About approval of Rules of rendering the state service "Issue of the Document on Conditions of Conversion of Goods on/out of Customs Area of the Eurasian Economic Union and Conversion of Goods for Internal Consumption in Easy, Mining and Metallurgical, Chemical, Woodworking Industries, and also Mechanical Engineering and Building Industry"

According to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" I ORDER:

1. Approve the enclosed Rules of rendering the state service "Issue of the Document on Conditions of Conversion of Goods on/out of Customs Area of the Eurasian Economic Union and Conversion of Goods for Internal Consumption in Easy, Mining and Metallurgical, Chemical, Woodworking Industries, and also Mechanical Engineering and Building Industry".

2. Recognize invalid some orders of the Minister of investments and development of the Republic of Kazakhstan and the Minister of the industry and infrastructure development of the Republic of Kazakhstan according to appendix 2 to this order.

3. To provide to committee of industrial development and industrial safety of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

4. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of rendering the state service "Issue of the Document on Conditions of Conversion of Goods on/out of Customs Area of the Eurasian Economic Union and Conversion of Goods for Internal Consumption in Easy, Mining and Metallurgical, Chemical, Woodworking Industries, and also Mechanical Engineering and Building Industry"

Chapter 1. General provisions

1. These rules of rendering the state service "Issue of the Document on Conditions of Conversion of Goods on/out of Customs Area of the Eurasian Economic Union and Conversion of Goods for Internal Consumption in Easy, Mining and Metallurgical, Chemical, Woodworking Industries, and also Mechanical Engineering and Building Industry" (further – Rules) are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further - the Law) and determine procedure for issue of the document on conditions of conversion of goods on/out of customs area of the Eurasian Economic Union and conversion of goods for internal consumption in easy, mining and metallurgical, chemical, woodworking industries, and also mechanical engineering and building industry.

2. "Issue of the document on conditions of conversion of goods on/out of customs area of the Eurasian Economic Union and conversion of goods for internal consumption in easy, mining and metallurgical, chemical, woodworking industries, and also mechanical engineering and building industry" is the state service (further – the state service) and it appears Committee of the industry of the Industry ministry and construction of the Republic of Kazakhstan (further – the service provider) according to these rules.

Chapter 2. Procedure for rendering the state service

3. For receipt of the state service physical persons and legal entities (further – uslugopoluchatel) send to the service provider by means of the web portal of "the electronic government" www.egov.kz (further – the portal) the list of documents necessary for rendering the state service which is given in the list of the main requirements to rendering the state service "Issue of the Document on Conditions of Conversion of Goods on/out of Customs Area of the Eurasian Economic Union and Conversion of Goods for Internal Consumption in Easy, Mining and Metallurgical, Chemical, Woodworking Industries, and also Mechanical Engineering and Building Industry" (further – the List of the main requirements to rendering the state service) according to appendix 1 to these rules.

When giving the uslugopoluchatel of all necessary documents by means of the portal – in "personal account" of uslugopoluchatel displays the status about acceptance of request for rendering the state service with indication of the date of receipt of result of the state service.

5. The employee of office of the service provider performs document registration, the main requirements to rendering the state service specified in Item 8 of the List, in day of their receipt and sends to the head of the service provider which appoints the executive in charge.

In case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan, reception of an application and issue of result of rendering the state service is performed the next working afternoon.

6. The executive in charge within 2 (two) working days checks completeness of the submitted documents, and in case of establishment of incompleteness of the submitted documents prepares motivated refusal in form, according to appendix 2 to these rules (further - Motivated refusal), and sends it to uslugopoluchatel through the portal in electronic form signed by the digital signature (further - the EDS) the head of the service provider or replacement his face, to personal account of uslugopoluchatel.

Data on the identity document, on state registration (re-registration) of the legal entity, the individual entrepreneur, the service provider receives from the corresponding state information systems through lock of "the electronic government".

7. In case of representation by uslugopoluchatel of complete document package, the executive in charge within 5 (five) working days checks the submitted documents necessary for receipt of the document on conversion conditions for compliance to Rules of filling and issue of the document on conditions of conversion of goods on/out of customs area of the Eurasian Economic Union and conversion of goods for internal consumption, entering of changes (amendments) into it, withdrawal (cancellation) and (or) renewal of its action, and also prolongation of term of conversion of goods and recognition of the waste formed as a result of transactions on conversion on customs area of the Eurasian Economic Union and conversion for internal consumption, unsuitable for further commercial use the approved order of the Government of the Republic of Kazakhstan of June 28, 2018 No. 392, and within 1 (one) working day draws up result of rendering the state service - the document on conditions of conversion of goods on/out of customs area of the Eurasian Economic Union and conversion for internal consumption easy, mining and metallurgical, chemical, woodworking industries, and also in mechanical engineering in forms according to appendices 3, of 4, 5 to these rules.

