About approval of technique of efficiency evaluation of activities of special economic and industrial zones

According to the subitem 19) of article 11 of the Law of the Republic of Kazakhstan of April 3, 2019 "About special economic and industrial zones", I ORDER:

1. Approve the enclosed technique of efficiency evaluation of activities of special economic and industrial zones.

2. Declare invalid the order of the Minister of investments and development of the Republic of Kazakhstan of January 29, 2016 No. 136 "About approval of technique of efficiency evaluation of activities of special economic zones" (it is registered in the Register of regulatory legal acts of the Republic of Kazakhstan at No. 13380, it is published on April 26, 2016 in information system of law of Ad_let).

3. To provide to committee of industrial development and industrial safety of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

4. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Technique of efficiency evaluation of activities of special economic and industrial zones

Chapter 1. General provisions

1. This Technique of efficiency evaluation of activities of special economic and industrial zones (further - the Technique) is developed according to the subitem 19) of article 11 of the Law of the Republic of Kazakhstan of April 3, 2019 "About special economic and industrial zones" (further - the Law) and is intended for efficiency evaluation of activities of special economic and industrial zones.

2. The efficiency evaluation of activities of special economic and industrial zones (further - assessment) is made by the authorized body performing state regulation in the field of creation, functioning and abolition of special economic and industrial zones.

3. Assessment is performed annually following the results of accounting (calendar) year according to the subitem 4) of article 39 of the Law.

On newly created special economic and industrial zones, assessment is performed for the actual period of functioning of special economic and industrial zones from the moment of their creation and till December 31 of accounting (calendar) year.

4. The managing company of special economic zones annually, and managing company of industrial zones quarterly, no later than the 10th following after accounting year (quarter) directs the reporting on results of activities of special economic and industrial zones (further - reporting information) in any form, with obligatory specifying of the data approved by the order of the Minister of the industry and infrastructure development of the Republic of Kazakhstan of July 11, 2019 No. 500 "About approval of Rules of representation of special economic and industrial zones of the reporting by managing company" (it is registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan for No. 19021).

5. Information source for assessment is the reporting information of managing company of special economic and (or) industrial zones represented on electronic and paper carriers.

Assessment of achievement of the forecast and planned targets provided by the strategy of development for the special economic zone approved by managing company of special economic zone in coordination with the authorized body performing state regulation in the field of creation, functioning and abolition of special economic and industrial zones and strategies of development for industrial zones of republican and regional value, the approved managing company of industrial zone in coordination with local executive body of area, city of republican value, the capital, target indicators of functioning of special economic and industrial zones, critical level of not achievement of target indicators is result of the specified assessment.

Chapter 2. Evaluating efficiency of activities of special economic and industrial zones

6. The efficiency evaluation of activities of special economic and industrial zones is performed separately on each special economic and industrial zone by the following criteria:

1) efficiency of functioning of special economic and industrial activity;

2) efficiency of activities of participants of special economic and industrial zones;

3) influence of activities of special economic and industrial zones on social and economic development of the region (area, the city of republican value, the capital) in the territory of which they are created;

4) management efficiency of managing company of special economic and (or) industrial zones.

7. By each criterion certain Item 6 of this Technique gives points according to Items 12 and 13 of this Technique.

Final value of each criterion (subcriterion) is determined as the weighted average measure value in percentage expression.

8. In case of criterion assessment "efficiency of functioning of special economic and industrial zones" the following indicators are considered:

1) the number of participants of special economic and industrial zones, including the number of participants with participation of foreign investors in shareholding structure (participants) and participants realizing agreements on implementation of activities as the participant of special economic and industrial zones with attraction of foreign investments (forecast/fact);

2) quantity of the workplaces created by participants of special economic and industrial zones in the territory of special economic and industrial zones (forecast/fact) (temporary working places/constants workplaces);

3) the volume of investment, including the capital investments performed by participants of special economic and industrial zones in the territory of special economic and industrial zones according to agreements on implementation of activities as the participant of special economic and industrial zones (plan/fact);

