. 24, the Art. 3525);

Rules of provision of subsidies from the federal budget to legal entities (except for the public (municipal) institutions) and to the individual entrepreneurs performing actions for assistance to development of additional education of children and for the organization of rest of children and their improvement

1. These rules establish the purposes, conditions and procedure for provision of subsidies from the federal budget to legal entities (except for the public (municipal) institutions) (further - legal entities) and to the individual entrepreneurs performing actions for assistance to development of additional education of children and for the organization of rest of children and their improvement (further - subsidies).

2. Subsidies are provided within the direction (subprogramme) "Development of additional education of children and implementation of actions of youth policy" of the state program of the Russian Federation "Development of education".

3. Actions for assistance to development of additional education of children and for the organization of rest of children and their improvements are actions:

a) on development of infrastructure of the organizations of additional education of children and (or) the organizations of rest of children and their improvements, including on implementation of the running and (or) capital repairs of buildings, structures, rooms and constructions of the specified organizations;

b) on upgrade of material equipment, including acquisition of the equipment, the education guidances, tutorials, games and consumable materials necessary for program implementation of additional education of children and (or) programs of the organization of rest of children and their improvement;

c) on implementation of actions on staffing, involvement of qualified specialists for work with children with limited opportunities of health in the field of additional education of children, and also the organization of rest of children and their improvement.

4. Subsidies are provided for the purpose of compensation of part of the costs incured by legal entities or individual entrepreneurs on interest payment on the credits or on the tranches within credit lines received in currency of the Russian Federation in the year preceding year of provision of subsidies based on the credit agreements signed with the Russian credit institutions.

5. Subsidies are provided within the budgetary appropriations provided by the Federal Law on the federal budget for the corresponding financial year and planning period and limits of the budget obligations brought in accordance with the established procedure to the Ministry of Public Education of the Russian Federation as the receiver of funds of the federal budget for the purposes specified in item 4 of these rules.

6. The subsidy is provided to the legal entity (individual entrepreneur) in case of observance of the following conditions:

a) loan granting to the legal entity (individual entrepreneur) for the purpose of financial provision of the actions specified in Item 3 of these rules;

b) accomplishment by the legal entity (individual entrepreneur) of obligations on repayment of principal debt and payment of the added percent on the credit;

c) absence at the legal entity (individual entrepreneur) of costs for interest payment on the credits which were compensated from means of the federal budget earlier;

d) absence at the legal entity (individual entrepreneur) of unexecuted obligation on tax payment, charges, the insurance premiums, penalty fee, penalties and percent which are subject to payment in accordance with the legislation of the Russian Federation about taxes and fees;

e) recognition of the legal entity (individual entrepreneur) by the winner of tender.

7. The subsidy for compensation of the percent added and paid on overdue loan debt is not provided.

8. The subsidy is provided to the legal entity (individual entrepreneur) in the amount of the amount of actual costs of the legal entity (individual entrepreneur) on interest payment on the credit for settlement period, at the same time the size of subsidy cannot exceed the size calculated proceeding from:

loan amount which target use is confirmed according to the subitem "an" of Item 11 of these rules;

key interest rate of the Central bank of the Russian Federation operating on payment date of percent on the credit.

The size of the means which are subject to compensation cannot exceed actual costs of the receiver of subsidy for interest payment on the credits in settlement period which constitutes 1 year about day of application for participation in tender (further - the request).

If the total size of the provided means calculated according to appendix exceeds amount of the budgetary appropriations provided to the Ministry of Public Education of the Russian Federation the current financial year the size of subjects to compensation to the legal entity (individual entrepreneur) of means decreases by the purposes specified in item 4 of these rules in proportion to total exceeding of the size.

9. The right to subsidy is granted following the results of carrying out tender for determination of the receiver of subsidy (further - tender) according to the procedure, established by the Ministry of Public Education of the Russian Federation.

10. Competition is held by the Ministry of Public Education of the Russian Federation at least once a year.

11. For the purpose of carrying out the tender Ministry of Public Education of the Russian Federation:

a) at least in 30 calendar days prior to the expiration of submission of requests posts on the official site the Ministries of Public Education of the Russian Federation on the Internet (further - the official site) the announcement of carrying out tender and the tender documentation including:

requirements to content, form and structure of the request;

procedure, place, start date and end date of submission due date of requests;

procedure and terms of modification of the tender documentation;

procedure, place, date and time of consideration of requests;

procedure and terms of assessment of requests;

form of the certificate of educational activities in the year preceding year of provision of subsidy and about planned measure values of educational activities in the current financial year (for the legal entities and individual entrepreneurs performing actions for assistance to development of additional education of children);

form of the certificate of target use of the credit;

b) forms tender committee, and also approves regulations on tender committee and its structure;

c) registers requests with the enclosed documents according to the procedure of their receipt.

