About introduction of amendments to some acts of the Cabinet of Ministers of Ukraine

The Cabinet of Ministers of Ukraine decides:

Make changes which are applied to acts of the Cabinet of Ministers of Ukraine.

Changes which are made to acts of the Cabinet of Ministers of Ukraine

1. In item 4 of the resolution of the Cabinet of Ministers of Ukraine of May 12, 1994 No. 302 "About procedure for certification and breastplates of veterans of war" (ZP of Ukraine, 1994, No. 9, Art. 218; Official Bulletin of Ukraine, 2009, No. 3, Art. 85; 2012, No. 7, Art. 249, No. 77, Art. 3106; 2013, No. 41, Art. 1477; 2016, No. 35, Art. 1360; 2017, No. 38, Art. 1204; 2019, No. 70, Art. 2456):

Paragraph two to state 1) in the following edition:

"for persons with disability owing to war, participants of war and persons on whom operation of the Law of Ukraine "Expatiates on the status of veterans of war, guarantees of their social protection", - by request of the Ministry of cases of veterans, temporarily occupied territories and internally displaced persons;";

2) in paragraph three of the word "Ministries of Cases of Veterans" shall be replaced with words "The ministries of cases of veterans, temporarily occupied territories and internally displaced persons".

In appendix 1 to the resolution of the Cabinet of Ministers of Ukraine of December 26, 2011 No. 1399 "About establishment of limit of the cars servicing executive bodies" (The Official Bulletin of Ukraine, 2012, No. 7, Art. 246; 2014, No. 28, Art. 793; 2016, No. 101, Art. 3310; 2018, No. 99, Art. 3288):

4. In Item 2 of the resolution of the Cabinet of Ministers of Ukraine of August 20, 2014 No. 413 "About approval of the Procedure for provision and deprivation of participant status of fighting to persons who protected independence sovereignty and territorial integrity of Ukraine and were directly involved in anti-terrorist operation, ensuring its carrying out or in implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, ensuring their implementation" (The Official Bulletin of Ukraine, 2014, No. 73, Art. 2068; 2017, No. 86, Art. 2614; 2018, No. 42, Art. 1484; 2019, No. 70, of the Art. 2456) of the word "Ministry of Cases of Veterans" in all cases shall be replaced with words "The ministry of cases of veterans, temporarily occupied territories and internally displaced persons" in the corresponding case.

5. In Item 3 of the resolution of the Cabinet of Ministers of Ukraine of August 19, 2015 No. 604 "Some questions of payment of the one-time monetary assistance in case of death (death) or disability of the volunteer owing to the wound (contusion, injury or injuries) sustained during provision of the volunteer help in the area of conducting anti-terrorist operation, implementation of measures for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, fighting and armed conflict" (The Official Bulletin of Ukraine, 2015, No. 68, Art. 2234; 2019, 19, the Art. 660, No. 70, the Art. 2456) words to "The Ministry of economic development and trade together with the Ministry of cases of veterans" shall be replaced with words No. to "The ministry of development of economy, trade and agricultural industry together with the Ministry of cases of veterans, temporarily occupied territories and internally displaced persons".

6. In Item 3 of the resolution of the Cabinet of Ministers of Ukraine of April 29, 2016 No. 336 "Some questions of social protection of veterans of war and members of their families" (The Official Bulletin of Ukraine, 2016, No. 42, Art. 1575; 2019, 70, the Art. 2456) words to "The Ministry of economic development and trade together with the Ministry of cases of veterans" shall be replaced with words No. to "The ministry of development of economy, trade and agricultural industry together with the Ministry of cases of veterans, temporarily occupied territories and internally displaced persons".

7. Item 9 of appendix to the resolution of the Cabinet of Ministers of Ukraine of October 11, 2016 No. 710 "About effective use of public funds" (The Official Bulletin of Ukraine, 2016, No. 83, Art. 2739; 2018, No. 61, Art. 2108; 2019, 7, the Art. 202, No. 72, the Art. 2532, No. 78, the Art. 2698, the Art. 2701) after words of "the deputy minister concerning state registration" to add No. with words ", the Minister of cases of veterans, temporarily occupied territories and internally displaced persons who can have no more than six deputies, including the First Deputy Minister and the deputy minister concerning the European integration".