4) total revenue from sales of goods, works, services less the value added tax, excises (according to the profit and loss statement of accounting records of the participants applying general system of the taxation) and (or) the amount of the income (according to the tax declaration on the tax paid in connection with application of simplified taxation system, the participants applying simplified taxation system) received by participants as a result of implementation of agreements on implementation of activities as the participant of special economic and industrial zone (forecast/fact);

5) amount of private investments into the authorized capital of managing company of special economic and industrial zones for the purpose of financing of creation of objects of engineering, transport, social, innovative and other infrastructure of special economic and industrial zones;

6) amount of the taxes paid by participants of special economic and industrial zones to budgets of all levels of budget system of the Republic of Kazakhstan (forecast/fact);

7) amount of the customs payments paid by participants of special economic and industrial zones;

8) quantity of the objects of engineering infrastructure constructed in the territory of special economic and industrial zones and put into operation (plan/fact) and their design capacity;

9) amount of the enclosed budget investments (means of republican, local budgets) in construction of infrastructure it (is allocated/is mastered).

The share of execution of each indicator specified in subitems 1) - 9) this Item, is calculated by formula:

Р the fact it (is mastered) - the actual value of execution of indicator;

Р the plan (the forecast, it is allocated) - general meaning of indicator.

9. Criterion assessment "efficiency of activities of participants of special economic and industrial zone" is made proceeding from the indicators provided in subitems 2), 3) and 6) of Item 8 of this Technique.

Final value of each criterion (subcriterion) is determined as the weighted average measure value in percentage expression:

Bi - the corresponding point on the actual achievement of forecast planned targets according to Item 15.

10. The criterion "efficiency of activities of participants of special economic and industrial zones" includes subcriterion efficiency of types of activity of special economic and industrial zones.

The subcriterion efficiency of types of activity of special economic and industrial zones is calculated proceeding from type of activity of special economic and industrial zones which is subdivided by sight activities in the field of processing industry and in the transport and logistic sphere.

11. The subcriterion efficiency of types of activity of special economic and industrial zones for types of activity in the field of processing industry consists of indicators:

1) the share of the exported products in the total amount of the made products is calculated by formula:

Р ex-. pro-@ - the actual value of the exported products in terms of money;

Р general amount - the total amount of the made products in the territory of the Republic of Kazakhstan in terms of money;

2) the share of the processing industry relating to high-technology sectors of economy in total quantity of the productions placed in the territory of special economic and industrial zones is calculated by formula:

Р втс - the actual number of the productions in processing industry relating to high-technology sectors;

р general amount - total quantity of the productions placed in the territory of special economic and industrial zones in the field of processing industry;

3) the specific weight of the companies performing technological innovations in total quantity of the companies (the participants realizing agreements on implementation of activities as the participant of special economic and industrial zones) is calculated by formula:

12. The subcriterion efficiency of types of activity of special economic and industrial zones for types of activity in the transport and logistic sphere is calculated proceeding from the following indicators:

1) export share in the total amount of cargo turnover which is calculated by formula:

2) import share in the total amount of cargo turnover which is calculated by formula:

13. The criterion influence of activities of special economic and industrial zones on social and economic development of the region (area, the city, republican value, the capital) in the territory of which they are created is determined as:

1) the relation of the indicator specified the subitem 2) of Item 8 of this Technique to the number of able-bodied population of administrative and territorial unit (area, the cities of republican value, the capital) in the territory of which special economic and industrial zones are created (for calculation measure values as of December 31 of the corresponding year of assessment are used).

The final measure value can be expressed as a percentage which is calculated by formula:

- the relation of the indicator specified in the subitem 2) of Item 8 of this Technique to the number of able-bodied population of administrative and territorial unit (area, the cities of republican value, the capital) in the territory of which special economic and industrial zones are created;

Р 1 - the indicator specified in the subitem 2) of Item 8 of this Technique;

Р 2 - indicator of number of able-bodied population of territorial administrative unit (area, the cities of republican value, the capital) in the territory of which special economic and industrial zones are created;

2) the relation of the indicator specified in the subitem 4) of Item 8 of this Technique to amount of gross regional product of administrative and territorial unit in the territory of which special economic and industrial zones are created (for calculation annual measure values are used, the final measure value is expressed as a percentage), which is calculated by formula:

