About modification and amendments in the resolution of Board of National Bank of the Republic of Kazakhstan of December 28, 2018 No. 313 "About approval of the list, forms and terms of representation by banks of the second level, the Development Bank of Kazakhstan joint-stock company and the organizations performing separate types of banking activities, the reporting under loans and contingent obligations and Rules of their representation"

For the purpose of enhancement of regulatory legal acts of the Republic of Kazakhstan the Board of National Bank of the Republic of Kazakhstan DECIDES:

1. Bring in the resolution of Board of National Bank of the Republic of Kazakhstan of December 28, 2018 No. 313 "About approval of the list, forms and terms of representation by banks of the second level, the Development Bank of Kazakhstan joint-stock company and the organizations performing separate types of banking activities, the reporting under loans and contingent obligations and Rules of their representation" (it is registered in the Register of state registration of regulatory legal acts at No. 18220, it is published on February 1, 2019 in Reference control bank of regulatory legal acts of the Republic of Kazakhstan) the following changes and amendment:

to state part one of item 4 in the following edition:

"4. The reporting under loans and contingent obligations under forms according to appendices 3, 5 and 7 to this resolution is submitted in National Bank of the Republic of Kazakhstan in electronic form in case of the change or data acquisition provided in the specified forms which happened in month under report to the twenty fifth (inclusive) the month following month under report.";

add with Item 4-1 of the following content:

"4-1. In case of identification of mistakes in the reporting under loans and contingent obligations provided to National Bank of the Republic of Kazakhstan during the period from July 1, 2019 to February 1, 2020 the banks of the second level, Development Bank of Kazakhstan joint-stock company, the mortgage organizations, the affiliated organizations of national managing holding in the field of agro-industrial complex having the license of authorized body for implementation of banking loan activities provide error correction by implementation of the following events in the specified sequence:

correct the found errors in information system of National Bank of the Republic of Kazakhstan intended for collection of the reporting under loans and contingent obligations in measure type by implementation of adjustment of data in the reporting provided to the period from July 1, 2019 to February 1, 2020;

send to National Bank of the Republic of Kazakhstan the written notice with indication of the description of the revealed mistakes in earlier provided reporting under loans and contingent obligations.";

to state part one of Item 10 in the following edition:

"10. This resolution becomes effective after ten calendar days after day of its first official publication, except for:

1) Item 4, which becomes effective since July 1, 2019 and is effective till January 1, 2021;

2) Item 5, which becomes effective since January 1, 2021.".

To state the report on the subject of credit history on form according to appendix 3 in edition according to appendix 1 to this resolution;

The report on the loan agreement (contingent obligation) on form according to appendix 5 to state in edition according to appendix 2 to this resolution;

To state the report on providing on form according to appendix 7 in edition according to appendix 3 to this resolution;

The report on servicing of loan (contingent obligation) on form according to appendix 9 to state in edition according to appendix 4 to this resolution.

2. To provide to department of statistics of the financial market in the procedure established by the legislation of the Republic of Kazakhstan:

1) together with Legal department state registration of this resolution in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this resolution on official Internet resource of National Bank of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this resolution submission to Legal department of data on execution of the actions provided by the subitem 2) of this Item and Item 3 of this resolution.

3. To department of external communications - the press service of National Bank of the Republic of Kazakhstan to provide within ten calendar days after state registration of this resolution the direction it to the copy on official publication in periodic printing editions.

4. To impose control of execution of this resolution on the vice-chairman of National Bank of the Republic of Kazakhstan Abylkasymova M. E.

5. This resolution becomes effective after ten calendar days after day of its first official publication.

Action of paragraphs two, third, fourth, fifth, sixth, seventh, tenth, twelfth, thirteenth, fourteenth and fifteenth Item 1 of this resolution extends to the legal relationship which arose since July 1, 2019.

Paragraphs the fourth, the fifth, sixth and seventh Item 1 of this resolution are effective till April 1, 2020.
