About modification of the Decision of Board of the Eurasian economic commission of May 10, 2016 No. 38

According to Item 30 of the Protocol on information and communication technologies and information exchange within the Eurasian Economic Union (appendix № 3 to the Agreement on the Eurasian Economic Union of May 29, 2014) and being guided by the Decision of Board of the Eurasian economic commission of November 6, 2014 № 200, the Board of the Eurasian economic commission decided:

1. Bring in the Decision of Board of the Eurasian economic commission of May 10, 2016 No. 38 "About the technological documents regulating information exchange in case of realization by means of the integrated information system of foreign and mutual trade of general process "Forming and maintaining the unified register of conformity assessment bodies of the Eurasian Economic Union (including certification bodies, test laboratories (centers))" changes according to appendix.

2. Determine that the term of accomplishment of the procedure of accession to general process "" Does not exceed forming and maintaining the unified register of conformity assessment bodies of the Eurasian Economic Union (including certification bodies, test laboratories (centers)) 9 months from the date of the introduction of this Decision in force.

3. This Decision becomes effective after 30 calendar days from the date of its official publication, except for requirements with code 33 (the table 11) and requirements with code 36 (the table 12), the state members of the Eurasian Economic Union provided by Regulations of information exchange between authorized bodies and the Eurasian economic commission in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming and maintaining the unified register of conformity assessment bodies of the Eurasian Economic Union (including certification bodies, test laboratories (centers))" (taking into account the changes made by this Decision) which are applied after 90 calendar days from the date of inclusion of the reference books containing in the formalized data type from the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union in structure of resources of single system of normative reference information of the Eurasian Economic Union.

1. Rules of information exchange in case of realization by means of the integrated information system of foreign and mutual trade of general process "Forming and maintaining the unified register of conformity assessment bodies of the Eurasian Economic Union (including certification bodies, test laboratories (centers))", approved by the specified Decision to state in the following edition:

Rules of information exchange in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming and maintaining the unified register of conformity assessment bodies of the Eurasian Economic Union (including certification bodies, test laboratories (centers))"

I. General provisions

1. These rules are developed according to the following international treaties and acts constituting the right of the Eurasian Economic Union (further - the Union):

The agreement on the Eurasian Economic Union of May 29, 2014;

The decision of Council of the Eurasian economic commission of December 5, 2018 No. 100 "About the Procedure for inclusion of accredited bodies on assessment of conformity (including certification bodies, test laboratories (centers)) in the unified register of conformity assessment bodies of the Eurasian Economic Union, and also its forming and maintaining" (further - the Procedure);

The decision of the Commission of the Customs union of April 7, 2011 No. 620 "About the Single list of products which are subject to obligatory assessment (confirmation) of compliance within the Customs union with issue of single documents";

The decision of Board of the Euroasian economic commission of November 6, 2014 №200 "About the technological documents regulating information exchange in case of realization by means of the integrated information system of foreign and mutual trade of general processes";

The decision of Board of the Eurasian economic commission of January 27, 2015 №5 "About approval of Rules of electronic data exchange in the integrated information system of foreign and mutual trade";

The decision of Board of the Euroasian economic commission of April 14, 2015 № 29 "About the list of general processes within the Eurasian Economic Union and modification of the Decision of Board of the Euroasian economic commission of August 19, 2014 № 132";

The decision of Board of the Euroasian economic commission of June 9, 2015 №63 "About the Analysis technique, optimization, harmonizations and descriptions of general processes within the Eurasian Economic Union";

The decision of Board of the Eurasian economic commission of September 28, 2015 No. 125 "About approval of the Regulations on exchange of electronic documents in case of cross-border interaction of public authorities of state members of the Eurasian Economic Union among themselves and with the Eurasian economic commission".

II. Scope

2. These rules forming and maintaining the unified register of conformity assessment bodies of the Eurasian Economic Union (including certification bodies, test laboratories (centers))" (further - general process), including the description of the procedures performed within this general process are developed for the purpose of determination of procedure and conditions of information exchange between participants of general process ".

3. These rules are applied by participants of general process in case of control of procedure for performing procedures and transactions within general process, and also during the designing, development and completion of components of the information systems providing realization of general process.

III. Basic concepts

4. For the purposes of these rules concepts which mean the following are used:

"authorization" - provision to the participant of general process of the rights to accomplishment of certain actions;

"unified register" - the unified register of conformity assessment bodies of the Union representing general information resource which contains data on conformity assessment bodies which forming and maintaining are performed by the Eurasian economic commission in electronic form with use of means of the integrated information system of the Union within interaction of state members of the Union and the Eurasian economic commission based on data from the national parts of the unified register represented to the Eurasian economic commission by accreditation bodies of state members of the Union";

"national part of the unified register" - the part of the national register which is physically located in information system of state member of the Union which contains data on the conformity assessment bodies included in the unified register which forming and maintaining performs accreditation body of state member of the Union";

"conformity assessment bodies" - bodies (including certification bodies, test laboratories (centers)), the accredited and (or) authorized according to the legislation of state members of the Union on implementation assessments of conformity.

The concepts "group of procedures of general process", "information object of general process", "contractor", "transaction of general process", "procedure of general process" and "participant of general process" used in these rules are applied in the values determined by the Analysis technique, optimizations, the harmonization and the description of general processes within the Eurasian Economic Union approved by the Decision of Board of the Eurasian economic commission of June 9, 2015 № 63.

