1. Bring in the order of the Minister of health and social development of the Republic of Kazakhstan of May 5, 2015 No. 320 "About approval of Rules of appointment and payment of the government address public assistance" (it is registered in the Register of state registration of regulatory legal acts for No. 11426, it is published on July 9, 2015 in information system of law of Ad_let) the following changes:

state Item 1 in the following edition:

"1. Approve the enclosed Rules of appointment and payment of the government address public assistance and provision of the guaranteed benefits package.".

The rules of appointment and payment of the government address public assistance approved by the specified order to be reworded as follows according to appendix to this order.

2. To provide to development department of policy of the public assistance of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order submission to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan Aukenov E. M.

4. This order becomes effective since January 1, 2020 and is subject to official publication.

Rules of appointment and payment of the government address public assistance and provision of the guaranteed benefits package

Chapter 1. General provisions

1. These rules of appointment and payment of the government address public assistance and provision of the guaranteed benefits package (further - Rules) are developed according to item 4 of article 7 of the Law of the Republic of Kazakhstan of July 17, 2001 "About the government address public assistance" (further - the Law) and determine procedure for appointment and payment of the government address public assistance of provision of the guaranteed benefits package.

2. In these rules the following basic concepts are used:

1) the assistant - the employee of Jobcenter of the population performing functions on rendering assistance to the consultant for social work and the akim, the settlement, the village, the rural district in carrying out consultation, interview, and also monitoring of accomplishment of obligations under the social contract;

2) authorized organization for payment of the address public assistance - the organizations having the license of authorized body on regulation and supervision of the financial market and the financial organizations on the corresponding types of banking activities, or territorial subdivisions of Kazpochta joint-stock company;

3) measures of social adaptation - the complex of actions including the measures of social resettlement of disabled people determined by article 21 of the Law of the Republic of Kazakhstan of April 13, 2005 "About social protection of disabled people in the Republic of Kazakhstan" the special social services rendered to persons which are in difficult life situation according to the Law of the Republic of Kazakhstan of December 29, 2008 "About special social services" and also other measures state the supports given according to the procedure, stipulated by the legislation the Republic of Kazakhstan;

4) social disadaptation - violation of interaction of the personality with social environment;

5) social deprivation - restriction and (or) deprivation of possibility of independent satisfaction with person (family) of the basic vital needs";

6) the consultant for social work (further - the consultant) - the employee of Jobcenter of the population performing assistance in purpose of the address public assistance and exit of needy person (family) from the situation caused by stay it below the poverty line;

7) the social contract - the agreement determining the rights and obligations of the Parties on participation in active measures of assistance of employment between the citizen of the Republic of Kazakhstan or the oralman from among jobless, separate categories of the busy persons determined by the Government of the Republic of Kazakhstan and also other persons in the cases provided by the Law of the Republic of Kazakhstan "About employment of the population" (further - the Employment act of the population), and jobcenter of the population, and in the cases provided by the Employment act of the population with the physical persons and legal entities involved in the organization of active measures of assistance of employment and also about rendering the government address public assistance;

8) able-bodied person (the able-bodied family member) - person or the family member aged since sixteen years to age, stipulated in Item 1 article 11 of the Law of the Republic of Kazakhstan "About provision of pensions in the Republic of Kazakhstan", except for persons with disability of the first or second group and (or) persons having diseases in case of which the term of temporary disability can be established more than two months;

9) the average per capita income - the share of comprehensive income of family falling on each family member in month;

10) comprehensive income - the amount of the income types considered in case of purpose of the address public assistance;

11) the standard list of actions for assistance of employment and social adaptation (further - the Standard list) - the list of active measures of assistance of employment and social adaptation approved by the central executive body in the field of social protection of the population, and recommended for use in case of the conclusion of the social contract;

12) active measures of assistance of employment of the population - measure of social protection from unemployment and employment of the population, the state support of citizens of the Republic of Kazakhstan and oralmans from among jobless, separate categories of the busy persons determined by the Government of the Republic of Kazakhstan, and also other persons in the cases provided by the Employment act of the population performed according to the procedure, established by the legislation of the Republic of Kazakhstan on employment of the population;

13) the guaranteed benefits package - the help to the needy families having children aged from one up to eighteen years in the types and amounts determined by the Government of the Republic of Kazakhstan.

