About measures for further enhancement of monitoring of the foreign trade transactions in the Republic of Uzbekistan

For the purpose of further enhancement of system of conducting monitoring of the foreign trade transactions in the Republic of Uzbekistan and increases in its efficiency, and also simplification of procedure for introduction of data on contracts in foreign trade and invoices in the Unified information system of the foreign trade transactions by business entities the Cabinet of Ministers DECIDES:

1. Establish procedure according to which business entities (except for registered in accordance with the established procedure as self-employed persons) by means of the Single portal of interactive state services of the Republic of Uzbekistan enter into the Single electronic information system of the foreign trade transactions (EEISVTO) of the data on contracts in foreign trade, acts and invoices electronically with use of the digital signature.

2. Approve Regulations on procedure for conducting monitoring and control of implementation of the foreign trade transactions according to appendix No. 1.

3. To the State Customs Committee of the Republic of Uzbekistan to make corresponding changes to EEISVTO proceeding from requirements of this resolution.

4. Make changes to some decisions of the Government of the Republic of Uzbekistan according to appendix No. 2.

5. Recognize invalid some decisions of the Government of the Republic of Uzbekistan according to appendix No. 3.

6. To the State Customs Committee and the State Tax Committee of the Republic of Uzbekistan together with other interested ministries and departments to bring the regulatory legal acts adopted by them into accord with this resolution in a month.

7. This resolution becomes effective after three months from the date of its official publication.

8. To impose control of execution of this resolution on the deputy prime minister concerning investments and foreign economic relations - the minister of investments and foreign trade S. U. Umurzakov, the chairman of the State Customs Committee of the Republic of Uzbekistan M. B. Azimov and the chairman of the State Tax Committee of the Republic of Uzbekistan Sh. D. Kudbiyev.

Regulations on procedure for conducting monitoring and control of implementation of the foreign trade transactions

Chapter 1. General provisions

1. This Provision determines procedure for monitoring and control of the foreign trade transactions in bodies of currency exchange control and banks of the Republic of Uzbekistan.

2. In this Provision the following basic concepts are used:

the barter contract - the agreement signed between the resident and the nonresident of the Republic of Uzbekistan who provides exchange of certain quantity of one or several types of goods (works, services) on others without cash settlement;

contracts in foreign trade - the export contract, the import contract, the barter contract, the centralized export contract, the centralized import contract, the import exchange (fair) contract, the export exchange (fair) contract, the export consignment contract, the export contract for the republic territories, contracts for conversion (in the territory of the republic), the contract for conversion (outside the republic), export agreements based on leasing, import agreements based on leasing, the contract for import, the contract for export, the contract of purchase, the contract of realization, the agreement on advertizing specified in this Item of the Provision;

commodity import - commodity importation on customs area of the Republic of Uzbekistan without obligation of their return export;

import of works (services) - accomplishment (rendering) of works (services) of foreign state by legal entity or physical person to business entity of the Republic of Uzbekistan, irrespective of the place of their accomplishment (rendering);

importers - legal entities, and also the physical persons performing business activity without formation of legal entity - the residents of the Republic of Uzbekistan which signed import contracts with nonresidents of the Republic of Uzbekistan for commodity import (works, services);

the import contract - the contract signed between the importer and the nonresident of the Republic of Uzbekistan on commodity import (works, services);

the import exchange (fair) contract - the contract signed between the importer and the nonresident of the Republic of Uzbekistan on commodity import, works and services following the results of the exchange (fair) biddings;

the contract for conversion (outside the republic) - the contract signed between the importer and the nonresident of the Republic of Uzbekistan, providing conversion of goods of the Republic of Uzbekistan outside customs area and the subsequent return import of products of their conversion;

business entities are the residents of the Republic of Uzbekistan which signed contracts (invoices) and/or agreements specified in this Item of the Provision;

exporters - the legal, and also physical persons performing business activity without formation of legal entity - the residents of the Republic of Uzbekistan which signed export and barter contracts with nonresidents of the Republic of Uzbekistan on commodity export (works, services);

the export contract - the economic agreement signed between the resident and the nonresident of the Republic of Uzbekistan on commodity export (works, services), and also the contracts equated to export according to the legislation (except barter contracts);

the export exchange (fair) contract - the contract signed between the exporter and the nonresident of the Republic of Uzbekistan on commodity export (works, services) following the results of the exchange (fair) biddings;

the contract for conversion (in the territory of the republic) - the contract signed between the exporter and the nonresident of the Republic of Uzbekistan, providing conversion on customs area of goods and their export in product quality of conversion;

export of works (services) - accomplishment (rendering) of works (services) by the exporter to the nonresident of the Republic of Uzbekistan, irrespective of the place of their accomplishment (rendering);

commodity export - commodity exportation from customs area of the Republic of Uzbekistan without obligation of their return import if other is not stipulated by the legislation;

the centralized export contract - the contract signed on behalf of the Government or under its guarantees for export in necessary amounts of goods for needs of the state;

the centralized import contract - the contract signed on behalf of the Government or under its guarantees for import in necessary amounts of goods for needs of the state;

the export consignment contract - the contract signed between the consignor and the consignee for sale of goods through the consignee at the same time of right to use by the goods placed on the consignee's warehouse before its sale to the buyer belongs to the consignor;

the export contract for the republic territories - the direct contract signed in foreign currency between the nonresident of the Republic of Uzbekistan and the exporter on delivery of goods (works, services) made and used in the territory of the Republic of Uzbekistan;
