1. Bring in the order of the Minister of investments and development of the Republic of Kazakhstan of April 28, 2015 No. 499 "About approval of standards of the state services in the field of maintenance of the flight validity" (it is registered in the Register of state registration of regulatory legal acts for No. 11349, it is published on July 2, 2015 in information system of law of Ad_let) the following changes:

The standard of the state service "Issue of Certificates on State Registration of Civil Aircrafts of the Republic of Kazakhstan" approved by the specified order to be reworded as follows 1) according to appendix 1 to this order;

The standard of the state service "Issue of the Decision on Recognition of the Certificate of the Flight Validity of the Civil Aircrafts Issued by Foreign State" approved by the specified order to be reworded as follows 2) according to appendix 2 to this order;

The standard of the state service "Issue of the Certificate of the Aircraft on Noise" approved by the specified order to be reworded as follows 3) according to appendix 3 to this order;

The standard of the state service "Issue of Permission to Use of the Radio-transmitting Equipment" approved by the specified order to be reworded as follows 4) according to appendix 4 to this order;

The standard of the state service "Issue of Permission to Accomplishment of Special Flight" approved by the specified order to be reworded as follows 5) according to appendix 5 to this order;

The standard of the state service "Issue of the Export Certificate of the Flight Validity" approved by the specified order to be reworded as follows 6) according to appendix 6 to this order;

The standard of the state service "Issue of the Certificate of the Flight Validity of the Aircraft of Extralight Aircraft" approved by the specified order to be reworded as follows 7) according to appendix 7 to this order;

To be reworded as follows the standard of the state service "Certification of Compliance of Copy of the Civil Aircraft to Airworthiness Standards" approved by the specified order according to appendix 8 to this order;

The standard of the state service "Issue of the Certificate of the Flight Validity of the Civil Aircraft" approved by the specified order to be reworded as follows 9) according to appendix 9 to this order;

The standard of the state service "Issue of the Certificate like the Civil Aircraft" approved by the specified order to be reworded as follows 10) according to appendix 10 to this order;

The standard of the state service "Issue of the Certificate of the Organization for Maintenance and Repair of the Aircraft Equipment of Civil Aviation" approved by the specified order to be reworded as follows 11) according to appendix 11 to this order.

2. To provide to committee of civil aviation of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on the Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan;

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Standard of the state service "Issue of Certificates on State Registration of Civil Aircrafts of the Republic of Kazakhstan"

Chapter 1. General provisions

1. The state service "Issue of Certificates on State Registration of Civil Aircrafts of the Republic of Kazakhstan" (further - the state service).

2. The standard of the state service is developed by the Ministry of the industry and infrastructure development of the Republic of Kazakhstan (further - the Ministry).

3. The state service appears Committee of civil aviation of the Ministry (further - the service provider).

Reception of an application and issue of result of rendering the state service is performed through the web portal of "the electronic government": www.egov.kz (further - the portal).

Chapter 2. Procedure for rendering the state service

4. The term of rendering the state service from the moment of delivery of document package by the service provider on the portal - 20 (twenty) working days;

5. Form of rendering the state service: electronic (partially automated).

6. Result of rendering the state service - the certificate on state registration of the civil aircraft.

Form of provision of result of rendering the state service:

Electronic.

The result of rendering the state service goes by means of the portal to "personal account" of uslugopoluchatel, in electronic form, certified by the digital signature (further - the EDS) the authorized person of the service provider.

7. The state service is rendered on paid basis to physical persons and legal entities (further - uslugopoluchatel).

Payment of the registration fee of the civil aircraft is performed according to the procedure and the sizes determined by the Code of the Republic of Kazakhstan "About taxes and other obligatory payments in the budget" (Tax code).

Rates of charge for registration of the civil aircraft constitute:

1) for state registration of civil aircrafts - 7 monthly settlement indicators operating on collection payment date;

2) for re-registration of civil aircrafts - 7 monthly settlement indicators operating on collection payment date.

Payment of collection is performed in cash and non-cash form through the banks of the second level and the organization performing separate types of banking activities and also through payment gateway of "the electronic government".

8. The working schedule of the portal - round the clock except for technical breaks in connection with carrying out repair work (in case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan, reception of an application and issue of result of rendering the state service is performed the next working afternoon).

9. The list of the documents necessary for rendering the state service in case of the address of uslugopoluchatel on the portal:

1) the electronic copy of the request for state registration of the aircraft, according to appendix 1 to this standard of the state service;

2) the electronic copy of the constituent document (for legal entities) or the document proving the identity (for foreign physical persons);

in case the physical person or legal entity is nonresident of the Republic of Kazakhstan, electronic copies of documents are presented in the notarized form;

3) the notarized electronic copy of the purchase and sale agreement or other document confirming the property right (for foreign legal entities and physical persons);

4) the notarized electronic copy of the lease agreement, leasing, property hiring, other document confirming right to use by the aircraft;

5) electronic copy of the delivery-acceptance certificate of the civil aircraft;

6) the electronic copy of the inspection statement of technical condition of the aircraft in form, according to appendix 2 to this standard;

7) the electronic copy of the certificate of the type or the document equivalent to it certifying its compliance with airworthiness standards, the developer of the civil aircraft issued by the state.