The bases for refusal in rendering the state service established by the legislation of the Republic of Kazakhstan are stated in Item 9 of the List of the main requirements to rendering the state service.

In case of representation uslugopoluchately incomplete document package or lack of the data necessary for rendering the state service according to Item 9 of the List of the main requirements to rendering the state service, the service provider in the terms specified in Item 3 of the List of the main requirements to rendering the state service notifies uslugopoluchatel on the provisional solution about refusal in rendering the state service, and also time and the place (method) of carrying out hearing for opportunity to express to uslugopoluchatel line item according to the provisional solution.

The notification on hearing goes to the e-mail address of uslugopoluchatel specified in the statement, at least in 3 (three) working days prior to completion of term of rendering the state service. Hearing is carried out no later than 2 (two) working days from the date of the notification.

By results of hearing the service provider issues the document on conditions of conversion of goods on/out of customs area of the Eurasian Economic Union and conversion for internal consumption easy, mining and metallurgical, chemical, woodworking industries, and also in mechanical engineering in form according to appendix 3 to these rules, or Motivated refusal in rendering the state service.

The result of rendering the state service goes and kept in "personal account" of the uslugopoluchatel in electronic form signed by the EDS of the head of the service provider or replacement his face.

8. The service provider provides entering of data on stage of rendering the state service into information system of monitoring of rendering the state services according to the procedure, established by authorized body in the field of informatization.

8-1. The service provider within three working days from approval date or change of the order, sends information on the made changes and (or) additions to the these rules determining procedure for rendering the state service in Single contact center.

Chapter 3. Procedure for appeal of decisions, actions (failure to act) of the service provider concerning rendering the state services

9. Consideration of the claim concerning rendering the state services is made by higher administrative authority, the official, authorized body by assessment and control of quality of rendering the state services (further – the body considering the claim).

The claim is submitted to the service provider and (or) the official whose decision, action (failure to act) are appealed.

The service provider, the official, whose decision, action (failure to act) are appealed, no later than 3 (three) working days from the date of receipt of the claim send it and administrative case to the body considering the claim.

At the same time the service provider, the official whose decision, action (failure to act) are appealed, does not send the claim to the body considering the claim if he within 3 (three) working days makes the favorable decision, will make the action which is completely meeting the requirements specified in the claim.

The claim of uslugopoluchatel which arrived to the service provider according to Item 2 of article 25 of the Law is subject to consideration within 5 (five) working days from the date of its registration.

The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is subject to consideration within 15 (fifteen) working days from the date of its registration.

10. If other is not provided by the laws of the Republic of Kazakhstan, appeal to the court is allowed after appeal in pre-judicial procedure according to Item 5 of Article 91 of the Administrative procedural Procedure Code of the Republic of Kazakhstan.

11. No. 266 is excluded according to the Order of the Minister of the industry and infrastructure development of the Republic of Kazakhstan of 19.04.2023

12. No. 91 is excluded according to the Order of the Minister of the industry and infrastructure development of the Republic of Kazakhstan of 21.02.2022

