About approval of the Concept of the Automated information system MPower and Regulations on procedure for maintaining the Register of representative powers based on the digital signature

Based on Article 12 and Item c) parts (4) article 44 of the Law No. 91/2014 on the digital signature and the electronic document (The official monitor of the Republic of Moldova, 2014, Art. No. 174-177, 397), with subsequent changes, DECIDES: the Government

1. Found the Register of representative powers based on the digital signature created by the Automated information system MPower.

2. Approve:

1) the Concept of the Automated information system MPower, according to appendix No. 1;

2) Regulations on procedure for maintaining the Register of representative powers based on the digital signature, according to appendix No. 2.

3. Appoint public organization "Agency of Electronic Control" as the owner and the holder of the Register of representative powers based on the digital signature.

4. As the owner and the holder of the Register of representative powers based on the digital signature to provide to public organization "Agency of Electronic Control" implementation, functioning and development of the Automated information system MPower.

5. To the ministries, the State office and other central administrative authorities and organizational structures subordinated to the Government falling within the scope of their competence (subordinated administrative authorities, deconcentrated and subordinated public services, public organizations in which the ministry, the State office or other central administrative authority acts as the founder), to the public bodies / organizations and the autonomous state organizations subordinated or the founded Government and also to legal entities of private law who provide public services within the competences provided by the law:

1) to make offers to public organization "Agency of Electronic Control" concerning filling of the qualifier of the provided services for which representative powers based on the digital signature can be conferred;

To create 2), by means of the Automated information system MPower, certain types of the powers relating to the services rendered by them for which physical persons or legal entities of the public law or private law can confer representative powers;

3) to recognize and accept the valid representative powers conferred on the basis of types of the powers determined by means of the Automated information system MPower;

4) to confer representative powers by means of the Automated information system MPower which will be used in vendor interaction of services;

To review 5) in 6-month time from the date of publication of this resolution the normative and regulating basis connected with process of provision of services to physical persons or legal entities of the public law or private law to have opportunity to use the representative powers conferred by means of the Automated information system MPower;

6) to develop and approve within 6-month term from the date of filling of the qualifier of the submitted services for which representative powers based on the digital signature, after approval of public organization "Agency of Electronic Control" plans for integration of the existing electronic public services and the accompanying information systems with the Automated information system MPower can be created;

To integrate 7) within 12-month term from the date of filling with public organization "Agency of Electronic Control" of the qualifier of the submitted services for which representative powers based on the digital signature, by own financial means the available information systems with the Automated information system MPower, for the automated use of the representative powers conferred through it can be created;

8) in case of development of new information systems to provide their integration with the Automated information system MPower for the automated use of the powers determined through it.

6. Other public bodies and organizations, except noted in Item 5, including bodies of local public authority, and also physical persons or legal entities of private law can use the Automated information system MPower according to this resolution.

7. To public organization "Agency of Electronic Control":

1) to provide continuous development of the Automated information system MPower, including for the purpose of integration of new information systems;

2) for the purpose of promotion of electronic services to resolve, without collection of payments, to physical persons and legal entities of the public law or private law use of the Automated information system MPower;

3) to provide filling of the qualifier of the services provided by state bodies for which representative powers based on the digital signature, with their informing on ability to integrate the available information systems can be created;

4) to provide necessary tools for the automated access, provision and management of access to the Automated information system MPower through government service of authentication and access control (MPass) for all subjects of the Register;

5) to provide necessary tools for import of representative powers from registers and information systems of the public bodies and organizations specified in Item 5.

8. For the purpose of implementation of this resolution to the founder of public organization "Agency of Electronic Control" together with public organization "Agency of Electronic Control" annually to estimate the costs necessary for continuous administration and development of the Automated information system MPower and to make offers to the Ministry of Finance about request of financial resources, according to provisions of the Law on public finance and budget and tax responsibility No. 181/2014, for their inclusion in the law on the government budget for the corresponding year.

9. This resolution becomes effective from the date of publication.
