About modification and amendments in some orders of the Minister of Internal Affairs of the Republic of Kazakhstan

I ORDER:

1. Approve the list of some orders of the Minister of Internal Affairs of the Republic of Kazakhstan to which changes and additions, according to appendix to this order are made.

2. To committee of administrative police of the Ministry of Internal Affairs of the Republic of Kazakhstan (Baybolov M. K.) in the procedure established by the legislation of the Republic of Kazakhstan to provide:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Internal Affairs of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) and 4) of this Item.

3. To impose control of execution of this order on the supervising deputy minister of internal affairs of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

The list of some orders of the Minister of Internal Affairs to which changes and additions are made

1. Of June 26, 2014 No. 383 "About approval of Rules of the organization and evaluating degree of risks of the operated roads in the territory of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts No. 9635, it is published on September 5, 2014 in "The legal newspaper") to make the following change to the order of the Minister of Internal Affairs of the Republic of Kazakhstan:

"3-1. To chiefs of Departments of police of the cities of Nour-Sultan, Almaty, Shymkent and areas, representative offices of the Ministry of Internal Affairs of RK in the city of Baikonur:

1) to provide studying and observance of requirements of this order by staff of law-enforcement bodies;

2) to organize work of law-enforcement bodies according to requirements of this order.".

In the order of the Minister of Internal Affairs of the Republic of Kazakhstan of December 2, 2014 No. 862 "About approval of Rules of state registration and accounting of separate types of vehicles on vehicle identification number, training of drivers of motorized vehicles, acceptance of examinations and issue of car driver licenses" (it is registered in the Register of state registration of regulatory legal acts No. 10056, it is published on January 21, 2015 in the Kazakhstanskaya Pravda newspaper) to make the following changes:

"15-1. Registration actions - the activities connected with implementation of state registration, removal from accounting of vehicles, modification of registration of vehicles and unified information system, registration (removal) of pledges, imposing and removal of encumbrances.";

"4. Vehicles are registered behind physical persons in the place of their permanent registration of the residence.

In case of detection of signs of counterfeit of the submitted documents, GRNZ, and also availability of data on finding of the vehicle (number aggregates), the owner or the submitted documents in search by the authorized employee of Department of Internal Affairs, the employee of the State corporation is without delay transferred the relevant information to control room of Department of Internal Affairs.

The killed, cut number aggregates, vehicles which are not struck off the register on search are not subject to registration.

For determination of compliance of number aggregates survey of the vehicle by the authorized employee of Department of Internal Affairs can be performed.

For vehicle identification, determination of compliance of marking of the number aggregates put with the manufacturer of the vehicle authorized by the employee of Department of Internal Affairs survey of the vehicle can be performed.";

"24. On the vehicles delivered under the own steam from manufacturers, the auto repair plants, bodies of state revenues, and also struck off the register in connection with change of the place of permanent registration or change of the property right are issued for one-time use of GRNZ "Transit" respectively.

In case of issue of GRNZ "Transit" in the documents confirming the property right to vehicles marks with indication of series, numbers, date of issue and effective period of the specified signs become and are certified by seals of the organizations (except for subjects of private entrepreneurship) which made these records.

Effective period of GRNZ "Transit" - ten calendar days from the date of issue.

25. The vehicle owner has the right to choose GRNZ from available in premises of the State corporation, and also to order production of the free GRNZ of the increased demand which are absent available with certain digital and (or) alphabetic designations.

Access for owners of vehicles, to the list of available GRNZ will be organized by placement of the relevant information in premises of the State corporation. All list, available GRNZ, is according to the procedure entered into information systems of the State corporation. GRNZ of not increased demand are entered into information systems of the State corporation in alphabetical order, except for GRNZ issued on the vehicles which are under authority of state bodies, diplomatic representations, international organizations and (or) its representations, the consular establishments registered in the Republic of Kazakhstan, employees and members of their families accredited in the Republic of Kazakhstan.

On declaration of will of the vehicle owner in case of its address the choice and booking of GRNZ of the increased demand is performed.

The vehicle registration which owner chose certain digital and (or) alphabetic designations GRNZ of the increased demand is made after production of GRNZ.";

"27. In case of removal from the state accounting of the vehicle behind which GRNZ was registered earlier this registration plate is subject to delivery.

The handed-over GRNZ is liable to destruction, except as specified storages according to the statement of the vehicle owner.

Storage of the handed-over GRNZ of the national standard conforming to requirements for the statement of the owner up to 6 months is allowed.

28. Handed over earlier and conforming to requirements of the national GRNZ standard at the request of the vehicle owner, it is repeatedly issued on the vehicle which is again acquired by it.

Before the expiration of 30 calendar days of storage in the GRNZ State corporation it is issued without payment of the state fee for its issue.";

"32. On the transport which is under encumbrance, duplicates of documents and GRNZ are issued based on the allowing documents issued by bodies which impose the corresponding restrictions. Temporary removal of encumbrance in EIS at the time of issue of duplicates of documents and GRNZ is made by the authorized employee of Department of Internal Affairs.
