According to Item 2 of article 32-2 of the Law of the Republic of Kazakhstan of April 13, 2005 "About social protection of disabled people in the Republic of Kazakhstan" I ORDER:

1. Approve the enclosed Rules of registration of suppliers on the portal of social services, and also removals from registration on the portal of social services.

2. To provide to development department of policy of social services of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan Aukenov E. M.

4. This order becomes effective since January 1, 2020 and is subject to official publication.

Rules of registration of suppliers on the portal of social services, and also removals from registration on the portal of social services

Chapter 1. General provisions

1. These rules of registration of suppliers on the portal of social services, and also removal from registration on the portal of social services (further - Rules) determine order of registration on the portal of social services and removals from registration of suppliers on the portal of social services.

2. In these rules the following concepts are used:

1) the portal of social services (further - the Portal) - the part of unified information system of the social and labor sphere representing the automated information system giving to disabled people opportunity of acquisition of sanatorium treatment, prosthetic and orthopedic help, technical supportive (compensatory) means, special vehicles (further - goods), and also social services of the individual assistant and specialist of sign language (further - services);

2) suppliers of goods and (or) services (further - the supplier) - the physical persons performing business activity and also the legal entities and their branches rendering services and (or) delivering goods.

Chapter 2. Order of registration of suppliers on the Portal

3. Registration of the supplier on the Portal of social services is carried out by legal entities according to business identification number (further - the BIN), physical persons according to individual identification number (further - IIN) with the certificate of the digital signature issued by accredited certification center of the Republic of Kazakhstan (further - the EDS).

4. The supplier on voluntary basis follows registration on the Portal in electronic form the link http://aleumet.egov.kz.

The supplier after authorization of the EDS on the homepage signs the agreement and passes into the Office of the Supplier module.

When signing the EDS by the supplier from information systems of state bodies through lock of "the electronic government" in the Office of the Supplier module the following data certified by the EDS arrive:

1) for legal entities and their branches:

full name of the organization;

surname, name and middle name (in the presence) head of the organization;

data on state registration of the property right and the right of lease to the real estate intended for realization and/or storage of goods;

information about founders;

data on the organization (in the presence);

2) for the physical persons performing business activity:

surname, name and middle name (in the presence) physical person;

data on state registration as the individual entrepreneur (in the presence).

5. The supplier fills the following fields:

1) price of goods and (or) service;

2) goods quantity in warehouse;

3) contact information (mobile phone, e-mail address, contact telephone number, website (in the presence) supplier;

4) addresses of object of implementation of activities;

5) the name of types of the delivered goods and the rendered services;

6) data on bank details.

6. On the Portal are registered suppliers who:

1) have no tax debt and debt on social assignments;

2) are not subject to insolvency proceeding or liquidation;

3) are not included in the register of unfair participants of public procurements according to the legislation on public procurements;

4) have the certificate of conformity by delivery of the goods which are subject to obligatory certification;

5) have the registration certificate by delivery of medical products;

6) provided the price of the goods and (or) services realized through the Portal of social services.

7. Supporting documents are provided in electronic form.

Submission of supporting documents is not required in case of confirmation of information containing in the specified documents, information systems of state bodies.

8. The supplier fills in at least one request for goods and (or) the service taking into account type of activity performed on the Portal. For each type of activity the separate requisition with the description of characteristics is provided.

Suppliers in the Office of the Supplier module fill in data on implementable goods and the rendered services.

9. The supplier submits the application for registration on the Portal which is created based on the data entered by the supplier and received from information systems of state bodies according to appendix 1 to these rules, the statement in electronic form is certified by the EDS of the supplier.

10. The supplier provides reliability and relevance of the submitted documents and the completed data.

11. In case of introduction of data by the supplier in the automated mode check on obligation of filling of fields is made and in case of successful passing of check preserving data is made.

12. For registration of suppliers on the Portal and approvals of requests for goods and (or) services by authorized body in the field of social protection of the population of local executive bodies of areas, cities of republican value, the capital in place of registration of the supplier the Commission is created (further - the Commission).

