About approval of Aviation regulations of commercial conditions of airborne transportations
According to Articles 6, 18 Air codes of the Republic of Belarus and based on subitem 5.40 of Item 5 of the Regulations on the Ministry of Transport and Communications of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of July 31, 2006 No. 985 "Questions of the Ministry of Transport and Communications of the Republic of Belarus", the Ministry of Transport and Communications of the Republic of Belarus DECIDES:
1. Approve the enclosed Aviation regulations of commercial conditions of airborne transportations.
2. This resolution becomes effective since April 25, 2012.

1. Aviation regulations of commercial conditions of airborne transportations (further - Aviation rules) are developed based on the legislation of the Republic of Belarus taking into account the international obligations of the Republic of Belarus, standards and recommended practice of International Civil Aviation Organization (further - ICAO) for the purpose of commercial regulation of the airborne transportations performed by civil aircrafts of the Belarusian and foreign carriers with use of airspace and airfields (airfields) of civil aviation of the Republic of Belarus.
2. For the purposes of these Aviation rules the following main terms and their determinations are applied:
the aviation organization - the organization having the purposes of the activities accomplishment and (or) servicing of airborne transportations, accomplishment of aviation works, implementation of other types of activity in the field of aircraft (further - the aviaorganization);
accreditation - submission of certain list of documents by foreign air carrier for the purpose of official confirmation of observance of the conditions shown by Department on aircraft of the Ministry of Transport and Communications of the Republic of Belarus (further - Department on aircraft) for accomplishment of flights in the Republic of Belarus;
nonstop (transit) airborne transportations - the airborne transportations performed with use only of airspace of the Republic of Belarus;
airborne transportation - transportation by aircrafts of passengers, baggage, loads and mailings;
the proper shipping name - the name which should be used for the description of specific item or substance in all carriage documents and notifications and where it is reasonable - on packaging sets;
the appointed airline - the aviaorganization which was appointed and received powers on operation of the contractual line according to the international treaty of the Republic of Belarus on air traffic;
dangerous goods - the substances, materials and products having properties which manifestation in transit can serve as cause of explosion and (or) the fire to lead to death, disease, injuring, poisoning, radiation or burns of people and (or) animals, and also to cause damage of constructions, vehicles, other objects of transportation and (or) to do harm to the environment;
carrier - the operator of the aircraft having the right to accomplishment of airborne transportations according to the legislation;
transportation reservoir - the number of passenger (cargo) seats of the aircraft increased by the number of flights for certain period of time;
regular flight - the flight of the aircraft performed along route according to the established schedule;
particular loads (goods) - military products, and also the equipment, materials, raw materials which are used in the civil purposes, but can be applied to the arms production and military equipment, including weapons of mass destruction and means of its delivery;
the slot - period during which take-off or landing is allowed to the aircraft;
freedom of air - the term ICAO meaning the commercial conditions and privileges provided by one state to other state in case of accomplishment of the international flights;
flight the plan (FPL) - flight plan;
charter flight - the irregular flight performed under the agreement of chartering of the aircraft;
charter flights on permanent basis - the charter flights performed along the same route with certain frequency (as a rule, at least once a decade);
charter flights on regular basis (regular charter) - the charter flights performed along the same route within half-year on certain and invariable days of the week and slots;
RPL (RPL) - the repeating plan of flights;
UTTs (UTC) - coordinate world time.
3. Accreditation in Department on aircraft there shall undergo foreign carriers:
the having intentions to carry out flights with use of airfields of the Republic of Belarus;
not registered in ICAO.
4. Not later than 30 days prior to the first flight the carrier shall submit to Department on aircraft the request for accreditation with appendix of document package according to appendices 1 and 2 to these Aviation rules.
5. The decision on accreditation is reported to carrier and in the center of coordination and ensuring flights of the state company "Belaeronavigation" (further - TsKOP).
6. TsKOP conducts databank on accredited carriers and provides information on results of accreditation to interested persons.
7. Carriers not later than in 14-day time inform Department on aircraft on changes of the data containing in the documents submitted earlier on accreditation.
8. The decision on accomplishment of flight by the aircraft of the carrier which did not undergo accreditation is accepted by Department on aircraft or according to its order the authorized aviaorganization.
9. The department on aircraft has the right to demand accreditation of any carrier having intentions to make flights with use of airspace of the Republic of Belarus.
