According to Rules of development and approval of administrative regulations of provision of the state services approved by the order of the Government of the Russian Federation of May 16, 2011 No. 373 (The Russian Federation Code, 2011, No. 22, Art. 3169; 2018; No. 46, the Art. 7050), Item 2 of the Regulations on licensing of activities for collection, transportation, processing, utilization, neutralization, placement of waste of the I-IV classes of danger approved by the order of the Government of the Russian Federation of October 3, 2015 No. 1062 (The Russian Federation Code, 2015, No. 41, Art. 5670; 2019, to No. 1, of the Art. 5), I order:
1. Approve the enclosed Administrative regulations of Federal Nature Management Supervision Service of provision of the state service in licensing of activities for collection, transportation, processing, utilization, neutralization, placement of waste of the I-IV classes of danger.
2. Declare invalid the order of Rosprirodnadzor of March 16, 2016 No. 132 "About approval of the document forms used by Federal Nature Management Supervision Service in the course of licensing of activities for collection, transportation, processing, utilization, neutralization, placement of waste of the I-IV classes of danger" (registration No. 42194) is registered by the Ministry of Justice of the Russian Federation on May 20, 2016.
3. This order becomes effective from the date of recognition No. 379 which voided the order of the Ministry of Natural Resources and Environmental Protection of the Russian Federation of July 1, 2016 "About approval of Administrative regulations of Federal Nature Management Supervision Service on provision of the state service in licensing of activities for collection, transportation, processing, utilization, neutralization, placement of waste of the I-IV classes of danger" (registration No. 43019) is registered by the Ministry of Justice of the Russian Federation on July 28, 2016.

1. The administrative regulations of Federal Nature Management Supervision Service of provision of the state service in licensing of activities for collection, transportation, processing, utilization, neutralization, placement of waste of the I-IV classes of danger (further - Regulations) determine terms and the sequence of ministerial procedures (actions) of Federal Nature Management Supervision Service (further - Rosprirodnadzor) and its territorial authorities, and also order of interaction between structural divisions of Rosprirodnadzor and territorial authorities of Rosprirodnadzor, their officials with applicants by provision of the state service.
Subject of regulation of Regulations are the relations arising between Rosprirodnadzor (territorial authorities of Rosprirodnadzor) and legal entities, individual entrepreneurs by provision of the state service in licensing of activities for collection, transportation, processing, utilization, neutralization, placement of waste of the I-IV classes of danger.
Action of these Regulations does not extend to questions of the treatment of the radioactive waste, biological waste and medical waste, substances destroying ozone layer (except as specified if such substances are part of products which lost the consumer properties) according to article 2 of the Federal Law of June 24, 1998 No. 89-FZ "About production wastes and consumption" (The Russian Federation Code, 1998, No. 26, Art. 3009; 2020, No. 15, Art. 2240).
2. Applicants on receipt of the license for activities for collection, transportation, processing, utilization, neutralization, placement of waste of the I-IV classes of danger are the legal entities and individual entrepreneurs (further - the license, the Applicants) planning to perform (license applicant) or performing activities (licensee) in the territory of the Russian Federation and in other territories over which the Russian Federation performs jurisdiction in accordance with the legislation of the Russian Federation and rules of international law.
Powers of the representatives acting on behalf of Applicants are confirmed by the power of attorney which is drawn up according to requirements of the legislation of the Russian Federation.
3. If receipt of the information from the register of licenses provided according to article 21 of the Federal Law of May 4, 2011 to No. 99-FZ "About licensing of separate types of activity" is result of provision of the state service (The Russian Federation Code, 2011, No. 19 Art. 2716; 2019, No. 23, the Art. 2907) (further - the Federal Law No. 99-FZ), the Applicant is physical (individual entrepreneur) or the legal entity.
4. Informing concerning provision of the state service is performed in case of the address of the Applicant for receipt of the state service, behind consultation concerning provision of the state service (personally, in writing, by e-mail, on telephone numbers for enquiries, by placement of information on the official site of Rosprirodnadzor (its territorial authorities) of https://www.rpn.gov.ru on the Internet (further - the Website), in the federal state information system "Single Portal of the State and Municipal Services (Functions)" www.gosuslugi.ru (further - the Single portal), at information stands in places of provision of the state service.
Informing is performed free of charge.
The information access about terms and procedure for provision of the state service is performed without accomplishment by the Applicant of any requirements, including without use of the software which installation on technical means of the Applicant requires the conclusion of license or other agreement with the owner of the software providing collection of payment, registration or authorization of the Applicant, or provision of personal data by it.
In case of the personal address of consultation are provided in reception hours of statements, in other cases - in working hours, including when reception of applications on provision of the state service is not performed.
For provision of the state service by the Applicant are specified the name - for legal entities, surname, name, middle name (in the presence) - for individual entrepreneurs, and also date of submission of documents for rendering the state service.
5. Information on the location (address), the working schedule, telephone numbers for enquiries, addresses of the official sites and e-mail of Rosprirodnadzor (its territorial authorities) is posted on the Website, in the federal state information system "Federal Register of the State and Municipal Services (Functions)" https://frgu.gosuslugi.ru (further - the Federal register), on the Single portal, and also at information stands in places of provision of the state services in Rosprirodnadzor (its territorial authorities).
6. The state service in licensing of activities for collection, transportation, processing, utilization, neutralization, placement of waste of the I-IV classes of danger (further - the state service).
