About modification of some decisions of the Government of the Kyrgyz Republic

For the purpose of creating favorable conditions for development of trade and economic relations, ensuring increase in the export potential, accounting of goods within trade with state members of the Eurasian Economic Union when importing (import) to the Kyrgyz Republic, determinations of acceptance date to accounting, ensuring completeness of receipt of indirect taxes on import,    "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides traceabilities of goods and observance of the international treaties and acts constituting the right of the Eurasian Economic Union according to articles 10 and 17 of the constitutional Law of the Kyrgyz Republic:

1. Bring in the order of the Government of the Kyrgyz Republic "About measures for streamlining of functioning of the check points through frontier of the Kyrgyz Republic intended for the international automobile, air and railway service, and internal stationary posts on highways of the Kyrgyz Republic" of November 19, 2007 to No. 556 the following changes:

- state Item 31 in the following edition:

"31. Commodity importation on the territory of the Kyrgyz Republic is performed by the automotive vehicle of the importer/cargo carrier. When passing through road check-point on the Kyrgyz-Kazakhstan site of frontier the importer/cargo carrier represents to the official of authorized state body in the field of protection of Frontier of the Kyrgyz Republic shipping documents with appendix of the certificate of authorized tax authority of availability of tax registration.";

-  add Chapter 3 with Item 31-1 of the following content:

"31-1. The official of authorized state body in the field of protection of Frontier of the Kyrgyz Republic makes scanning of shipping documents, technical data sheet of the vehicle, the passport of importer/carrier, enters the scanned versions into information system and transfers information in real time to temporary/stationary Item.";

-  add Chapter 4 with Item 37-1 of the following content:

"37-1. The taxpayers performing import (import) of goods to the territory of the railway station "Maymak" shall make accounting and fixing of documents on the imported load in Item of accounting of goods of the railway station "Maymak". The railway carrier shall make actions for issue of loads to the taxpayer with the permission of tax authorities. The railway carrier bears responsibility for issue of load without the permission of tax authorities.";

- state Item 38 in the following edition:

"38. In case of establishment of the facts:

- absence at importer/carrier of the international way bill (CMR) or the corresponding accompanying waybill, the transit declaration, the certificate of tax registration with the mark "For the purposes of Commodity Import from State Members of EEU" or its copies confirmed by the importer's seal and also the documents specified in Item 6 of this Procedure;

- absence in information system of Tax Service of the accompanying waybill on the fact of crossing of border taking place in previous periods this vehicle without document creation on summary post (journey without stopping) which comes to light by reconciliation with data of the automated control of other authorized bodies;

- discrepancies of the provided shipping document to the data (the scanned version) which arrived from authorized state body in the field of protection of Frontier of the Kyrgyz Republic, and information obtained from Item of weight and dimensional control;

- discrepancies of indicators of the accompanying waybill to the actual indicators of the imported goods (load);

- lack of shipping documents at the importer and/or carrier of goods;
