About approval of Single rules of protection of subsoil in case of development of fields of solid minerals, oil, gas, underground waters in the Republic of Kazakhstan

For the purpose of implementation of the Presidential decree of the Republic of Kazakhstan, the valid law, of January 27, 1996 the Government of the Republic of Kazakhstan decides N2828 "About Subsoil and Subsurface Use":

1. Approve the enclosed Single rules of protection of subsoil in case of development of fields of solid minerals, oils, gas, underground waters in the Republic of Kazakhstan.

2. To subsoil users in case of development of mineral deposits in the Republic of Kazakhstan to be guided by the called rules.

3. This resolution becomes effective from the date of signing.

The Single Rules of Protection of Subsoil (SRPS) in case of development of mineral deposits in the Republic of Kazakhstan

Introduction

Single rules of protection of subsoil in case of development of mineral deposits and conversion of mineral raw materials (further imenuyetsyapravit) are developed according to requirements of the Presidential decree of the Republic of Kazakhstan, the valid law, of 27.01.1996 N 2828, "About subsoil and subsurface use" and the Presidential decree of the Republic of Kazakhstan, the valid law, of 28.06.1995 N2350 "About oil" and others legislative, regulatory legal acts.

Rules contain complex of requirements for rational and complex use of subsoil and their protection at all stages of subsurface use.

The applied terms and determinations in Rules correspond accepted in the legislation on subsoil, and also in the existing cross-industry and industry normative and technical documents (provisions, instructions; methodical instructions) regulating development of mineral deposits.

Accomplishment of rules is obligatory, for all legal entities and physical persons irrespective of the patterns of ownership performing search and investigation, design, posting and operation of wells, conducting development, arrangement and construction of the accompanying trade constructions, preparation of technological liquids, power sources and dumping of waste.

Rules also do not cancel the requirement of the existing cross-industry and industry regulating documents in the field of protection of subsoil in that part which does not contradict these rules and the current legislation about subsoil.

Part I

1. These rules establish complex of requirements for rational and complex use of subsoil in case of development of fields of solid minerals and protection of subsoil.

2. Requirements for rational use and protection of subsoil in case of production of solid minerals by geological and technological and other nonconventional methods (underground lixiviation, underground smelting of sulfur, underground gasification of coals, etc.) shall be provided in the industry instructions approved by Committee of geology and protection of subsoil of the Ministry of Natural Resources and Environmental Protection of the Republic of Kazakhstan and emergency situations Agency of the Republic of Kazakhstan.

Permission to carrying out transactions on subsurface use is availability of the Act of registration of the Contract for subsurface use.

3. Development plans for mining operations develop the organizations in coordination with Committee of geology and protection of subsoil of the Ministry of Natural Resources and Environmental Protection of the Republic of Kazakhstan and emergency situations Agency of the Republic of Kazakhstan.

Development of systematic works - systematic, consecutive accomplishment of transactions on subsurface use according to the annual plan of mining operations constituted according to the project of development of mineral deposits with ensuring rational use of subsoil and safe operation.

Development plans for mining operations are developed for year and on perspective, according to the project and technical and economic indicators of the organizations.

The procedure for creation and approval of plans (projects) of development of mining operations and standard rates of losses and impoverishment is established by the methodical instructions approved by Committee of geology and protection of subsoil of the Ministry of Natural Resources and Environmental Protection in coordination with emergency situations Agency of the Republic of Kazakhstan. Plans (projects) of development of mining operations affirm the Department of Energy, the industry and trade of the Republic of Kazakhstan in coordination with Committee of geology and protection of subsoil of the Ministry of Natural Resources and Environmental Protection of the Republic of Kazakhstan.

Permission to building of the areas of bedding of minerals in locations of the underground constructions which are not connected with mining is issued according to the Provision approved by the Government of the Republic of Kazakhstan of 27.01.1997 to N109.

4. The instructive documents of the organizations regulating productive activity shall correspond to these rules.

5. The project of mining by the mining organization is developed based on the specification on designing where questions of rational, complex development of minerals and protection of subsoil shall be provided.

