Based on article 6 of the Air code of the Republic of Belarus, subitem 9.42 of Item 9 of the Regulations on the State military-industrial committee of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of December 8, 2009 No. 602, and the resolution of Council of Ministers of the Republic of Belarus of August 6, 2015 No. 665 "About approval procedure of the aviation rules regulating activities in the field of experimental aircraft, and the list of positions of aviation personnel of experimental aircraft of the Republic of Belarus" the State military-industrial committee of the Republic of Belarus DECIDES:
1. Approve the enclosed Aviation rules of certification of experimental aircrafts, aviation engines, air screws, onboard and land aeronautical equipment, aviation exercise machines of experimental aircraft of the Republic of Belarus.
2. Declare invalid the resolution of the State military-industrial committee of the Republic of Belarus of April 6, 2017 No. 6 "About approval of Aviation rules of certification of experimental aircrafts, aviation engines, air screws, onboard and land aeronautical equipment, aviation exercise machines of experimental aircraft of the Republic of Belarus".
3. This resolution becomes effective after its official publication.

1. These Aviation rules developed according to the Air code of the Republic of Belarus (further - the Air code), based on subitem 9.4-2 of Item 9 of the Regulations on the State military-industrial committee of the Republic of Belarus and the resolution of Council of Ministers of the Republic of Belarus of August 6, 2015 No. 665 govern the relations on the organization of certification of experimental aircrafts, aviation engines, air screws, onboard and land aeronautical equipment, aviation exercise machines of experimental aircraft of the Republic of Belarus.
2. In these Aviation rules the following terms and their determinations are applied:
acoustic or issued change - the change of standard design of sample influencing noise level on areas or issue and requiring additional certification on compliance to requirements to environmental protection;
minor change - change of standard design of sample which insignificantly influences its flight validity and is not the main change;
the main change - change of standard design of sample which significantly influences its flight validity;
the holder of the certificate of type - the applicant who received the certificate of type on the object of aircraft created by it;
the holder of the certificate of copy - the applicant who received the certificate of the copy belonging to it object of aircraft on the property right, the right of economic maintaining or operational management or other bases, stipulated by the legislation or the agreement;
evidential documentation - the documentation containing results of checks, testing, researches and estimates of technical condition of object of experimental aircraft, establishing its compliance to requirements of certified basis, which is drawn up and approved according to these Aviation rules;
the applicant - the legal entity (individual entrepreneur) who gave to the State military-industrial committee (further - Goskomvoyenprom) the request for receipt of the certificate like (copy) or other certified document;
the manufacturer - the legal entity performing production of object of aircraft;
component of object of aircraft - any its component;
design documentation - set of the design documents containing depending on their appointment this, necessary for development, production, control, acceptance, delivery, operation, repair of products;
modification - any main thing, the minor acoustic or issued change of standard design of sample of object of aircraft concerning its flight validity or affecting its characteristics, influencing the environment;
discrepancy - failure to meet requirements of certified basis and widespread regulations (criteria) of the flight validity established to object of aircraft and its components;
discrepancies of category "1" - the discrepancies which are directly influencing safety of flights and not allowing to provide compliance of object of aircraft and its components to requirements of certified basis, and durability of its design (for aircrafts) - to the requirements to the flight validity distributed to it;
discrepancies of category "2" - the discrepancies which are not allowing to provide compliance of object of aircraft and its components to requirements of certified basis, but directly not influencing safety of flights, ensuring the flight validity (for aircrafts) and connected directly with departure from the established procedures and standards;
airworthiness standards - the requirements to design, parameters and flight qualities of aircrafts and their components aimed at safety of flights;
the sample of object of aircraft - in relation to these Aviation rules sample of object of aircraft is type (copy) of the aircraft, pilotless aviation complex, type of the aviation mid-flight engine, type of the air screw and type of the auxiliary engine;
object of aircraft - aircrafts, pilotless aviation complexes, aviation engines, air screws, onboard and land aeronautical equipment, aviation exercise machines;
developer - the organization performing development of new type of object of aircraft, design documentation on prototype and production of prototype;
assembly sets - sets of ready details from which objects of aircraft will be collected;
the certificate of the flight validity - the document certifying compliance of the aircraft of the design specified in the certificate like (copy), and being necessary condition of the admission to flight operation of this aircraft with the restrictions set for it;
certification - establishment of compliance of object of aircraft and its production to requirements of the existing Aviation rules;
certified testing - set of the actions for check of compliance of the declared sample of object of aircraft to certified basis which are carried out by the certified center, the applicant and Goskomvoyenprom;
certified basis - complex of the requirements to the flight validity and environmental protection distributed to this sample of object of aircraft;
the certified center - the organization (structural division of the organization) which is performing certified works and having on that appropriate authority;
structural division - the division of Goskomvoyenprom performing function of specially authorized body in the field of experimental aircraft;
the table of correspondences - the document containing data on compliance of sample of object of aircraft to certified basis;
standard design - design of sample of object of aircraft (including its flight characteristics and operational restrictions) which compliance to requirements of certified basis is established by results of certification of sample;
operational documentation - documentation which separately or in total with other documentation determines service regulations of object of aircraft, including its maintenance, and containing operational restrictions, procedures and recommendations.
