I. General provisions

Subject of regulation of regulations

1. The administrative regulations of provision of the state service of licensing by Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications in the field of television broadcasting and broadcasting (further - Administrative regulations, the state service respectively) establish terms and the sequence of ministerial procedures (actions) performed by Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications (further - the licensing body) and officials when licensing television broadcasting, broadcasting.

2. Applicants by provision of the state service, except for provisions of data from the register of licenses in the form of the statement about the specific license, are the license applicants, licensees who are the Russian legal entities, on behalf of their authorized representatives acting by law or the power based on the power of attorney, or its copy certified notarially or body (official) who issued it in which the authorized signature is witnessed (further - the applicant).

3. The legal entity or physical person can be the applicant by provision of data from the register of licenses in the form of the statement about the specific license.

Reference information is placed at information stands in premises of the licensing body, on the official site, in the federal state information system "Federal Register of the State and Municipal Services (Functions)" according to the Regulations on the federal state information system "Federal Register of the State and Municipal Services (Functions)" approved by the order of the Government of the Russian Federation of October 24, 2011 No. 861 <1> (further - the federal register, the order of the Government of the Russian Federation No. 861), and also in the federal state information system "Single Portal of the State and Municipal Services (Functions)" according to the Regulations on the federal state information system "Single Portal of the State and Municipal Services (Functions)" approved by the order of the Government of the Russian Federation No. 861 (further - the Single portal).

II. Standard of provision of the state service

9. Provision of the state service is performed by the licensing body.

10. By provision of the state service it is forbidden to demand from the applicant of implementation of actions the, including approvals necessary for receipt of the state service and connected with the appeal to other state bodies and the organizations <2>, except for receipts of the services included in the list of services which are federal executive bodies, State Atomic Energy Corporation "Rosatom" of the state services, necessary and obligatory for provision, and are provided by the organizations participating in provision of the state services, No. 352 <3 approved by the order of the Government of the Russian Federation of May 6, 2011>.

c) prolongation (refusal in prolongation) license effective period;

d) ceased to be valid

e) provision of the statement from the register of licenses about the specific license;

g) the termination (refusal in the termination) actions of the license.

12. Ceased to be valid according to the Order of the Ministry of digital development, communication and mass communications of the Russian Federation and the Federal Service of the Russian Federation on supervision in the field of communication, information technologies and mass communications of 04.12.2020 No. 155

The term of provision of the state service, including taking into account need of the appeal to the organizations participating in provision of the state service, the term of suspension of provision of the state service if the possibility of suspension is stipulated by the legislation the Russian Federation, the term of issue (direction) of the documents which are result of provision of the state service

13. Provision (refusal in provision) licenses is performed no more than in 45 working days from the date of reception of an application about provision of the license and the documents attached to it.

14. Renewal (refusal in renewal) licenses is performed in time, not exceeding 30 working days from the date of reception of an application about renewal of the license and the documents attached to it.

15. Prolongation (refusal in prolongation) effective period of the license is performed within 30 working days from the date of receipt of the statement of the licensee for prolongation of effective period of the license.

19. Provision of data on the specific license in the form of the statement from the register of licenses which is created and kept according to the Rules of forming and maintaining the register of licenses and standard form of the statement from the register of licenses approved by the order of the Government of the Russian Federation of December 29, 2020 No. 2343 (The official Internet portal of legal information pravo.gov.ru, 31.12.2020, ID 0001202012310050) or provision of the certificate of lack of required data is performed within three working days from the date of receipt of the statement for provision of such data.

20. The termination (refusal in the termination) actions of the license is performed:

20.1. Within ten working days from the date of obtaining:

a) statements of the licensee for the termination of the licensed type of activity;

b) statements of the licensee for the termination of activities of the legal entity (except for reorganization in the form of transformation or merge in the presence for date of state registration of the legal successor of the reorganized legal entities at each legal entity of the license for the same type of activity participating in merge);

20.2. Within a month from the date of receipt of the written application of the founder of mass media about the termination of activities of the mass media provided by the license <5>.

22. For receipt of the license the license applicant submits in the licensing body the application for provision of the license according to appendix No. 1 to these Administrative regulations, and also:

a) the documents confirming observance of provisions of article 19.1 of the Law of the Russian Federation "About mass media" <6>;