8. In the resolution of the Cabinet of Ministers of Ukraine of February 28, 2018 No. 119 "Some questions of social protection of injured participants of Revolution of Advantage" (The Official Bulletin of Ukraine, 2018, No. 23, the Art. 778):

The second Item 3 of the Procedure for provision of the status of the injured participant Revolyution Dostoinstva approved by the specified resolution the word "Minsotspolitiki" to replace 1) in the paragraph with the word "Minveteranov";

The word "Minsotspolitiki" to replace 2) in Item 10 of the Procedure for the production and certification "The injured participant Revolyutsii Dostoinstva" approved by the specified resolution with the word "Minveteranov".

9. In the resolution of the Cabinet of Ministers of Ukraine of December 27, 2018 No. 1175 "Some questions of the Ministry of cases of veterans" (The Official Bulletin of Ukraine, 2019, No. 4, the Art. 154):

1) in the resolution:

to state the name of the resolution in the following edition:

"Some questions of the Ministry of cases of veterans, temporarily occupied territories and internally displaced persons";

in Item 1 of the word "Ministry of Cases of Veterans of Ukraine" shall be replaced with words "The ministry of cases of veterans, temporarily occupied territories and internally displaced persons of Ukraine";

The Regulations on the Ministry of cases of veterans of Ukraine approved by the specified resolution to state 2) in the following edition:

Regulations on the Ministry of cases of veterans, temporarily occupied territories and internally displaced persons of Ukraine

1. The ministry of cases of veterans, temporarily occupied territories and internally displaced persons of Ukraine (Minveteranov) is the central executive body which activities go and coordinated by the Cabinet of Ministers of Ukraine.

Minveteranov is principal organ in system of the central executive bodies which provides forming and realizes state policy in the field of social protection of veterans of war, of persons who have special merits before the Homeland, injured participants of Revolution of Advantage (further - veterans), members of families of veterans, persons on whom operation of the Law of Ukraine "On the status of veterans of war, guarantees of their social protection" (further - members of families of veterans), and concerning temporarily occupied territories in the Donetsk and Luhansk regions and temporarily occupied territory of the Autonomous Republic of Crimea and Sevastopol expatiates (further - temporarily occupied territories of Ukraine).

2. Minveteranov in the activities is guided by the Constitution and the laws of Ukraine, presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine accepted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, other acts of the legislation.

3. The main objectives Minveteranov are:

1) forming and realization of state policy in the field of:

social protection of veterans and members of their families, including ensuring psychological recovery, social and professional adaptation, employment, increase in competitiveness in the labor market, and also technical and other means of rehabilitation, sanatorium treatment, housing; provision of educational services, lifelong state grants, annual payment by May 5 of the one-time monetary assistance (except the organization of payment of such help); provision, deprivation of the status and certification to veterans;

preserving mental health of veterans and members of their families;

celebration of memory of veterans;

temporarily occupied territories of Ukraine and the population, on them living which ultimate goal is their integration into single constitutional space of Ukraine;

internally displaced persons from temporarily occupied territories of Ukraine, assistance of realization of their rights and freedoms and creation of conditions for voluntary return of such persons to the abandoned residence after recovery of the constitutional space of Ukraine (reintegration) or integration in the new place of residence in Ukraine;

applications of regulations of international humanitarian law in the territory of Ukraine;

developments of the world, recovery and development of the Donetsk and Luhansk regions;

2) providing rights and freedoms of veterans and members of their families;

3) ensuring forming and maintaining the Unified state register of veterans of war.

