Some questions of licensing of certain types of economic activity

According to part six of Article 8 and part five of article 10 of the Law of Ukraine "About licensing of certain types of economic activity" the Cabinet of Ministers of Ukraine decides:

1. Approve applied:

licensed conditions of carrying out economic activity in the field of development, production, realization, repair, upgrade and utilization of arms, military equipment, military weapon and ammunition to it;

Procedure for control of observance of licensed conditions of carrying out economic activity in the field of development, production, realization, repair, upgrade and utilization of arms, military equipment, military weapon and ammunition to it.

2. Bring in the list of documents which are enclosed to the application for licensing for separate type of economic activity, No. 756 approved by the resolution of the Cabinet of Ministers of Ukraine of July 4, 2001 (The Official Bulletin of Ukraine, 2001, No. 27, by Art. 1212; 2005, No. 25, the Art. 1433), change which is applied.

3. To the ministry of industrial policy to develop and approve standard form of the description of documents which are enclosed to the application for licensing for carrying out activities in the field of development, production, realization, repair, upgrade and utilization of arms, military equipment, military weapon and ammunition to it.

4. Determine that:

1) for receipt of the license for the right of carrying out activities in the field of development, production, realization, repair, upgrade and utilization of arms, military equipment, military weapon and ammunition to it, its copy or the duplicate, and also for renewal of the license subjects of managing submit to the Ministry of industrial policy the application on sample according to appendices 1-4;

2) operation of rooms, storages, warehouses and bases for storage of military firearms and ammunition to it is performed by subjects of managing which obtained the license according to the Regulations on authorization system approved by the resolution of the Cabinet of Ministers of Ukraine of October 12, 1992 No. 576;

Subjects of managing which obtained the license shall provide 3):

accounting and storage (safety) of materials, semifinished products, delivery products, experimental and research samples, the made products and fixed assets of production appointment;

proper protection of rooms, buildings and territories in which economic activity according to the obtained license is carried out.

5. Economic activity in the field of production of military firearms and ammunition to it is carried out according to the licensed conditions approved by this resolution and No. 576 "About approval of the Regulations on authorization system" is not regulated by the resolution of the Cabinet of Ministers of Ukraine of October 12, 1992.

Licensed conditions of carrying out economic activity in the field of development, production, realization, repair, upgrade and utilization of arms, military equipment, military weapon and ammunition to it

1. These licensed conditions establish organizational, qualification, production, regime and other requirements to carrying out economic activity in the field of development, production, realization, repair, upgrade and utilization of arms, military equipment, military weapon (except cold weapon) and ammunition to it.

2. The terms "licensee", "license", "licensing", "licensed conditions", "body of licensing" and "production" are used in these licensed conditions in the value given in the Law of Ukraine "About licensing of certain types of economic activity". Other terms are used in the following value:

ammunition - technical devices of single application (including their components and elements) which are arms type, intended for defeat of manpower of the opponent, destruction of its military equipment, destruction of strengthenings and constructions, accomplishment of other tasks (lighting or smoke of the area, scattering of propaganda literature, etc.);

military weapon - technical devices and means which equip Armed Forces, other military forming, law enforcement and prospecting agencies for ensuring their fighting and daily activities and which are intended for direct or using ammunition of defeat of manpower of the opponent, destruction of its military equipment and destruction of strengthenings and constructions;
