About modification of the Regulations on the Highest qualification commission of notariate

The Cabinet of Ministers of Ukraine decides:

Bring in the Regulations on the highest qualification commission of notariate approved by the resolution of the Cabinet of Ministers of Ukraine of August 31, 2011 No. 923 (The Official Bulletin of Ukraine, 2011, No. 67, Art. 2584; 2013, No. 9, Art. 336; 2016, No. 91, Art. 2973; 2017, No. 100, the Art. 3069), changes which are applied.

Changes which are made to Regulations on the highest qualification commission of notariate

1. Add the Provision with Items 2-1 and 2-2 of the following content:

"2-1. The basic principles of work of the Commission are legality, objectivity, collective nature of decision making and their obligation.

2-2. Form of work of the Commission are meetings.".

2. In item 4:

The second words "the head territorial administrations of justice in the Autonomous Republic of Crimea, areas, Kiev and Sevastopol (further - head departments of justice)" shall be replaced with words 1) in the paragraph "territorial authorities of Ministry of Justice";

Word in paragraph four of "head departments of justice" shall be replaced with words 2) "territorial authorities of Ministry of Justice,".

3. State Items 5 and 6 in the following edition:

"5. Seven people delegated by Ministry of Justice from among notaries and/or representatives of Ministry of Justice, and seven notaries delegated by Notarial chamber of Ukraine are part of the Commission.

Members of the commission in case of execution of the powers are equal.

The notary can be part of the Commission provided that:

it has length of service the notary at least 12 years;