Other terms and their determinations applied in these Aviation rules are used in the values specified in the Air code and aviation rules regulating activities in the field of experimental aircraft.
3. These Aviation rules determine the procedures establishing relation of the organizations participating in certification of object of aircraft.
4. Action of these Aviation rules extends to the legal entities creating and operating experimental aircrafts (further - AF) and their components.
5. These Aviation rules do not cancel action of the documents issued in accordance with the established procedure and certifying the flight validity of AF and their components which were allowed to operation before their Date of Introduction in action.
6. Uniform application and unambiguous interpretation of the requirements to sample of object of aircraft included in its certified basis are necessary condition of ensuring its certification.
7. Objects of experimental aircraft are subject to certification according to these Aviation rules.
The objects of aircraft imported into the Republic of Belarus for implementation of types of activity in experimental aircraft and which do not have the certificate of type (the certificate of copy), the export certificate of the flight validity recognized in the Republic of Belarus are subject to obligatory certification according to requirements of these Aviation rules.
8. Expenses on certification of object of aircraft, except for the expenses of the republican budget allocated for maintenance of specially authorized body in the field of experimental aircraft (structural division) are born by the applicant regardless of results and the made decisions.
9. Compliance of sample of object of aircraft and its components to requirements of certified basis is established based on calculations, modeling, the analysis of operating experience of sample or its prototypes, preliminary testing and certified (laboratory, bench, land and flight) monitoring tests of sample.
10. Certified works are carried out according to the operating methods of determination of compliance or methods developed by the organizations and the companies which are carrying out certified works.
The specified methods are subject to approval by Goskomvoyenprom and join in programs of certified monitoring tests.
11. Certified monitoring tests are carried out under the direction of and Goskomvoyenprom control.
Goskomvoyenprom has the right to stop transition to the following stage of certification if the goals of the previous stage are not achieved.
12. The final decision on compliance of sample of object of aircraft to requirements to the flight validity and environmental protection accepts Goskomvoyenprom.
13. Departure from the requirements to the flight validity of sample included in its certified basis can be recognized Goskomvoyenpromy acceptable if these departures are compensated by the measures providing the level of the flight validity equivalent to the level established by the existing Aviation rules (airworthiness standards).
14. Goskomvoyenprom can demand from participants of certified works of representation of any materials confirming compliance of object of aircraft to requirements of certified basis and necessary for decision making to it.
15. Each sample will be certified together with its operational documentation.
16. The applicant is responsible for carrying out certified works according to the procedure, established by these Aviation rules, and also for compliance like object of aircraft to requirements of certified basis before the end of operation of object of aircraft.
17. Prior to carrying out (land, flight, bench, qualification) testing of object of aircraft the developer of object of aircraft processes the documents (the form, passports or the document equivalent to them) certifying compliance of this copy of design documentation developed in accordance with the established procedure to each copy of object of aircraft intended for carrying out specific type of testing.
Testing of object of aircraft can be begun only in the presence of the specified documents.
