About modification of the order of the Government of the Kyrgyz Republic "About Rules of payment by Social fund of the Kyrgyz Republic of means of pension accruals of the State accumulation pension fund" of October 24, 2012 No. 745

For the purpose of enhancement of payment mechanisms of means of pension accruals, according to articles 10 and 17   of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Bring in the order of the Government of the Kyrgyz Republic "About Rules of payment by Social fund of the Kyrgyz Republic of means of pension accruals of the State accumulation pension fund" of October 24, 2012 change No. 745 according to appendix to this resolution.

2. Recommend to State-owned Mortgage Company open joint stock company according to the legislation of the Kyrgyz Republic in the field of information of personal nature in case of the address of the insured person obtaining mortgage loan, receive addressed to Social fund of the Kyrgyz Republic the consent of the subject of personal data to transfer of its personal data to the third parties for payment of means of pension accruals (investment part of the state pension).

3. To social fund of the Kyrgyz Republic:

- together with the Ministry of Health of the Kyrgyz Republic and State-owned Mortgage Company open joint stock company (under approval) to take adequate measures on implementation of this resolution;

- bring the decisions into accord with this resolution;

- sign the agreement on cooperation with commercial banks, intended to participate in implementation of measures, following from this resolution.

4. To impose control of execution of this resolution on department of social development of Government office of the Kyrgyz Republic.

5. This resolution becomes effective after fifteen days from the date of official publication.

Appendix

Changes in the order of the Government of the Kyrgyz Republic "About Rules of payment by Social fund of the Kyrgyz Republic of means of pension accruals of the State accumulation pension fund" of October 24, 2012 No. 745

In Rules of payment by Social fund of the Kyrgyz Republic of means of the pension accruals of the State accumulation pension fund approved  by the order of the Government of the Kyrgyz Republic of October 24, 2012 No. 745:

- add Item 1 with subitems 6 and 7 of the following content:

"6) once to persons obtaining mortgage loan in the presence of the pension accruals considered in accumulated portion of the personal insurance account in the amount is at least pyatist of settlement indicators, on condition of lack of own housing;

7) once to persons having serious illness according to the List of the serious illness granting the right to early receipt of means of pension accruals (investment part of the state pension) (further - the List of diseases), specified in appendix 4 to these rules in the presence of the pension accruals considered in accumulated portion of the personal insurance account.";

- add Item 3 with paragraphs the seventh and eighth the following content:

"-to persons obtaining mortgage loan whose amount of pension accruals by the time of the address constitutes at least pyatist of settlement indicators;

- to persons having serious illness according to the List of diseases specified in appendix 4 to these rules in the presence of the pension accruals considered in accumulated portion of the personal insurance account.";

- add item 4 with the paragraph the seventh the following content:

"The amount of lump sum payment for financing of the initial contribution is determined by mortgage loan by the applicant, but the pyatist of settlement indicators no more amount of means of the pension accruals (investment part of the state pension) considered in accumulated portion of the personal insurance account suffices.";