The commission consists of the odd number of members, from among members of the commission the commission chairman who directs activities of the commission, and in case of its absence the vice-chairman is by a majority vote elected.

Functions of the secretary of the commission are performed by the specialist of authorized body in the field of social protection of the population of local executive bodies of areas, cities of republican value, the capital who is not the member of the commission.

13. The secretary of the Commission within one working day from the date of receipt of data adopts to execution the statement and the request for goods and (or) services, sends the Commissions for consideration.

The commission within five working days from the date of receipt of documents of the Supplier performs check on compliance to the requirements specified in the subitem 2) of Item 5, in Item 6 of these rules.

14. Following the results of consideration the Commission within two working days makes the decision and signs the protocol.

The secretary of the Commission within one working day after signing of the protocol places it on the Portal.

The suppliers registered on the Portal automatic are brought in the register of suppliers and (or) the register of the specialists rendering services.

After decision the status of the statement approval is reflected in the Portal - "Is approved" in case of approval or refused" with indication of causes of failure cases:

1) discrepancies to the requirements imposed to the supplier specified in Item 6 of these rules;

2) discrepancies of number of the enclosed documents to the quantity specified by the supplier;

3) discrepancies of supporting documents to the names of documents specified by the supplier;

4) absence in the enclosed documents of the details established for them: the name and the address of the organization which issued the document, the authorized signature, date of issue of the document, number and series of the document (in the presence), document effective period (in the presence);

5) availability in supporting documents of indistinct and illegible records, explicit erasures, additions, the crossed-out words, not deciphered reducings, corrections, except for the corrections certified by the authorized signature and under seal (in the presence);

6) the specified data in the subitem 2) of Item 5 of these rules are doubtful;

7) inclusions of the supplier in the register of the suppliers removed from registration and (or) the register of the specialists removed from registration rendering services in the cases specified in the subitem 4) of Item 15.

Chapter 3. Procedure for removal from registration on the Portal

15. The supplier acts from registration on the Portal based on the decision of the Commission in cases:

1) filing of application about removal from registration on the Portal of social services in form according to appendix 2 to these rules;

2) terminations of activities or death of the supplier;

3) inclusions in the register of unfair participants of public procurements according to the legislation on public procurements;

4) non-executions and (or) improper execution of the obligations undertaken by the Supplier by means of the Portal.

16. The data specified in the subitem 2) of Item 15 of these rules arrive from information systems of state bodies.

17. The secretary of the Commission on weekly basis performs check regarding case availability, specified in the subitem 3) of Item 15 of these rules in information systems of state bodies.

18. In the case specified in the subitem 4) of Item 15 of these rules the disabled person no later than fourteen calendar days from the date of when he knew of the facts of violation by the supplier of the obligations, places the relevant information on the Portal:

1) non-execution of the order;

2) untimely execution of the order (the goods are delivered later by what 30 calendar days from the date of the order);

3) discrepancy of goods and/or services to the descriptions specified on the Portal;

4) the change in price of goods and/or services during action of the price declared on the Portal.

This information within ten working days from the date of placement by the disabled person is considered by the Commission which determines availability or lack of violations from the supplier owing to non-execution of undertaken obligations, according to the agreement.

19. The commission in the cases specified in Item 15 of these rules makes the decision on removal from registration of the supplier on the Portal and signs the protocol. The secretary of the Commission places the protocol on the Portal with indication of the reason of removal from registration of the supplier on the Portal. In case of removal from registration of the supplier on the Portal, its data are removed from the register of suppliers and (or) the register of the specialists rendering services and are introduced in the register of removed suppliers and (or) the register of the removed specialists rendering services.

20. According to Item 2 of article 32-2 of the Law of the Republic of Kazakhstan of April 13, 2005 "About social protection of disabled people in the Republic of Kazakhstan", in case of removal of the supplier from registration on the Portal of social services in the basis provided by the subitem 3) of Item 15 of these rules, the subsequent registration on the Portal of social services is possible after exception of information about him of the register of unfair participants of public procurements according to the legislation of the Republic of Kazakhstan on public procurements.