12. The Ministry of Public Education of the Russian Federation has the right to make the decision on modification of the announcement of carrying out tender only during the first half of the term established for submission of requests. Within 2 working days from the date of adoption of the specified solution of change are posted on the official site. Submission due date of requests is in that case prolonged for 10 at least working days.

13. The legal entity (individual entrepreneur) for participation in tender submits to the Ministry of Public Education of the Russian Federation the request which is drawn up according to the requirements established by the tender documentation with appendix of the following documents:

a) the extract from the Unified State Register of Legal Entities (extract from the Unified State Register of Legal Entities and Individual Entrepreneurs) certified in accordance with the established procedure and issued not later than 1 month about day of submission of documents;

b) the copy of the credit agreement and the statement according to the loan account confirming receipt of the credit, and also the documents confirming timely payment of the added interests on credit on actually incurred costs according to which request are subject to compensation, and its timely repayment which are certified by the relevant Russian credit institution;

c) the statement according to the loan account confirming the size of loan debt on the credit;

d) the certificate of target use of the credit in the form established by the tender documentation certified by the head of the legal entity (individual entrepreneur) with application of copies of payment documents;

e) calculation of the means which are subject to compensation according to appendix to these rules;

e) the reference of tax authority in which the legal entity (individual entrepreneur) stays on the registry, confirming lack of unexecuted obligation on tax payment, charges, the insurance premiums, penalty fee, penalties and percent which are subject to payment in accordance with the legislation of the Russian Federation about taxes and fees, certified in accordance with the established procedure and issued not later than 1 month about day of submission of documents;

g) the copy of the license for implementation of educational activities and the copy of the appendix to the license confirming sales right of additional general education programs (for the legal entities and individual entrepreneurs performing actions for assistance to development of additional education of children);

h) the statement from the register of the organizations of rest of children and their improvement certified in accordance with the established procedure by executive body of the subject of the Russian Federation in the field of the organization of rest and improvement of children (for the legal entities and individual entrepreneurs performing actions for the organization of rest of children and their improvement);

i) the reference signed by the head and the chief accountant (in the presence) of the legal entity (individual entrepreneur) confirmatory that the legal entity (individual entrepreneur) does not receive from the federal budget of funds for compensation of part of costs for interest payment according to the credit agreement for the purpose of which the subsidy is provided;

j) the cover letter signed by the head of the legal entity (individual entrepreneur).

14. The request is submitted to the Ministry of Public Education of the Russian Federation on paper and in electronic form.

15. The tender committee carries out examination of requests in 2 steps.

16. The first stage of examination of requests is carried out within 10 working days from the date of the end of order taking. At this stage the tender committee performs consideration of the requests submitted to the Ministry of Public Education of the Russian Federation for compliance to the requirements established by the tender documentation.

17. The participant of tender bears responsibility for unauthenticity of the data containing in the documents submitted according to Item 13 of these rules.

18. The tender committee rejects the request on the following bases:

a) representation not in full the documents specified in the tender documentation;

b) representation by the participant of tender of unreliable information;

c) submission of the request which is not conforming to the requirements established by the tender documentation;

d) receipt of the request after the established end date of submission due date of requests.

19. The minutes of tender committee containing information on all participants of tender and also about rejected requests with reasons for reasons for rejection, are drawn up not later than in 3 working days from the date of acceptance by tender committee of the decision by results of the first stage of examination of requests.

If the tender committee by results of consideration of requests recognized only one request to conforming requirements established by the tender documentation, the request is allowed to the second stage of examination of requests.

20. At the second stage of examination of requests the tender committee performs assessment of requests by the criteria specified in Item 21 of these rules and also checks completeness and reliability of the data containing in requests.

The second stage of examination of requests is carried out within 20 working days from the date of the termination of the first stage.

21. The requests submitted on tender conforming to the requirements established by the tender documentation are estimated by tender committee by the following criteria (further - criteria of tender):

a) the number of children aged from 5 up to 18 years studying according to additional general education programs, the number of children aged from 6 years and 6 months up to 17 years inclusive directed to rest and improvement in the organization of rest of children and their improvement in the year preceding year of provision of subsidy including:

children, students on a grant basis (for the legal entities and individual entrepreneurs performing actions for assistance to development of additional education of children);

the children who are on vacation and improvement on a grant basis (for the legal entities and individual entrepreneurs performing actions for the organization of rest of children and their improvement);

the children who are in difficult life situation;

b) the number of the additional general education programs realized by the organization of additional education (for the legal entities and individual entrepreneurs performing actions for assistance to development of additional education of children);

c) orientation of the additional general education programs realized by the organization of additional education (for the legal entities and individual entrepreneurs performing actions for assistance to development of additional education of children);

d) requirement of the organization of additional education or the organization of rest of children and their improvement in the running and (or) capital repairs, and also in upgrade of material equipping, creation of conditions for handicapped children and children with limited opportunities of health.