- the relation of the indicator specified in the subitem 4) of Item 8 of this Technique to amount of gross regional product of administrative and territorial unit (area, the cities of republican value, the capital) in the territory of which special economic and industrial zones are created;

3) the relation of the indicator specified in the subitem 6) of Item 8 of this Technique to amount of the taxes paid to budgets of all levels of budget system of the Republic of Kazakhstan by the taxpayers registered on territorial administrative unit in the territory of which the special economic and industrial zone is created (the final measure value can be expressed as a percentage), which is calculated by formula:

- the relation of the indicator specified in the subitem 6) of Item 8 of this Technique to amount of the taxes paid to budgets of all levels of budget system of the Republic of Kazakhstan by the taxpayers registered on territorial administrative unit in the territory of which special economic and industrial zones are created;

Р 5 - the indicator specified in the subitem 6) of Item 8 of this Technique;

Р is 6 indicator of amount of the taxes paid to budgets of all levels of budget system of the Republic of Kazakhstan by the taxpayers registered on territorial administrative unit in the territory of which special economic and industrial zones are created.

14. The criterion "management efficiency of managing company of special economic and (or) industrial zones" is determined as:

the relation of the indicators provided in subitems 1) and 8) of Item 8 of this Technique to forecast and planned targets of special economic and industrial zones;

total share of the area of the parcels of land provided in lease and (or) which are in property of participants of special economic and industrial zones, in total area of special economic and industrial zones which is calculated by formula:

Р indicator (%) - share of execution of indicator;

Р the fact (lease, property) - the actual value of the participants of special economic and industrial zones of the parcels of land issued in lease and (or) being in property;

Р the plan (the forecast, it is allocated) - total area of the parcels of land located in the territory of special economic and industrial zones;

share of the capacities of objects of engineering infrastructure, including objects of heat supply, water supply, power supply, gas supply, water disposal put into operation, created or created, in number of the specified objects declared and confirmed with contractual commitments of participants of special economic and industrial zones which is calculated by formula:

Р indicator (%) - share of execution of indicator;

Р the fact (commissioning) - the actual quantity of the objects of engineering infrastructure put into operation;

Р the plan (declared) - total quantity of the infrastructure facilities declared to putting into operation.

15. The efficiency evaluation of activities of special economic and industrial zones is made taking into account accomplishment of forecast and planned targets of special economic and industrial zones by each criterion, according to appendix to this technique.

16. Following the results of the carried-out assessment the authorized body performing state regulation in the field of creation, functioning and abolition of special economic and industrial zones annually till July 1 of the year following after accounting year of evaluating analytical information on results of activities of special economic and industrial zones on the Internet resource of authorized body is placed.

Appendix

to the Technique of efficiency evaluation of activities of special economic and industrial zones

Criteria for evaluation of efficiency of activities of special economic and industrial zones

For assessment of indicators of activities of special economic and/or industrial zones the five-point system of values is used:

5 points - in case of achievement of planned targets over 90 percent;

4 points - in case of achievement of planned targets for 71-90 percent;

3 points - in case of achievement of planned targets for 51-70 percent;

2 points - in case of achievement of planned targets for 36-50 percent;

1 point - in case of achievement of planned targets below than for 35 percent;

0 points - in the absence of achievement of planned targets.

Total final value of indicator of activities of special economic and/or industrial zones for the actual achievement of forecast planned targets (criteria) of special economic and/or industrial zone is determined as the weighted average value.

Based on the received weighted average value the efficiency evaluation of activities of special economic and/or industrial zones for the accounting period and from the beginning of functioning of special economic and/or industrial zone using the following points is made: from 5 to 4 points - the value reflecting effective activities of special economic and/or industrial zones;

from 4 to 3 points - the value reflecting rather effective activities of special economic and/or industrial zones;

from 3 to 2 points - the value reflecting conditional and effective activities of special economic and/or industrial zones with need of enhancement in the separate directions;

from 2 to 1 points - the value reflecting the low level of efficiency of activities of special economic and/or industrial zones;

it is lower than 1 point - the value reflecting inefficient activities of special economic and/or industrial zones.