6. The project of mining on mining shall meet the requirements of the legislation on subsoil and subsurface use and these rules.

7. Shall be provided in the project of mining: placement of land constructions of the organizations; methods of opening and system of mining of minerals; the application of means of mechanization and automation of production processes providing the most complete, complex and ecologically reasonable extraction from subsoil and rational, effective use of balance sheet inventories of the main and together with them the lying minerals; and also preserving in subsoil or warehousing of off-balance inventories for their subsequent industrial development; rational use of drainage waters, the overburden and containing breeds, and also production wastes in case of development of mineral deposits and conversion of mineral raw materials; geological studying of subsoil (detailed and operational investigation), geological and surveying ensuring works; the measures ensuring safety of work of production personnel and the population, buildings and constructions, protection of subsoil, environment objects from harmful effects of the works connected with use of natural resources; measures for recultivation of the broken lands after working off; actions for safe engineering; estimates and calculations of payments for use of natural resources.

8. On development of large-scale deposits of minerals with the number of subsoil users two and more, the complex project of development and mining providing shall be developed: rational cut of the field on the mine (career) fields providing the most complete extraction from subsoil of inventories of minerals, complex use of inventories as the main, and in passing lying minerals and the components containing in them, and also the measures providing accounting and preserving in passing extracted and temporarily not used minerals.

9. Schemes of opening, methods and systems of development accepted in the project of mining shall be comprehensively proved by povariantny technical and economic calculations. In case of reasons for methods and systems of development in projects of development of fields shall be determined optimum parameters of technological schemes (extraction units), completeness and quality of extraction of minerals from subsoil, condition of technical safety of conducting mining works.

10. The opening options accepted in the project to implementation, methods and systems of development shall exclude the selective working off of the richest parts of the field, ore bodies and deposits leading to decline in quality of the remaining balance sheet field reserves owing to which the deposits of minerals which are in them can lose industrial value or be completely lost.

11. Projects of development on the fields which are in difficult mining-and-geological conditions shall contain the special Section providing the actions excluding or considerably reducing adverse effect of the complicating environment on rational, complex use of subsoil and at the same time providing safe conducting mining operations, protection of subsoil and the environment.

12. In projects of development of fields in case of underground method of production of stone construction materials, gypsum, limestone, stone and potassium salts target preparation of developments taking into account providing and the long-term safety for use for the purpose of which is not connected with mining shall be considered.

13. Projects of development of fields on mining are subject to state examination in:

The Ministry of Natural Resources and Environmental Protection of the Republic of Kazakhstan - in the field of environmental protection and protection of subsoil;

bodies of the Agency of the Republic of Kazakhstan for emergency situations - in the field of safe engineering.

Projects affirm the Department of Energy, the industry and trade of the Republic of Kazakhstan.

14. In case of establishment by State commission the optimal variant of development of the field with reflection of relevant requirements in the license to use subsoil shall be determined by inventories of the Ministry of Natural Resources and Environmental Protection of the Republic of Kazakhstan of universal purpose of complex mineral raw materials by the project of mining.

2. Planning and design of development of mining operations

15. Planning and design of development of mining operations in the course of mining of minerals shall be performed in strict accordance with the legislation on subsoil, the project of mining existing with regulatory legal acts and these rules, to provide the solution of all questions of technology of mining providing correctness of mining, rational, complex use and protection of subsoil.

16. Annual plans of development of mining operations shall provide:

the standard rates of losses and impoverishments calculated on each extraction unit;

application of the methods and systems of mining providing the most complete extraction of minerals from subsoil;

mining according to the operating standards;

compliance to the engineering design of the direction of the planned amount of mountain and preparatory, cut developments and overburden works for creation of inventories, opened, prepared and ready to dredging;

observance of ratio by quantity and quality of minerals in extraction units (the site, the block, the panel, the camera) and terms of their repayment according to the schedule;

measures for decrease in losses and impoverishment of minerals in case of production, to involvement in production if necessary earlier left in the subsoil preserved, lost in subsoil of off-balance inventories, to use jointly of the lying minerals and breeds of vskrysha, to warehousing of substandard mineral raw materials in special dumps, to implementation in production of progressive technology solutions, advanced methods and results of research, developmental works in the field of rational, complex use of minerals and protection of subsoil.

