About introduction of amendments to some resolutions of the Cabinet of Ministers of Ukraine in the field of state registration

The Cabinet of Ministers of Ukraine decides:

1. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

2. Determine that:

before implementation of information exchange of the State register of the corporeal rights to real estate with the Single state web portal of electronic services filing of applications in the field of state registration of the corporeal rights to real estate and their encumbrances electronically, access to results of provision of administrative services in the respective sphere, receipt of data from the State register of the corporeal rights to real estate is performed with use of the official website of Ministry of Justice;

use of the automated system of enforcement proceeding when carrying out state registration of encumbrances of the corporeal rights to real estate in connection with imposing by the state or private contractor of arrest on real estate in case of forced execution of decisions according to the law is performed after implementation of the corresponding technical capability.

Changes which are made to resolutions of the Cabinet of Ministers of Ukraine

1. According to the procedure of maintaining the State register of acts of civil status of citizens, No. 1064 approved by the resolution of the Cabinet of Ministers of Ukraine of August 22, 2007 (The Official Bulletin of Ukraine, 2007, No. 65, Art. 2516; 2011, No. 84, Art. 3078; 2015, No. 50, Art. 1601, No. 102, Art. 3525; 2016, No. 91, Art. 2973; 2020, No. 3, Art. 150):

1) in Item 2:

the fourth after words of "government" to add the paragraph with words ", local government bodies";

to add the paragraph of "government", the sixth after words, with words ", local government body";

The paragraph of the sixth of Item 19-1 after words of "government" to add 2) with words ", local government body".

2. According to the procedure of maintaining the State register of the corporeal rights to real estate, No. 1141 approved by the resolution of the Cabinet of Ministers of Ukraine of October 26, 2011 (The Official Bulletin of Ukraine, 2011, No. 86, Art. 3145; 2018, No. 52, Art. 1827; 2019, No. 57, Art. 1967):

1) in Item 1 of the word "and their encumbrances, about subjects and objects of such rights" shall be replaced with words ", encumbrances of such rights";

Shall be replaced with words 2) in the subitem 4 of Item 2 of the word "and State register of mortgages" ", the State register of mortgages and in the case provided by the law, data of the State register of lands";

3) in item 4:

in the paragraph the second shall be replaced with words the word "and" "and/or", and the word "removals" - the word "cancellations";

in paragraph three to replace the word "removals" with the word "cancellations";

in paragraph seven of the word "and their encumbrances, about objects and subjects of such rights" shall be replaced with words "on real estate, encumbrances of such rights";

the ninth to state the paragraph in the following edition:

"8) introduction of records about cancellation of state registration of the rights, cancellation of records of the State register of the rights, introduction of data on cancellation of decisions of the state registrar;";

the eleventh to state the paragraph in the following edition:

"10) information exchange with registers (inventories), and also with the automated information systems, the holder (the manager, the owner, the administrator) which state bodies are;";

the thirteenth to state the paragraph in the following edition:

"12) information exchange with the Single state web portal of electronic services or other information systems based on the agreements on rendering service service signed with the technical administrator of the State register of the rights for filing of applications in the field of state registration of the rights electronically, ensuring access to results of provision of administrative services in the field of state registration of the rights, receipt of data from the State register of the rights;";

after the paragraph of the thirteenth to add Item with the new paragraph of such content:

"13) forming of statistical data on the carried-out registration actions reflecting their quantity characteristic for certain period of time by such registration actions, and their promulgation in the official website of Ministry of Justice. The list of indicators and periods of time on which forming of statistical data is performed is determined by Ministry of Justice.".

With respect thereto the fourteenth and fifteenth to consider paragraphs respectively paragraphs the fifteenth and sixteenth;
