I ORDER:

1. Bring in the order of the Acting Minister of investments and development of the Republic of Kazakhstan of June 26, 2015 No. 727 "About approval of Rules of issue, storage, withdrawal of registration certificates and confirmations of accessory and reality of open key of the digital signature by root certification center of the Republic of Kazakhstan, certification center of state bodies and national certification center of the Republic of Kazakhstan (it is registered in the Register of state registration of regulatory legal acts for No. 12181, it is published on October 29, 2015 in information system of law of Ad_let) the following changes:

to state preamble of the specified order in the following edition:

"According to the subitem 12) of Item 1 of article 5 of the Law of the Republic of Kazakhstan of January 7, 2003 "About the electronic document and the digital signature" (further - the Law) and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" I ORDER:";

The rules of issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of open key of the digital signature by root certification center of the Republic of Kazakhstan approved by the specified order to be reworded as follows according to appendix 1 to this order;

The rules of issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of open key of the digital signature by certification center of state bodies of the Republic of Kazakhstan approved by the specified order to be reworded as follows according to appendix 2 to this order;

The rules of issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of open key of the digital signature by national certification center of the Republic of Kazakhstan approved by the specified order to be reworded as follows according to appendix 3 to this order.

2. To provide to committee of the state services of the Ministry of digital development, innovations and aerospace industry of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of digital development, innovations and the aerospace industry of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of open key of the digital signature by root certification center of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of open key of the digital signature by root certification center of the Republic of Kazakhstan (further - Rules) are developed according to the subitem 12) of Item 1 of article 5 of the Law of the Republic of Kazakhstan of January 7, 2003 "About the electronic document and the digital signature" (further - the Law), and determine procedure for issue, storage, withdrawal of registration certificates and confirmation of accessory and reality of open key of the digital signature by root certification center of the Republic of Kazakhstan.

2. In these rules the following basic concepts are used:

1) means of cryptographic information security (further - SKZI) - the software or the hardware and software realizing algorithms of cryptographic transformations, generation, forming, distribution or management of enciphering keys;

2) the list of the withdrawn registration certificates (further - SORS) - the part of the register of registration certificates containing data on registration certificates which are terminated their serial numbers, date and the reason of recall;

3) certification center - the legal entity certifying compliance of open key of the digital signature to the closed key of the digital signature, and also confirming reliability of the registration certificate;

4) root certification center of the Republic of Kazakhstan (further - KUTs RK) - the certification center performing confirmation of accessory and reality of open keys of the digital signature of certification centers;

5) the applicant - certification center, except for KUTs RK;

6) the user - the owner of the registration certificate of certification center except for KUTs RK;

7) the registration certificate - the paper document or the electronic document issued by the certification center for confirmation of conformity of the digital signature to requirements established by the Law;

8) withdrawal of the registration certificate - the procedure of recognition of the registration certificate invalid in KUTs RK;

9) the owner of the registration certificate - physical person or legal entity addressed to which the registration certificate legally owning the closed key corresponding to the open key specified in the registration certificate is granted;

10) the digital signature (further - the EDS) - set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content.

Chapter 2. Procedure for issue of the registration certificate to certification center

3. For issue of the registration certificate to certification center, the applicant represents to KUTs RK by means of mail or special mail service, or purposely the following documents:

1) the statement on issue of the registration certificate to certification center in form, according to appendix 1 to these rules;

2) copy of the certificate on accreditation of certification center;

3) the registration certificate of certification center in electronic form.

4. Issue of the registration certificate to certification center is performed by means of mail or special mail service, or purposely within fifteen working days, after submission of documents specified in Item 3 of these rules.