4. Minveteranov it agrees to the tasks assigned to him:

1) generalizes practice of application of the legislation on the questions which are within its competence develops offers concerning enhancement of legal acts, acts of the President of Ukraine, the Cabinet of Ministers of Ukraine and in accordance with the established procedure submits them for consideration of the Cabinet of Ministers of Ukraine;

2) develops drafts of the laws and other regulatory legal acts on the questions which are within its competence;

3) approves drafts of the laws, other drafts of acts of the legislation which arrive on approval from other ministries and the central executive bodies, prepares within the powers provided by the law, the conclusions and offers to drafts of the laws, other acts of the legislation which move to the Cabinet of Ministers of Ukraine, and drafts of the laws submitted for consideration of the Verkhovna Rada of Ukraine by other persons of law of the legislative initiative, regulatory legal acts of the Verkhovna Rada of the Autonomous Republic of Crimea;

Prepares 4) within the powers provided by the law, notes and offers to the laws adopted by the Verkhovna Rada of Ukraine which arrived for the signature to the President of Ukraine;

Provides 5) within the powers provided by the law, methodological support during development, monitoring and efficiency evaluation of implementation of documents of strategic planning (programs of social and economic development, target programs, etc.) of the local state administrations, local government bodies for the questions which are within the competence Minveteranov;

6) is performed as the state customer by the common directorship and control of development of the state target programs and accomplishment of the actions and tasks determined in them;

7) participates in carrying out the analysis of drafts of the state target programs for the purpose of determination of their influence on providing the rights and freedoms of veterans, members of their families and internally displaced persons from temporarily occupied territories of Ukraine;

8) participates in preparation of the generalized conclusion about results of accomplishment of the state target programs regarding evaluating effects of their accomplishment on providing the rights and freedoms of veterans, members of their families and internally displaced persons from temporarily occupied territories of Ukraine;

9) promotes:

to promoting and ensuring forming of positive image of the veteran;

realization of the rights and freedoms of the citizens of Ukraine living in temporarily occupied territories of Ukraine;

to implementation of measures for release of prisoners of war and hostages, search of missing persons in connection with wars and the local conflicts, fulfillment of duties of military service, takes part in the solution of questions of social and professional adaptation of the former prisoners of war who returned home;

to involvement of veterans to national patriotically (including military patriotic) to education of children and youth;

to development of physical culture and sport among veterans and members of their families, to their participation in the international and other actions, provides training of national team of Ukraine from among veterans and its participation in the international sports competitions, develops programs of sports rehabilitation and sports activities for veterans and members of their families;

to satisfaction of national and cultural, educational requirements, development of ethnic identity of the indigenous people and ethnic minorities living in temporarily occupied territory of the Autonomous Republic of Crimea and Sevastopol;

to free development of the Crimean Tatar language, languages of other indigenous people and ethnic minorities living in temporarily occupied territory of the Autonomous Republic of Crimea and Sevastopol;

to satisfaction of social and economic, ecological and cultural requirements of the population living in temporarily occupied territories of Ukraine;

in the procedure established by the legislation to social security of internally displaced persons, social resettlement of persons who were imprisoned personal as a result of actions of illegal armed groups, occupational administration and/or authorities of the Russian Federation in temporarily occupied territories of Ukraine;

together with MON and local government bodies to receipt of preschool, complete general secondary education by internally displaced persons, professional (professional) education, and also the higher education;

to attraction in accordance with the established procedure means of the international organizations, non-governmental organizations of foreign states, the international non-governmental organizations for accomplishment of the programs aimed at providing protection of the rights and freedoms of persons which are violated as a result of armed conflict and/or temporary occupation of part of the territory of Ukraine;

to provision to International Humanitarian Organizations of access to the population living in temporarily occupied territories of Ukraine;

to protection by internally displaced persons and persons who live in temporarily occupied territories of Ukraine, their rights in the international degrees of jurisdiction;

to implementation of the actions aimed at the development of ethnic originality and culture of the indigenous people and ethnic minorities living in temporarily occupied territory of the Autonomous Republic of Crimea and Sevastopol;

Coordinates 10) on the questions carried to its competence, implementation by executive bodies and in the cases provided by the law, local government bodies of actions for questions:

providing the rights and freedoms of veterans, members of their families and internally displaced persons from temporarily occupied territories of Ukraine;

social protection of veterans and members of their families;

celebrations of memory of veterans;

developments of interaction and cooperation with institutes of civil society;

