About approval of Changes in Regulations on the consolidated supervision of activities of non-bank financial groups in which preferential activities are performed by person who obtained the license for implementation of professional activity in the stock market

According to Items 37-4, 37-5 of Article 7, to Items 2, of the 13th article 8 of the Law of Ukraine "About state regulation of the security market in Ukraine" the National commission on securities and the stock market SOLVED:

1. In heading and Item 1 of the decision of the National commission on securities and the stock market of March 26, 2013 No. 431 "About approval of the Regulations on the consolidated supervision of activities of non-bank financial groups in which preferential activities are performed by person who obtained the license for implementation of professional activity in the stock market", registered in the Ministry of Justice of Ukraine on April 16, 2013 for No. 618/23150 (with changes), words "person who obtained the license for implementation of professional activity in the stock market" shall be replaced with words "financial institutions, supervision of which is exercised by the National commission on securities and the stock market".

2. Approve Changes in Regulations on the consolidated supervision of activities of non-bank financial groups in which preferential activities are performed by person who obtained the license for the implementation of professional activity in the stock market approved by the decision of the National commission on securities and the stock market of March 26, 2013 No. 431, registered in the Ministry of Justice of Ukraine on April 16, 2013 for No. 618/23150 (with changes) which are applied.

3. To non-bank financial groups, supervision of which is exercised by the National commission on the securities and the stock market created before entry into force of this decision within 6 months from the date of entry into force of this decision to submit to the National commission on securities and the stock market documents according to Item 3 of the Changes approved by this decision.

4. To provide to management of methodology of corporate management and corporate finances (Peresunko D.):

submission of this decision on state registration in the Ministry of Justice of Ukraine;

promulgation of this decision on the official website of the National commission on securities and the stock market.

5. This decision becomes effective in two months after its official publication.

6. Control over the implementation of this decision to assign to the member of the National commission on securities and the stock market Tarabakin D.

Changes in Regulations on the consolidated supervision of activities of non-bank financial groups in which preferential activities are performed by person who obtained the license for implementation of professional activity in the stock market

1. In  word Provision heading "person who obtained the license for implementation of professional activity in the stock market" shall be replaced with words "financial institutions, supervision of which is exercised by the National commission on securities and the stock market".

2. In the Section I:

 Item 1 to state 1) in the following edition:

"1. This Provision establishes procedure for identification by the National commission on securities and the stock market (further - the Commission) non-bank financial groups in which preferential activities are performed by financial institutions, supervision of which is exercised by the Commission (further - non-bank financial group), recognitions of non-bank financial groups by the Commission, approvals by the Commission of the responsible person of non-bank financial group, derecognition of non-bank financial group, and also the requirement for regulation of activities of non-bank financial groups, activities risk minimizations, both their certain participants, and risks of groups, procedure for receipt of the consolidated statements of such groups.";