17. It is forbidden to provide in annual plans of development of mining operations:

leaving of balance sheet inventories of minerals at borders of career (mine) fields or in contours of repayable inventories which working off will be in the future impossible or complicated;

selective working off of the rich on content of useful component and the best sites of the field on technological effectiveness;

leaving on future periods of production of the beaten-off mineral in extraction units if it is not provided by technology of mining operations.

18. The local project on its working off shall be developed for each extraction unit. Basis for its development is the project of mining and development plans for mining operations. The project of working off of extraction unit is surely approved with territorial authorities of Committee of geology and protection of subsoil of the Ministry of Natural Resources and Environmental Protection of the Republic of Kazakhstan.

Extraction unit is understood as the smallest economically and technologically optimum site of the field with reliable calculation of initial inventories of ore (the block, the panel, lava, part of ledge etc.) which working off is performed by single system of development and the technological scheme of dredging, by which the most exact separate production accounting of ore weight by quantity and content of metal in it can be performed (useful component).

19. In the project on extraction unit shall be proved by technical and economic calculations:

optimum parameters of extraction unit, indicators of extraction of mineral from subsoil, change of quality of mineral in case of production;

the methods of determination and accounting of indicators of extraction of minerals providing necessary completeness, reliability and efficiency of establishment of the actual indicators of extraction.

3. Requirements of protection of subsoil in case of development of fields

20. The method and the scheme of opening and conducting mining works on fields or its part shall provide:

the maximum and economically reasonable extraction from subsoil of all minerals which are subject to development within mountain branch;

safety of conducting mining operations;

possibility of working off of the isolated ore bodies, layers and deposits having industrial value;

protection of the field from natural disasters and from other factors leading to complication of their working off, decrease in industrial value, quality and losses of minerals.

21. Opening, preparation of the field and mining works, including trial, shall be made in strict accordance with the project of development.

In case of change of mining-and-geological and mining conditions in the project shall be timely and the corresponding additions and changes are in accordance with the established procedure made.

22. The chosen methods, amounts and terms of carrying out overburden and preparatory and cut works shall provide the established quality of inventories, opened, prepared and ready to dredging.

23. In the course of mining shall be provided:

carrying out operational investigation and other geological works;

control of observance of the places of laying, the directions and parameters of excavations, safety tselik, technological schemes of driving provided by the project;

carrying out permanent observations of condition of the massif, geological and tectonic violations and other phenomena arising when mining.

24. When carrying out the opening and preparatory excavations with passing mining subsoil users shall: make separate dredging jointly of the lying raznosortny, affine minerals of different type; record them production and losses; provide separate warehousing and safety of the extracted minerals before consumption.

25. In the course of opening and mining (the mine field) spoil of the sites of bodies (layers, deposits) adjoining it with balance sheet and off-balance inventories of minerals is not allowed.

26. The quantity and quality of inventories of minerals, ready to dredging, standard rates of operational losses and impoverishment shall be determined by extraction units.

27. In the course of clearing dredging subsoil users shall:

conduct regular geological observations in clearing faces and provide the timely geological forecast for operational management with mining operations;

record production on each extraction unit;

not allow formation of temporarily inactive inventories, losses on contacts with the containing breeds and in low-power sites of bodies (deposits, layers);

develop and perform actions for non-admission of above-standard losses and impoverishment;

it is strict to observe compliance of the schedule and development plan for mining operations.

28. In case of production of clearing works it is forbidden:

start mining works before carrying out the preparatory and cut developments established by the project providing completeness of extraction of minerals;

the selective working off of rich or easily accessible sites of the field (layers, deposits) bringing or able to lead to spoil of the remained balance sheet inventories of minerals;

allow above-standard losses.

29. The measure definition of extraction of minerals from subsoil, losses and impoverishment shall be made on the basis of primary accounting separately on methods and systems of development, extraction units and according to requirements of methodical instructions for determination, accounting, regulation and economic evaluation of losses of the minerals in case of production approved with territorial authorities of Committee of geology and protection of subsoil of the Ministry of Natural Resources and Environmental Protection of the Republic of Kazakhstan.