IV. Main data on general process

5. Full name of general process: "Forming and maintaining the unified register of conformity assessment bodies of the Eurasian Economic Union (including certification bodies, test laboratories (centers))".

1. Purpose and tasks of general process

7. The purpose of general process is enhancement of mechanisms of forming and representation to participants of general process of data of the unified register.

8. For goal achievement of general process it is necessary to solve the following problems:

a) provide the Eurasian economic commission (further - the Commission) from authorized bodies of state members of the Union (further - state members) means of the integrated information system of the Union (further - the integrated system) data from national parts of the unified register and their publication on information portal of the Union;

b) provide possibility of receipt by interested persons of data on conformity assessment bodies on information portal of the Union;

c) provide authorized bodies of state members means of the integrated system of data on conformity assessment bodies from the unified register;

d) provide use of single qualifiers and reference books.

9. The list of participants of general process is provided in table 1.

3. Structure of general process

10. General process represents set of the procedures grouped according to the destination:

a) procedures of forming and maintaining the unified register;

b) procedures of submission of data from the unified register.

11. In case of performing procedures of general process forming and maintaining the unified register based on data from the national parts of the unified register received from authorized bodies of state members and also submission of data on the conformity assessment bodies included in the unified register, to authorized bodies of state members and interested persons are performed.

When forming and maintaining the unified register the following procedures of general process included in group of procedures of forming and maintaining the unified register are performed:

inclusion of data in the unified register;

change of the data containing in the unified register.

In case of submission of data to authorized bodies of state members the following procedures of general process included in group of procedures of submission of data of the unified register are performed:

receipt of data on date and time of updating of the unified register;

receipt of data from the unified register;

receipt of the changed data from the unified register.

Submission of the specified data is performed according to Regulations of information exchange between authorized bodies of state members of the Eurasian Economic Union and the Eurasian economic commission in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming and maintaining the unified register of conformity assessment bodies of the Eurasian Economic Union (including certification bodies, test laboratories (centers))", the approved Decision of Board of the Eurasian economic commission of May 10, 2016 No. 38 (further - Regulations of information exchange).

The format and structure of the represented data shall match the Description of formats and structures of the electronic documents and data used for realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming and maintaining the unified register of conformity assessment bodies of the Eurasian Economic Union (including certification bodies, test laboratories (centers))", to No. 38 approved by the Decision of Board of the Eurasian economic commission of May 10, 2016 (further - the Description of formats and structures of electronic documents and data).

Information exchange between authorized bodies of state members and the Commission is performed with use of the integrated system. Access to the data containing in the unified register for interested persons is performed through information portal of the Union.

12. The provided description of structure of general process is provided in the figure 1.

13. The procedure for performing procedures of general process, grouped according to the destination, including the disaggregated activity description, is given in the Section VIII of these rules.

14. For each group of procedures the general scheme showing bonds between procedures of general process and procedure for their accomplishment is provided. The general scheme of procedures is constructed with use of the graphical notation of UML (unified modeling language - Unified Modeling Language) and supplied with the text description.

4. Group of procedures of forming and maintaining the unified register

15. Performing procedures of forming and maintaining the unified register begins with the moment of receipt of state member of data by authorized body for inclusion in national part of the unified register or for entering of changes into it.

The authorized body of state member provides uniqueness of identification number of conformity assessment body in national part of the unified register.

In case of inclusion of new data in national part of the unified register the "Inclusion of Data in the Unified Register" procedure is performed (P.TS.02.PRC.001).

If reasons to believe are had that the conformity assessment body does not correspond to criteria of the Procedure, the question of inclusion of data on such body in the unified register is submitted for consideration of Board of the Commission.

In case of modification of the data containing in national part of the unified register the "Change of the Data Containing in the Unified Register" procedure is performed (P.TS.02.PRC.002).

If reasons to believe are had that the conformity assessment body does not correspond to criteria of the Procedure, the question of assignment to such body in the unified register of the status is submitted for consideration of Board of the Commission "is excluded".

In case of placement in information system about dangerous products of the Union of data on dangerous products which were followed by the documents on assessment of conformity issued by one certification body 2 and more once a month such body in the unified register is given the status "is excluded".

5. Group of procedures of submission of data of the unified register

18. Procedures of submission of data from the unified register are performed in case of receipt of the corresponding requests from information systems of authorized bodies of state members.

Within performing procedures of submission of data from the unified register the following types of requests are processed:

the request of data on date and time of updating of the unified register which is carried out for the purpose of assessment of need of obtaining by authorized body of state member of the changed data from the unified register;

the request of data from the unified register which is carried out for the purpose of receipt of state member of data by authorized body from the unified register, urgent for certain date. Data from the unified register can be requested both for current date, and as of the date specified in request;

request of the changed data data, addition or change of which came from the unified register in case of which are requested or the data containing in the unified register, in full (taking into account historical data) or since date and time of updating of the national part of the unified register specified in request, until accomplishment of request by means of use of the integrated system. The request of data from the unified register is in full used in case of initial loading of data in information system of authorized body of state member, for example, in case of initialization of general process, connection of new state member, recovery of information after failure. In this case date and time of updating of data in national part of the unified register in request are not specified.