11) in coordination with the Ministry of Health is created by the list of medical services for veterans and members of their families which are not included in the program of the state guarantees of medical attendance of the population whose payment is guaranteed by the state;

12) interacts with International Humanitarian Organizations on rendering the humanitarian assistance by them to the civilian population during armed conflicts;

Will organize 13) and carries out explanatory work about need of observance of regulations of international humanitarian law;

14) is carried out by monitoring:

conditions of observance of the rights and freedoms of veterans, members of their families, rights and freedoms of man and citizen in temporarily occupied territories of Ukraine;

conditions of observance of requirements of the legislation of rather social protection of veterans and members of their families, including provision of housing for veterans and members of their families, psychological recovery and social adaptation of veterans and members of their families, employment and leisure of veterans, recovery and enhancement of their professional skills and abilities by professional training, increase in competitiveness in the labor market, provisions to veterans of medical services;

observance of regulations of international humanitarian law also takes responses to the facts of their violation;

activities of International Humanitarian Organizations for the questions which are within the competence Minveteranov;

impacts of armed conflict and temporary occupation of part of the territory of Ukraine on social and economic development of the state and separate industries of economy;

Will organize 15) and coordinates work on questions:

provisions, deprivations of participant status of fighting and about purpose of the one-time monetary assistance in case of death (death) or disability of the volunteer and some other categories of faces according to the Law of Ukraine "About the status of veterans of war, guarantees of their social protection";

factual determinations receipt by persons of the wounds or other injuries of health received from explosives, ammunition and military arms in the territory of conducting anti-terrorist operation, implementation of measures for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions;

16) considers materials about confirmation of participation of persons in underground and guerrilla liberating fight in Ukraine in the 20th century;

17) cooperates with public associations by determination and realization of the priority directions of state policy on the questions which are within the competence Minveteranov provides to public associations of veterans in the procedure established by the legislation financial support on competitive basis for program implementation (projects, actions), carries out monitoring and efficiency analysis of programs (projects, actions) realized at the expense of means of the government budget by public associations of veterans;

Initiates 18) and provides carrying out dialogue with public associations of veterans, members of their families and internally displaced persons;

Plans 19) and will organize implementation of actions for worthy celebration of memory of veterans (search implementation, burial and reburial, preserving and arrangement of military burials, memory perpetuating and so forth), coordinates activities of executive bodies and local government bodies of rather worthy celebration of memory of veterans;

20) participates in the organization of burials and reburials of persons which died (died) owing to direct participation in fighting in case of protection of the Fatherland or fulfillment of duties of military service in the territory of Ukraine and other states;

Plans 21) and will organize within the competence celebrations of the anniversary, memorable and historical dates, international days at the national level connected with celebration of veterans, protection of independence, sovereignty and territorial integrity of Ukraine, and also forming of conciliarity and statehood, declaration of independence of Ukraine;

22) is provided by interaction of public authorities, local government bodies, companies, organizations and organizations for implementation of search, accounting, the device and preserving military burials and establishment of names of unknown soldiers who died during participation in fighting in the territory of Ukraine and other states;

Creates 23) and keeps the register of military burials, monuments and memorial boards of the died (died) veterans;

24) takes part in the organization of the edition of books, other printing editions connected with perpetuating of memory of defenders of the Fatherland, participants of fight for independence of Ukraine in the 20th century, memoirs, art and audiovisual works, creation of the museums, memorials and exposures, carrying out scientific research and conferences, seminars, meetings at round table and other actions within competence;

25) will be organized by implementation of actions for forming of positive image of veterans, promoting of military history, establishing communication between veterans of different generations, coordinates activities of executive bodies and local government bodies for appropriate questions;

26) makes in accordance with the established procedure offers on rewarding of veterans with the state awards;

Creates 27) and provides forming and maintaining the Unified state register of veterans of war, provides personal data protection, received according to the legislation, information security with limited access, and also technical information security and control of their safety, provides and coordinates data exchange between the existing state registers, information and analytical systems, and also between suppliers of privileges and services;

