About organizational measures for implementation of Single electronic system of development and approval of drafts of regulatory legal acts

In pursuance of the Presidential decree of the Republic of Uzbekistan of August 8, 2018 No. UP-5505 "About Approval of the Concept of Enhancement of Rule-making Activities" the Ministry of Justice together with the Ministry of development of information technologies and communications of the Republic of Uzbekistan and Ediny integrator po sozdaniyu i podderzhke gosudarstvennykh informatsionnykh sistem-UZINFOCOM LLC (further - the Single integrator) it is created and since January 1, 2019 the Single electronic system of development and approval of drafts of regulatory legal acts is started in the test mode on the world information Internet as pilot functioning (further - Single electronic system).

The developed Single electronic system provides realization of the following priority tasks:

creation of possibility of simultaneous and operational mailing of drafts of regulatory legal acts for consideration, approval (vising) of use of the digital signature to all interested ministries, departments, executive bodies on places, including for carrying out their extensive public and professional discussion;

ensuring transparency of process of consideration and approval (vising) of drafts of regulatory legal acts by automatic recording of the performed actions, fixations of dates of transfer and acceptance;

confirmation of authenticity of the digital signature, including authenticity of visas and their relevance;

collection and storage of information on the carried-out actions in the course of consideration and approval (vising) of drafts of regulatory legal acts, offers and notes of the interested ministries, departments, executive bodies on places according to drafts of regulatory legal acts;

maintaining the single electronic base of drafts of regulatory legal acts providing including information on process of development and the interested ministries, departments, executive bodies on places, approval (vising) of which was performed by means of Single electronic system, and also use of single electronic base when forming information and analytical and statistical data;

management, monitoring and control in real time of process of development and approval (vising) of the interested ministries, departments, executive bodies on places of drafts of regulatory legal acts;

essential saving of time and manpower in the course of development and approval (vising) of the interested ministries, departments, executive bodies on places of drafts of regulatory legal acts.

At the same time, despite realization of number of actions for implementation of Single electronic system, remain still insufficient accepted from the separate ministries, departments, executive bodies on places and other organizations of measure for providing the high-quality organization and full start of Single electronic system.

The fact-finding seminars held by the Ministry of Justice of the Republic of Uzbekistan for the purpose of training in use in Single electronic system not completely covered all ministries, departments, executive bodies on places, including with participation of the first heads of data of the organizations and their deputies. This circumstance showed that skills of work in Single electronic system of heads and executives in charge of the ministries, departments, executive bodies on places remain still at a low level, and heads of the specified organizations not in full are provided with the digital signature.

For the purpose of ensuring implementation and smooth functioning of Single electronic system, including in structural divisions of the office of the Cabinet of Ministers, ensuring necessary transparency and acceleration of process of development and approval (vising) of drafts of the regulatory legal acts Cabinet of Ministers decides:

1. Take into consideration that according to requirements of the Law of the Republic of Uzbekistan "About the digital signature" approval (vising) of drafts of regulatory legal acts in electronic form in Single electronic system is performed by the digital signature which certificate is issued in accordance with the established procedure by Scientific information center of new technologies under the State Tax Committee of the Republic of Uzbekistan.

2. Establish procedure according to which:

from May 1 to July 1, 2019 - pilot functioning of Single electronic system during which development and approval (vising) by the interested ministries, departments, executive bodies on places of drafts of the laws of the Republic of Uzbekistan, acts of the President of the Republic of Uzbekistan and the Government of the Republic of Uzbekistan, and also their entering into the Cabinet of Ministers is performed in paper form in accordance with the established procedure or in electronic form by means of Single electronic system is entered;

from July 1 to October 1, 2019 - pilot functioning of Single electronic system in the office of the Cabinet of Ministers during which developed and approved (vised) the interested ministries, departments, executive bodies on places drafts of the laws of the Republic of Uzbekistan, acts of the President of the Republic of Uzbekistan and the Government of the Republic of Uzbekistan are entered into the Cabinet of Ministers in accordance with the established procedure mainly in electronic form by means of Single electronic system is entered;

since October 1, 2019 and in subsequent period - entering of the developed and approved by the interested ministries, departments, executive bodies on places for review and further adoption of drafts of the laws of the Republic of Uzbekistan, acts of the President of the Republic of Uzbekistan and the Government of the Republic of Uzbekistan into the Cabinet of Ministers and Administration of the President of the Republic of Uzbekistan is performed exclusively in electronic form by means of Single electronic system.

Recommend to the state bodies and other organizations which are not entering into structure of the Government, implement in rule-making activities the procedure for development, approval (vising) of the interested ministries, departments, executive bodies established by this resolution on places and introduction of drafts of the laws of the Republic of Uzbekistan, acts of the President of the Republic of Uzbekistan and the Government of the Republic of Uzbekistan.

3. Form permanent Coordination panel on ensuring effective and smooth functioning of Single electronic system of development and approval of drafts of regulatory legal acts in structure according to appendix No. 1.

4. Determine the main objectives and activities of the Coordination panel (Davletov):

taking measures to operational connection to Single electronic system of all ministries, departments, executive bodies on places for timely implementation of procedure for development, approval (vising) and introduction of drafts of the laws of the Republic of Uzbekistan, acts of the President of the Republic of Uzbekistan and the Government of the Republic of Uzbekistan by means of Single electronic system;

carrying out on system basis of fact-finding seminars on explanation of essence and operating procedure by means of Single electronic system for employees of state bodies and the organizations;

preparation and introduction of suggestions for improvement of the legislation regulating questions of development and approval (vising) of drafts of regulatory legal acts by means of Single electronic system;

implementation of permanent monitoring of the course of development and approval (vising) by the interested ministries, departments, executive bodies on places, other state bodies and project organizations of the laws of the Republic of Uzbekistan, acts of the President of the Republic of Uzbekistan and the Government of the Republic of Uzbekistan by means of Single electronic system;