List of the main requirements to rendering the state service Name of the state service: "Issue of the document on conditions of conversion of goods on/out of customs area of the Eurasian Economic Union and conversion of goods for internal consumption in easy, mining and metallurgical, chemical, woodworking industries, and also mechanical engineering and building industry". Name of subspecies of the state service: 1. "Issue of the document on conditions of conversion of goods on customs area of the Eurasian Economic Union"; 2. 6	The amount of the payment levied from uslugopoluchatel when rendering the state service and methods of its collection in cases, stipulated by the legislation the Republic of Kazakhstan	On all subspecies of the state service: free of charge
7	Working schedule of the service provider and subjects of information	1) the service provider – Monday through Friday, according to the established working schedule from 9:00 till 18:30 o'clock, except for days off and holidays, according to the Labor code of the Republic of Kazakhstan (further – the Code) with lunch break from 13:00 to 14:30 o'clock. 2) the portal – round the clock, except for technical breaks in connection with carrying out repair work (in case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the Code, reception of applications and issue of results of rendering the state service is performed the next working afternoon). Addresses of places of rendering the state service are placed on: 1) the service provider - www.comprom.gov.kz, the Section "State Services"; 2) portal.
8	The list of the documents and data requested at uslugopoluchatel for rendering the state service	1. Issue of the document on conditions of conversion of goods on customs area of the Eurasian Economic Union: 1) the application form which is filled in in form according to appendix 1 to this List of the main requirements to rendering the state service, in electronic form, the uslugopoluchatel certified by the EDS (according to article 248 of the Code about Customs regulation in the Republic of Kazakhstan); 2) the electronic document (documents) or the electronic copy of the document (documents) confirming (confirming) rights of possession, uses and (or) orders of goods, appendices and (or) amendments to it (to them) containing data on transactions of conversion of the goods (based on engineering procedure), methods of their making, methods of identification of the goods placed under customs procedure in conversion products, waste and remaining balance, and also terms of conversion of goods (according to article 248 of the Code about Customs regulation in the Republic of Kazakhstan); 3) the electronic document (documents) or the electronic copy of the document (documents) confirming the name and classification of foreign goods and (or) goods of the Eurasian Economic Union and products of their conversion according to the Commodity nomenclature of foreign economic activity of the Eurasian Economic Union and also their quantity and cost (according to article 248 of the Code about Customs regulation in the Republic of Kazakhstan); 4) the electronic document (documents) or the electronic copy of the document (documents), tables of calculation of regulations of exit of products of conversion in quantitative and (or) percentage expressions (according to Articles 248, 249 Codes about Customs regulation in the Republic of Kazakhstan). 2. Issue of the document on conditions of conversion of goods out of customs area of the Eurasian Economic Union: 1) the application form which is filled in in form according to appendix 2 to this List of the main requirements to rendering the state service, in electronic form, the uslugopoluchatel certified by the EDS (according to article 261 of the Code about Customs regulation in the Republic of Kazakhstan); 2) the electronic document (documents) or the electronic copy of the document (documents) confirming (confirming) rights of possession, uses and (or) orders of goods, appendices and (or) amendments to it (to them) containing data on transactions of conversion of the goods (based on engineering procedure), methods of their making, methods of identification of the goods placed under customs procedure in conversion products, waste and remaining balance, and also terms of conversion of goods (according to article 261 of the Code about Customs regulation in the Republic of Kazakhstan); 3) the electronic document (documents) or the electronic copy of the document (documents) confirming the name and classification of foreign goods and (or) goods of the Eurasian Economic Union and products of their conversion according to the Commodity nomenclature of foreign economic activity of the Eurasian Economic Union and also their quantity and cost (according to article 261 of the Code about Customs regulation in the Republic of Kazakhstan); 4) the electronic document (documents) or the electronic copy of the document (documents), tables of calculation of regulations of exit of products of conversion in quantitative and (or) percentage expressions (according to Articles 261, 262 Codes about Customs regulation in the Republic of Kazakhstan). 3. Issue of the document on conditions of conversion of goods for internal consumption: 1) the application form which is filled in in form according to appendix 3 to this List of the main requirements to rendering the state service, in electronic form, the uslugopoluchatel certified by the EDS (according to article 273 of the Code about Customs regulation in the Republic of Kazakhstan); 2) the electronic document (documents) or the electronic copy of the document (documents) confirming (confirming) rights of possession, uses and (or) orders of goods, appendices and (or) amendments to it (to them) containing data on transactions of conversion of the goods (based on engineering procedure), methods of their making, methods of identification of the goods placed under customs procedure in conversion products, waste and remaining balance, and also terms of conversion of goods (according to article 273 of the Code about Customs regulation in the Republic of Kazakhstan); 3) the electronic document (documents) or the electronic copy of the document (documents) confirming the name and classification of foreign goods and (or) goods of the Eurasian Economic Union and products of their conversion according to the Commodity nomenclature of foreign economic activity of the Eurasian Economic Union and also their quantity and cost (according to article 273 of the Code about Customs regulation in the Republic of Kazakhstan); 4) the electronic document (documents) or the electronic copy of the document (documents), tables of calculation of regulations of exit of products of conversion in quantitative and (or) percentage expressions (according to Articles 273, 274 Codes about Customs regulation in the Republic of Kazakhstan). Data on the identity document, on state registration (re-registration) of the legal entity, the individual entrepreneur, the service provider receives from the corresponding state information systems through lock of "the electronic government".
9	The bases for refusal in rendering the state service established by the laws of the Republic of Kazakhstan	1) establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the document on the conversion conditions, and (or) these (data) containing in them; 2) discrepancy of the submitted documents and data necessary for receipt of the document on conversion conditions on compliance to Rules of filling and issue of the document on conditions of conversion of goods on/out of customs area of the Eurasian Economic Union and conversion of goods for internal consumption, entering of changes (amendments) into it, withdrawal (cancellation) and (or) renewal of its action, and also prolongation of term of conversion of goods and recognition of the waste formed as a result of transactions on conversion on customs area of the Eurasian Economic Union and conversion for internal consumption, unsuitable for further commercial use, approved by the order of the Government of the Republic of Kazakhstan of June 28, 2018 No. 392; 3) the introduction in legal force of the decision (the resolution, determination) the court prohibiting to the applicant to perform activities for conversion of goods; 4) lack of consent of the uslugopoluchatel provided according to article 8 of the Law of the Republic of Kazakhstan "About personal data and their protection" on access to personal data of limited access which are required for rendering the state service.
10	Other requirements taking into account features of rendering the state service including rendered electronically	Uslugopoluchatel has possibility of receipt of the state service electronically through the portal on condition of EDS availability.