30. Losses and impoverishment of minerals in case of production shall be determined direct, indirect and the combined methods.

Methods of determination of losses of minerals in case of production shall provide: determination of losses and impoverishment in case of engineering procedure of production by types and places of their education and with required accuracy; identification of above-standard losses and reasons of their education.

31. Above-standard losses and selective working off of richer or valuable minerals are determined as difference between the actual and normative values by extraction units. For above-standard losses and selective working off the penalties established by the state are applied.

32. Determination, accounting and assessment of reliability of indicators of completeness and quality of extraction of minerals in case of production of clearing works is performed by surveying and geological services. Responsibility for timeliness and reliability of accounting of indicators of extraction of minerals from subsoil in case of production is born by the subsoil user.

33. For increase in indicators of completeness and quality of extraction in case of production subsoil users shall perform constantly measures for enhancement of methods of additional exploration and operational investigation, control of determination of quality of minerals in subsoil and the extracted mineral raw materials, technology of mining; to implementation of the progressive mountain equipment; to dredging of inventories from safety, barrier and other ore tselik, need for which passed; to application of laying of the developed space for more complete working off of inventories of valuable minerals; to cleaning of the soil of developments from the beaten-off ore and ore trifle.

34. In case of development of fields both open, and underground by methods systematic observations of condition of excavations, slopes of ledges and dumps, потолочин, the soil and tselik for the purpose of timely identification in them of deformations, determinations of parameters and service life, minimizing of losses of minerals, and also without fail shall be made for safety of conducting mining operations.

35. In case of development of the fields lying in difficult mining-and-geological and other environment (dangerous on gas, the sudden emissions and mountain blows inclined to spontaneous ignition, readily soluble in water, located on the continental shelf, under reservoirs, in landslide and with the increased seismicity areas) the special events developed taking into account prevention of adverse effect of natural factors on rational, complex use of inventories of minerals and ensuring technical safety shall be provided.

4. Geological and surveying ensuring mining operations

36. Subsoil users shall:

perform additional exploration and operational investigation of mineral deposits, other geological works for the purpose of increase in reliability of determination of explored reserves, high-quality composition of ores, study of mining-and-geological and other conditions of their working off;

keep in full and at the high-quality level the established geological and surveying documentation;

perform surveying works for ensuring rational and complex use of fields, protection of subsoil, buildings and constructions, natural objects from adverse effect of mountain developments;

provide accounting of condition and movement of inventories, losses and impoverishment, and also in passing extracted minerals and production wastes containing useful components.

37. All geological works within the developed field shall be carried out according to the approved project, regulating and methodical documents of Committee of geology and protection of subsoil of the Ministry of Natural Resources and Environmental Protection of the Republic of Kazakhstan.

38. Additional exploration and operational investigation of fields or their certain sites are carried out by the subsoil user or the specialized organization for the geological task issued by the subsoil user.

39. Projects of additional exploration and operational exploration shall provide:

the expected stock gain of minerals;

refining of geological, technological features of the field or its certain sites and transfer of inventories in higher categories on degree of their study.

Under difficult mining-and-geological conditions of mining or its sites by projects on additional exploration and operational investigation carrying out special researches for development of recommendations about ensuring protection of subsoil and safe operation shall be provided.

Projects on additional exploration and operational investigation shall provide the maximum use of capital, preparatory and cut developments of boreholes for the purposes of additional exploration and operational exploration and, in turn, prospecting excavations shall be used as much as possible for operational works.

40. All prospecting excavations and boreholes are subject to geological documentation.

41. Working geological documentation is replenished in process of accumulating of the actual material, but at least once a month. Summary geological documentation is replenished quarterly, lagging is not allowed.

42. Surveying works shall be carried out according to requirements of the Instruction of the organizations for production of surveying works and other regulating documents, and also legislations on subsoil and subsurface use and these rules.

The surveying works requiring application of special techniques and technical means and tools shall be carried out by the specialized organizations for the contract with the subsoil user.
