1. Approve the enclosed Rules of implementation of land servicing at the airports.

2. To provide to committee of civil aviation of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of implementation of land servicing at the airports

Chapter 1. General provisions

1. These rules of implementation of land servicing at the airports (further – Rules) are developed according to Item 2 of article 65 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further – the Law) and determine procedure of services of land servicing at the airports.

2. The main determinations and terms used in these rules:

1) airline – the legal entity having the air operator certificate of civil aircrafts;

2) services in collection and data transmission about air passengers – services in provision in authorized body and (or) law enforcement and special state bodies of data on the drawn-up and (or) booked tickets for the air transport following the international flights;

3) authorized body in the field of civil aviation – the central executive body performing management in the field of use of airspace of the Republic of Kazakhstan and activities of civil and experimental aviation (further – authorized body);

4) authorized organization in the field of civil aviation – the joint-stock company with absolute participation of the state in the authorized capital performing the activities aimed at providing sustainable development of industry of civil aviation of the Republic of Kazakhstan, safety of flights and aviation safety;

5) airport activities – the activities performed by physical and (or) legal entities at the airports, connected with ensuring airborne transportations, aviation works, safety of flights and aviation safety;

6) management on servicing at the airport (Airport Handling Manual) – the recommendation of international association of air transport (International Air Transport Association) (further – IATA), according to the standards and the equipment used in case of accomplishment of technological transactions in the course of land servicing of the aircraft;

7) the operator of the airport (airfield) – the legal entity of the Republic of Kazakhstan, and also foreign state according to the international treaties ratified by the Republic of Kazakhstan which uses the airport on the property right or other legal causes;

8) the user's guide of the airport (airfield) – the document accepted by the operator of the airport (airfield) for the purpose of increase in safety of flights, improvement of quality land and maintenance, and also ensuring smooth functioning of the airport;

9) land servicing – the servicing necessary in case of arrival of the aircraft in the airport (airfield) or departure of the aircraft from the airport (airfield) which is not including servicing of air traffic;

10) the service provider of land servicing – the physical person or legal entity rendering services of land servicing in the territory of the airport (airfield), except for the operator of the airport (airfield) and the airline which is independently servicing the aircrafts, passengers, baggage, load and mail;

11) independent land servicing (self-service) – implementation of one or several types of service of land servicing by airline for own needs and/or aircrafts, passengers, baggage, load and mail of airlines, fifty and more percent of voting shares of which belong to it, without the conclusion of the contract with the third parties;

12) the passenger - the physical person which is not part of crew and transported on the aircraft according to the agreement of airborne transportation or on other legal causes;

13) infrastructure facility – the property of the airport intended for rendering airport activities, including for provision of services of land servicing in the territory of the airport (airfield);

14) tender – method of determination of suppliers for rendering services of land servicing in the territory of the airport (airfield);