14) needy persons (families) are persons (family) having the average per capita income per month below the poverty line, established in areas, the cities of republican value, the capital;

15) the individual plan of the help to person (family) (further - the individual plan) - the actions plan on assistance of employment and (or) social adaptation constituted by jobcenter of the population together with person who addressed for rendering the address public assistance, and (or) members of his family;

16) authorized body - the local executive body of the city of republican value, the capital, area, city of regional value, the area in the city, the cities of district value performing purpose of the government address public assistance (further - authorized body);

17) the precinct election commission - the special commission created by the decision of akims of the corresponding administrative and territorial units for carrying out inspection of financial position of persons (families) which asked for the government address public assistance according to the Standard regulations on precinct election commissions approved by the order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of January 28, 2009 No. 29-p "About approval of the Standard regulations on precinct election commissions and also criteria of determination of needs in the government address public assistance by results of inspection of financial position of the applicant" (it is registered in the Register of state registration of regulatory legal acts No. 5562);

18) the district (city) commission on questions of employment of the population - the commission performing coordination of activities of the state bodies and other organizations located in the territory of the area (the city of regional value), akims of the cities of district value, villages, settlements, rural districts concerning implementation of measures of assistance of employment of the population and the public assistance according to the Standard regulations on the district (city) commission on questions of employment of the population approved by the order of the Minister of health and social development of the Republic of Kazakhstan of June 7, 2016 No. 482 "About approval of some standard documents" (it is registered in the Register of state registration of regulatory legal acts for No. 13867) (further - the order No. 482);

19) regional commission concerning employment of the population - the commission performing coordination of activities of the state bodies and other organizations located in the territory of the area (the city of republican value, the capital) for implementation of measures of assistance of employment of the population and the public assistance according to the Standard regulations on regional commission concerning employment of the population approved by the order No. 482;

20) jobcenter of the population (further - the Center) - the legal entity created by local executive body of the area, the cities of regional and republican value, the capital for the purpose of realization of active measures of assistance of employment, the organization of social protection from unemployment and other measures of assistance of employment.

Chapter 2. Procedure for purpose of the government address public assistance

3. The government address public assistance (further - the address public assistance) is provided to person or family with the average per capita income which is not exceeding the poverty line established in areas, the cities of republican value, the capital according to Item 1-2 of article 2 of the Law in the form of the unconditional or caused monetary assistance.

For purpose of the address public assistance the family composition is determined according to Item 1 of article 4 of the Law.

4. Person (family), applying for receipt of the address public assistance, for receipt of information on procedure for purpose of the address public assistance addresses to the Center for the residence, and in case of lack of the Center at the place of residence - to the akim of the settlement, village, rural district (further - the akim).

In the absence of registration in the place of permanent residence the residence is confirmed by registration in the place of temporary stay (accommodation) within six months preceding date of the request for purpose of the address public assistance within one settlement, except for:

1) emergency situations;

2) difficult life situation on the following bases:

the ill treatment which led to social disadaptation and social deprivation;

homelessness (persons of no fixed abode);

release from places of detention.

In the cases provided by subitems 1) and 2) of part two of this Item, the Center or the akim for the purpose of purpose of the address public assistance assists temporary registration of the applicant in the Center of social adaptation for persons which are not taking certain residence.

5. In the course of the address of person or family with it consultation during which to it is carried out:

1) information is provided:

about conditions of receipt of the unconditional and caused monetary assistance;

about conditions of participation in active measures of assistance of employment and (or) in programs of social adaptation;

about need of the conclusion of the social contract, obligations of the parties participating in the social contract, and conditions of termination of the social contract;