22. The solution of tender committee by results of the second stage of examination of requests is drawn up by the protocol within 3 working days from the date of holding meeting of tender committee.

23. The participant of tender which request gathered in the amount the greatest number of points according to criteria of tender appears tender committee the winner of tender (further - the winner of tender).

If requests 2 and more participants of tender gathered the identical greatest number of points, all these participants of tender are recognized winners of tender and the tender committee makes the decision on satisfaction of their requests.

If the request only of one participant of tender is recognized as tender committee by results of the second stage of examination of requests corresponding to criteria of tender, the participant is recognized the winner.

Results of tender are posted on the official site within 2 working days from the date of signing of the protocol by all members of tender committee.

24. Distribution of subsidies between winners of tender affirms the Ministry of Public Education of the Russian Federation. The subsidy is provided based on the agreement signed by the specified Ministry with the winner of tender in the corresponding standard form approved by the Ministry of Finance of the Russian Federation (further - the agreement) in which including are provided:

a) the consent of the winner of tender to carrying out by the Ministry of Public Education the Russian Federation and authorized body of the state financial control of checks of observance by the winner of tender of the purposes, conditions and procedure for provision of subsidy which are established by these rules and the agreement;

b) prohibition on acquisition at the expense of means of subsidy of foreign currency, except for the transactions performed according to the foreign exchange legislation of the Russian Federation when purchasing (delivery) of the high-technology import equipment, raw materials and components.

25. For agreement signature the winner of tender submits the following documents to the Ministry of Public Education of the Russian Federation:

a) the copies of constituent documents of the winner of tender certified in accordance with the established procedure;

b) the reference of tax authority confirming absence at the winner of the tender on the 1st preceding month in which agreement signature, unexecuted obligation on tax payment, charges, the insurance premiums, penalty fee, penalties and percent which are subject to payment in accordance with the legislation of the Russian Federation about taxes and fees is planned;

c) the reference, confirmatory that as of the 1st, preceding month in which agreement signature is planned, the winner of tender has no overdue debt on return to the federal budget of the subsidies, budget investments provided including according to other legal acts, and other arrears to the federal budget, including according to the monetary commitments in front of the Russian Federation determined in Article 93.4 of the Budget code of the Russian Federation;

d) the reference, confirmatory that as of the 1st, preceding month in which agreement signature is planned, the winner of tender - the legal entity is not in process of reorganization, liquidation or bankruptcy, and the winner of tender - the individual entrepreneur did not stop activities as the individual entrepreneur;

e) the reference, confirmatory that as of the 1st, preceding month in which agreement signature is planned, the winner of tender is not foreign legal entity, and also the Russian legal entity in whose authorized (share) capital share of participation of foreign legal entities whose place of registration is the state (territory) included in the list of the states and the territories which are providing preferential tax regime of the taxation and (or) not providing disclosure and provision of information approved by the Ministry of Finance of the Russian Federation when carrying out financial transactions (offshore zones) in total exceeds 50 percent;

e) the reference, confirmatory that as of the 1st, preceding month in which agreement signature is planned, the costs incurred by the winner of tender on interest payment on the credits were not compensated from the federal budget based on other regulatory legal acts.

26. The Ministry of Public Education of the Russian Federation within 10 working days from the date of receipt of the documents specified in Item 25 of these rules checks completeness and reliability of the data containing in them and makes the decision on provision of subsidy or on refusal in provision of subsidy.

27. The bases for refusal in provision of subsidy are:

a) discrepancy of the documents submitted by the winner of tender, to the documents specified in Item 25 of these rules or non-presentation (representation not in full) the specified documents;

b) unauthenticity of the data containing in the documents submitted by the winner of tender.

28. Transfer of subsidy is performed no later than the 10th working day from the date of agreement signature into the account opened for the receiver of subsidy in organization of the Central bank of the Russian Federation or the Russian credit institution.

29. In case of factual determination of violation of the purposes, conditions and procedure for provision of subsidy established by these rules and the agreement, appropriate means are subject to return to the income of the federal budget:

a) based on the requirement of the Ministry of Public Education of the Russian Federation - no later than the 10th working day from the date of receipt of the specified requirement by the receiver of subsidy;

b) based on representation and (or) the instruction of authorized body of the state financial control - in the terms established according to the budget legislation of the Russian Federation.

30. Information on the sizes and terms of transfer of subsidies is considered by the Ministry of Public Education of the Russian Federation when forming the forecast of cash payments from the federal budget necessary for creation in accordance with the established procedure of the cash plan of execution of the federal budget.

31. Control of observance of the purposes, conditions and procedure for provision of subsidies is performed by the Ministry of Public Education of the Russian Federation and authorized body of the state financial control.