Creates 28) and provides functioning of information and analytical system of accounting for administration of needs of veterans (personal electronic office of the veteran);

29) is provided by accomplishment of the international obligations of Ukraine by executive bodies on implementation of the Geneva conventions of August 12, 1949 on protection of the victims of war and other regulations of international humanitarian law, and also takes part in coordination mechanisms on their realization;

30) is coordinated by implementation of the actions for reorganization of the world directed to decrease in risk of origin or renewal of armed conflict by increase in the national capacity for settlement of armed conflicts, and also on determination of bases for peacekeeping and development, strengthening of stability of the accepting territorial communities, reintegration/integration of combatants (combatants) and internally displaced persons, their professional and social adaptation;

31) participates in strategic planning of rather economic recovery and development of the world in the territories which underwent to negative impact as a result of armed conflict and/or temporary occupation;

32) carries out monitoring and efficiency evaluation of actions for recovery and construction of the world in the territories which underwent to negative impact as a result of armed conflict and/or temporary occupation;

33) takes measures and will organize work on investment attraction, the credits and grants, including means of international financial institutions and the international technical assistance, for the purpose of preparation and accomplishment of the tasks determined Minveteranov and projects implementation on the questions which are within the competence Minveteranov;

34) prepares offers on implementation of delivery of the loads recognized as the humanitarian assistance, goods and services, in particular water - gazo-and electric utility services on temporarily occupied territories of Ukraine;

Collects 35) and analyzes information on need of implementation of actions for recovery of infrastructure facilities (transport, energy, housing-and-municipal, social, etc.) in the territories which underwent to negative impact as a result of armed conflict or temporary occupation;

36) develops offers on determination of the infrastructure facilities requiring first-priority recovery;

37) the SSU, the Ministry of Internal Affairs, Gosspetssvyaz, the National guard, State frontier service, Management of the state protection, National police, GSChS, prospecting and law enforcement agencies, military forming formed according to the laws of Ukraine concerning protection of the civilian population which lives along the line of demarcation in temporarily occupied territories of Ukraine interacts with the Ministry of Defence;

Collects 38) and analyzes information on need of provision of housing and the solution of other questions of social protection of internally displaced persons;

39) performs the measures and tasks directed to accomplishment of the state and regional programs of social and economic and cultural development, protection of constitutional rights and freedoms of citizens of Ukraine who by force left temporarily occupied territories of Ukraine;

40) is performed by interaction with authorized representative bodies of the Crimean Tatar people, non-governmental organizations of foreign states which represent the interests of the Crimean Tatars, the international non-governmental organizations, with mass media;

41) takes measures to protection of the rights and freedoms of persons which are violated as a result of armed conflict and/or temporary occupation of part of the territory of Ukraine;

42) is coordinated by implementation of measures for protection and providing the rights and freedoms of citizens of Ukraine who are imprisoned Ukraine, personal in temporarily occupied territories, or illegally keep or are condemned beyond its limits as a result of actions of illegal armed groups, occupational administration and/or authorities of the Russian Federation in connection with public or political work of such persons for the benefit of Ukraine;

43) performs collection and systematization of information on the facts of violation of the rights of citizens of Ukraine and faces imprisoned personal as a result of actions of illegal armed groups, occupational administration and/or authorities of the Russian Federation in temporarily occupied territories of Ukraine;

44) participates in the actions directed to protection of the state assets which are in temporarily occupied territories of Ukraine;

45) is performed by public-private partnership on the questions which are within the competence Minveteranov;

Collects 46) and analyzes information on need of implementation of the actions connected with reduction of damage to the surrounding environment in the territories which underwent to negative impact as a result of armed conflict and/or temporary occupation;

47) performs the measures directed to reduction of social, economic and ecological impact of explosive objects by life and activities of the population (antimine activities) and informing the population on danger of explosive objects;

