About projects implementation mechanisms within the digital agenda of the Eurasian Economic Union

In pursuance of the Decision of the Supreme Eurasian economic council of October 11, 2017 "About the Main directions of implementation of the digital agenda of the Eurasian Economic Union till 2025" Eurasian intergovernmental council solved No. 12:

1. Approve the enclosed projects implementation mechanisms within the digital agenda of the Eurasian Economic Union.

2. Eurasian economic commission:

in 2-month time to approve form of the passport of the project realized within the digital agenda of the Eurasian Economic Union, and the requirement to document package for initiation of the project according to Item 22 of the Procedure for study of initiatives within implementation of the digital agenda of the Eurasian Economic Union approved by the Decision of Eurasian intergovernmental council of October 25, 2017 No. 4;

following the results of implementation of two projects within the digital agenda of the Eurasian Economic Union to submit for review by Council of the Eurasian economic commission of the offer on adjustment of acts of bodies of the Eurasian Economic Union on projects implementation regarding determination of structure and roles of participants, and also the project documentation;

develop projects implementation business process model within the digital agenda of the Eurasian Economic Union;

provide decision making by Board of the Eurasian economic commission on question of approval of the specification of the project realized within the digital agenda of the Eurasian Economic Union, consensus;

provide participation in the competitive procedures which are carried out for the purpose of projects implementation within the digital agenda of the Eurasian Economic Union, the experts provided by authorized bodies of state members of the Eurasian Economic Union.

Projects implementation mechanisms within the digital agenda of the Eurasian Economic Union

I. General provisions

1. This document is developed according to the Main directions of implementation of the digital agenda of the Eurasian Economic Union till 2025 approved by the Decision of the Supreme Eurasian economic council of October 11, 2017 No. 12, determines temporary procedure for preparation, realization and monitoring of projects implementation within the digital agenda of the Eurasian Economic Union (further respectively - monitoring, the Union), and also functional structure of projects implementation within the digital agenda of the Union and is effective up to approval of permanent procedure for projects implementation within the digital agenda of the Union.

2. The concepts used hereunder mean the following:

"consortium" - the merging of the organizations of state members of the Union without formation of legal entity performing activities for the purpose of project implementation based on the consortium agreement;

"national customers" - the public authorities of state members of the Union participating in development, project implementation and control of the accomplishment course in the territory of state member of the Union of actions and (or) works within the project;

"the national customer coordinator" - one of national customers coordinating activities of other national customers from state member of the Union in case of development and project implementation;

"project" - complex of the interconnected actions intended for creation of unique results in the conditions of temporary and resource restrictions;

"project activities" - the activities connected with preparation, realization and project completion.

3. Public authorities and the organizations of state members of the Union (further - state members), consortia, the centers of competences of state members, the Eurasian economic commission (further - the Commission), contractors (collaborators), other subjects according to the legislation of state members can be project participants.

4. Project implementation is enabled on condition of its approval by all state members. At the same time the project is implemented on condition of participation in it at least 3 state members.

5. Coordination of project implementation is performed by the working group on coordination of the project (further - coordination panel) which part representatives of office of management of initiatives, departments of the Commission, authorized bodies and (or) the organizations of state members are.

II. Project activities

6. The document package for initiation of the project developed according to the Procedure for study of initiatives within implementation of the digital agenda of the Eurasian Economic Union approved by the Decision of Eurasian intergovernmental council of October 25, 2017 No. 4, and the passport of the project prepared by office of management of initiatives are submitted by the Commission for review by bodies of the Union.

7. For project implementation the following mechanism of decision making is used:

a) Council of the Commission:

makes the decision on project implementation or directs question for consideration of the Union by higher bodies;

based on documents for initiation of the project approves the passport of the project with indication of participants, amounts, terms and sources of financing, questions of the property rights;

approves the top level actions plan;

approves structure of coordination panel and its head;

according to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 No. 98, makes other decisions concerning projects implementation;

b) The board of the Commission based on the decision of Council of the Commission (other body of the Union) on project implementation makes the decision concerning the project progress, approves the specification of the project (including the requirements which are exerting impact on goal achievement of the project, but not providing implementation of actions by budget funds of the Union or budgets of state members) and other documents necessary for project implementation, according to Regulations of work of the Eurasian economic commission;

c) state members determine the authorized bodies and (or) the organizations responsible for project implementation and (or) accomplishment of actions within project activities at the national level, and also candidates of members of coordination panel also notify on it the Commission by the direction of the official letter.

8. In case of participation of state members in financing of the project within implementation of state programs the decision on project implementation and the passport of the project are accepted by Eurasian intergovernmental council. The state member in the specified case determines national customers and the national customer coordinator and notifies on it the Commission by the direction of the official letter.

9. Coordination panel:

a) determines project management methodology;

b) performs coordination of project activities;

c) performs monitoring;

d) prepares reports on the project progress;

e) prepares in need of the offer on modification of documents of the project;

e) considers problematic issues and disagreements between project participants;

g) will organize acceptance testing of the project;

h) performs other functions connected with coordination of project activities at the request of Council of the Commission.

10. In case of project implementation the centers of competences, being project participants can realize methodical and expert support of project activities.

11. The project can include the actions realized by the Commission, state members and (or) consortium.

12. Regarding the actions realized by the Commission, determination of the contractor of the relevant activities of the project is performed according to the Regulations on order placement and the conclusion of agreements to deliver goods, performance of works and rendering services for needs of the Eurasian economic commission approved by the Decision of Council of the Eurasian economic commission of January 25, 2012 No. 5.

13. In case of the organization of purchase at the single supplier (contractor) the procedure for preliminary selection is determined by Board of the Commission.

14. The contractor without fail attracts as collaborators of the organization from all state members participating in project implementation and also from other state members of the Union in case of interest. The contractor signs the consortium agreement which is submitted in the Commission with collaborators.

15. Council of the Commission based on the closing statement on project implementation submitted by coordination panel makes the decision on project closure.

In case of participation of state members in financing of the project within implementation of state programs the decision on project closure is submitted for review by Eurasian intergovernmental council.

III. Monitoring

16. Activities for carrying out monitoring are performed by coordination panel in interaction with the contractor.

17. During monitoring by coordination panel reports (including the closing statement) which frequency and terms of representation are specified in the passport of the project prepare, including obligatory submission of the report for consideration of the Commission by Council at least 2 times a year is provided.

18. For ensuring transparency and independent monitoring on the official site of the Union the passport of the project, reports on the project progress, information on the contractor, consortium, other data, except the materials containing data of limited distribution or trade secret are published.

19. Monitoring and the analysis of results project implementations are enabled taking into account the target indicators specified in the passport of the project, the top level actions plan. In case of variations from target indicators the coordination panel prepares offers on modification of documents of the project and the adjusting events are held.

IV. Funding mechanism for projects

20. Financial provision of projects implementation is performed:

a) by the budget funds of the Union provided the Commissions on creation, ensuring functioning and development of the integrated information system of the Union regarding implementation of the digital agenda of the Union - based on decisions of bodies of the Union on projects implementation;

b) at the expense of means of budgets of state members - by implementation by state members of separate actions of projects as a part of state programs according to the legislation, and also actions for development of national segments of the integrated information system of the Union;

c) at the expense of means of members of the consortia, grants and other sources which are not prohibited by the legislation of state members.

V. Final provisions

21. The questions concerning the property rights to the results received within project implementation, copyright are determined in the passport of the project according to the right of the Union and the legislation of state members.