The following documents are in the presence provided:

1) the electronic copy of the document confirming exception of the civil aircraft of the register of the state aircraft or of the register of civil aircrafts of foreign state;

2) electronic copy of the export certificate of the flight validity;

3) electronic copies of documents on re-equipment of the aircraft;

4) the electronic copy of the temporary certificate of the validity of the aircraft to flights issued by manufacturing plant.

By results of the carried-out works on verification of documentation and survey of the aircraft by authorized body the appraisal report about serviceability of the civil aircraft (further - the appraisal report), in form, according to appendix 3 to this standard is drawn up.

10. For receipt of the certificate on state registration (in case of change of the owner, in case of change of purpose of the aircraft, in case of change of the operator) civil aircrafts the uslugopoluchatel submits the application in electronic form, the uslugopoluchatel certified by the EDS, according to appendix 1 to this standard of the state service.

11. In case of exception of the civil aircraft of the State register of civil aircrafts of the Republic of Kazakhstan the uslugopoluchatel submits the application in electronic form, the uslugopoluchatel certified by the EDS, according to appendix 4 to this standard of the state service.

12. In case of delivery by uslugopoluchatel of all of above-mentioned electronic documents of the copy in this Item by means of the portal to uslugopoluchatel the status about acceptance of request for rendering the state service, with indication of date and time of receipt of result of the state service goes to "personal account".

Data on identity documents, on state registration (re-registration) of the legal entity, on state registration as the individual entrepreneur, about state registration of the civil aircraft, the air operator certificate, certificate on noise on the area, the certificate on radio station, certificates on the right of accomplishment of aviation works, the service provider receives from the corresponding state information systems through lock of "the electronic government".

In case of provision by uslugopoluchatel of incomplete document package according to the list provided by this standard and (or) documents with the expired effective period the service provider refuses reception of an application.

13. The basis for refusal in rendering the state service are:

1) the aircraft does not conform to requirements of the flight validity;

2) establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them;

3) discrepancy of uslugopoluchatel and (or) the provided materials, supplied and the information necessary for rendering the state service;

4) concerning uslugopoluchatel there is decision (sentence) of court on prohibition of activities or the separate types of activity requiring receipt of certain state service which took legal effect;

5) concerning uslugopoluchatel there is judgment which took legal effect based on which the uslugopoluchatel is deprived of the special right connected with receipt of service.

Chapter 3. Procedure for appeal of decisions, actions (failure to act) of the service provider and (or) his officials concerning rendering the state services

14. Appeal of decisions, actions (bezdeystviye) of the service provider and (or) his officials concerning rendering the state services moves to the address specified in Item 16 of this standard.

The claim is submitted in writing by mail or purposely through office of the service provider, or the Ministry.

Confirmation of adoption of the claim is its registration (stamp, the entering number and date) in office of the service provider, or the Ministry, with indication of surname and initials of person which accepted the claim, term and the place of receipt of the answer to the made complaint.

In case of the address through the portal to obtain information on procedure for appeal by phone single contact center 1414.

When sending the claim by means of the portal from "personal account" of uslugopoluchatel information on the address which is updated during processing of the address by the service provider is available (marks about delivery, registration, execution, the answer about consideration or refusal in consideration).

The claim of uslugopoluchatel which arrived to the service provider, the Ministry is subject to consideration within five working days from the date of its registration.

In case of disagreement with results of the rendered state service the uslugopoluchatel addresses with the claim to authorized body by assessment and control of quality of rendering the state services.

The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is subject to consideration within fifteen working days from the date of its registration.

In the claim:

physical person - its surname, name, and also at will middle name, the postal address are specified;

the legal entity - its name, the postal address, reference number and date. The appeal is signed by uslugopoluchatel.

15. In disagreement cases with results of the rendered state service, the uslugopoluchatel takes a legal action in the procedure established by the legislation of the Republic of Kazakhstan.

Chapter 4. Other requirements taking into account features of rendering the state service electronically.

16. Addresses of places of rendering the state service are placed on Internet resource of the service provider: www.miid.gov.kz, (in the subsection "State Services" of the Section "Committee of Civil Aviation").

17. The claim is submitted addressed to the head of the service provider to the address specified in Item 16 of this standard of the state service or addressed to the head of the Ministry of the address: 010000, Nour-Sultan's city, Prospekt Kabangbai of the batyr 32/1, e-mail address: caa@miid.gov.kz, reception phone: 8 (7172) 75-48-02.

18. Uslugopoluchatel receives information on procedure and the status of rendering the state service in the mode of remote access by means of portal "personal account", and also single contact center concerning rendering the state services.

19. Information on procedure for rendering the state service can be obtained by phones of service providers specified on Internet resource of the Ministry www.mіid.gov.kz, or by phone single contact center concerning rendering the state services: 1414.