48) takes part in creation of the Budget declaration, project development of the State program of economic and social development of Ukraine, the Program of activities of the Cabinet of Ministers of Ukraine taking into account features of their accomplishment in the territories which underwent to negative impact as a result of armed conflict and/or temporary occupation;

49) is provided together with MKMS by distribution of socially necessary information in Ukraine and beyond its limits on the questions which are within the competence Minveteranov;

50) acts in accordance with the established procedure as the customer of research works, within the powers provided by the law are promoted creation and implementation of modern information technologies in the field of competence by Minveteranov;

51) is performed by international cooperation, participates in preparation of international treaties of Ukraine, prepares offers concerning the conclusion, denouncements of such agreements, within the powers provided by the law signs the international agreements and provides accomplishment of obligations of Ukraine according to international treaties on the questions which are within the competence Minveteranov;

52) provides coordination of activities central and local executive bodies, local government bodies, the companies, organizations and the organizations for implementation of the international projects and programs within the powers provided by the law;

Performs 53) within the powers provided by the law, initiation, preparation and implementation of projects (programs) of the international technical and financial aid, in particular with the assistance of the governments of the states, the international organizations and foreign public associations, other subjects of public and private law;

Accepts 54) within the powers provided by the law, participation in implementation of actions for adaptation of the legislation to the legislation of the EU;

Informs 55) and makes explanations concerning realization of state policy on the questions which are within the competence Minveteranov;

56) is performed by consideration of addresses of citizens on the questions connected with activities Minveteranov, its territorial authorities, the companies, organizations and the organizations belonging to the sphere of its management and also concerning acts which are issued by it;

57) performs functions on management of objects of state-owned property which belong to the sphere of its management;

58) performs other powers determined by the law.

5. Minveteranov for the purpose of the organization of the activities:

Provides 1) within the powers provided by the law, implementation of actions for prevention of corruption and control of their realization in the device Minveteranov, its territorial authorities at the companies, in organizations and the organizations which belong to the sphere of its management;

2) selection of personnel in the device Minveteranov performs, its territorial authorities, on the companies, in the organizations and the organizations belonging to the sphere of its management Minveteranov, its territorial authorities will organize work on preparation, retraining and advanced training of workers of the device;

3) exercises control of activities of the companies, organizations and the organizations belonging to the management sphere Minveteranov;

4) Minveteranov, its territorial authorities, at the companies, in organizations and the organizations which belong to the sphere of its management will organize planned and financial work in the device, exercises control of use of financial and material resources, provides the organization and enhancement of procedure for conducting financial accounting;

5) Minveteranov and territorial authorities in mass media and on the official website provides illumination of information on activities;

Provides 6) within the powers provided by the law:

realization of state policy of rather state secret, information security with limited access, technical information security, and also Minveteranov exercises control of their preserving in the device;

task performance on mobilization preparation and mobilization readiness of the state;

involvement of citizens to participation in administration of state affairs, effective interaction with institutes of civil society, implementation of public control over activities Minveteranov, accounting of public opinion during forming and realization of state policy in the field of which is within the competence Minveteranov;

7) will be organized by record keeping and archive document storage according to statutory rules.

6. Minveteranov for accomplishment of the tasks assigned to it has the right:

1) to involve in accordance with the established procedure specialists central and local executive bodies, the companies, organizations and the organizations (in coordination with their heads), scientists, representatives of institutes of civil society (in consent) in consideration of the questions which are within its competence;

To receive 2) free of charge from the ministries, others central and local executive bodies, local government bodies necessary for accomplishment information, documents and materials of the tasks assigned to it, from bodies of statistics - statistical data;

3) to convene meetings, to form the commissions and working groups, to hold scientific conferences, seminars and other actions for the questions which are within its competence;

4) to use the corresponding information databases of state bodies, the state system of government communication and other technical means.

7. Minveteranov performs the powers directly and through the territorial authorities formed in accordance with the established procedure.

8. 8) employs and Minveteranov discharges from office according to the procedure, stipulated by the legislation about work, workers of the device, makes the decision concerning their encouragement, attraction to disciplinary responsibility;