7. The state service is provided by central office of Rosprirodnadzor and territorial authorities of Rosprirodnadzor.
By provision of the state service between central office of Rosprirodnadzor and its territorial authorities differentiation of powers is established.
8. The central office of Rosprirodnadzor performs provision of the state service in part:
collection, transportation, processing, utilization, neutralization of waste of the I-II classes of danger;
placements of waste of the I-IV class of danger;
collection, transportation, processing, utilization, neutralizations of waste of III-IV classes of danger in case of implementation of such activities in the territory of several subjects of the Russian Federation, power for provision of the state service in the territory of which perform different territorial authorities of Rosprirodnadzor.
9. Territorial authorities of Rosprirodnadzor provide the state service in licensing of activities for collection, transportation, processing, utilization, neutralization of waste of III-IV classes of danger in the territories of those subjects of the Russian Federation in which borders they perform the powers conferred to them.
The legal entities and individual entrepreneurs registered in appropriate subject of the Russian Federation submit applications for provision of licenses for implementation of types of activity which licensing according to differentiation of powers is referred to powers of territorial authorities, in the relevant territorial authority of Rosprirodnadzor.
10. If the Applicant plans implementation of the work types specified at the same time in Items 8 and 9 of Regulations, provision of the state service performs central office of Rosprirodnadzor.
11. Transfer to territorial authority of Rosprirodnadzor of powers on licensing of activities for collection, transportation, processing, utilization, neutralization of waste of III-IV classes of danger, in case of implementation of such activities in the territory of several subjects of the Russian Federation carried to powers of two and more territorial authorities is performed by the order of the Head (deputy manager) of Rosprirodnadzor prepared based on the motivated service record of the relevant structural division of central office of Rosprirodnadzor.
It is forbidden to demand from the Applicant of implementation of actions the, including approvals necessary for receipt of the state service and connected with the appeal to other state bodies and the organizations, except for receipts of the services included in the list of services which are necessary and obligatory for provision of the state services approved by the Government of the Russian Federation.
12. Results of provision of the state service are:
1) provision (renewal) of the license or issue of the notification on refusal in provision (renewal) of the license;
2) issue of the duplicate of the license or notification on refusal in issue of the duplicate of the license;
3) cancellation of the license;
4) provision of data from the register of licenses or the notification on refusal in provision of data from the register of licenses;
5) provision of the copy of the license or notification on refusal in provision of the copy of the license;
6) correction of the made typographical errors and (or) error messages in given as a result of provision of the state service documents or issue of the notification on refusal in correction of the made typographical errors and (or) error messages in given as a result of provision of the state service documents.
The result of provision of the state service in the choice of the Applicant can be provided in the document form on paper, and also in electronic form, signed by the authorized officer with use of the strengthened qualified digital signature, on the Single portal.
13. Provision of the license is drawn up in time, not exceeding 45 working days from the date of receipt in Rosprirodnadzor (territorial authority of Rosprirodnadzor) of properly issued application for provision of the license and in full the documents attached to it.
14. Renewal of the license is performed according to parts 10, of the 17th article 18 of the Federal Law No. 99-FZ:
in cases of reorganization of the legal entity in the form of transformation, merge, change of its name, the location address, and also in cases of change of the residence, name, surname and (if is available) middle name of the individual entrepreneur, details of the document proving his identity, the terminations of the licensed type of activity to one or several addresses of its implementation specified in the license, the terminations of accomplishment of one or several work types, components licensed type of activity, - in time, not exceeding 10 working days from the date of receipt in Rosprirodnadzor (territorial authority of Rosprirodnadzor) of properly issued application for renewal of the license and in full the documents attached to it;
in case of intention of the Applicant to perform the licensed type of activity to the address of the place of its implementation which is not specified in the license and (or) to execute the new work types constituting the licensed type of activity, - in time, not exceeding 30 working days from the date of receipt in Rosprirodnadzor (territorial authority of Rosprirodnadzor) of properly issued application for renewal of the license and in full the documents attached to it.
15. Decision making about cancellation of the license is performed in time, not exceeding 10 working days from the date of receipt in Rosprirodnadzor (territorial authority of Rosprirodnadzor) of the statement for the termination of the licensed type of activity.
16. Issue of the duplicate of the license is performed in time, not exceeding 3 working days from the date of obtaining by Rosprirodnadzor (territorial authority of Rosprirodnadzor) of the statement for provision of the duplicate of the license.
17. Provision of data on the specific license is performed in time, not exceeding 5 working days from the date of obtaining by Rosprirodnadzor (territorial authority of Rosprirodnadzor) of the statement for provision of data on the specific license.
18. Provision of the copy of the license is performed in time, not exceeding 3 working days from the date of obtaining by Rosprirodnadzor (territorial authority of Rosprirodnadzor) of the statement for provision of the copy of the license.
19. Return of documents by provision of the state service is performed in time, not exceeding 3 working days from the date of obtaining by Rosprirodnadzor (territorial authority of Rosprirodnadzor) of the statement for the termination of provision of the state service.
20. Decision making about correction of the made typographical errors and (or) error messages in given as a result of provision of the state service documents is performed in time, not exceeding 5 working days from the date of obtaining by Rosprirodnadzor (territorial authority of Rosprirodnadzor) of the statement for correction of the made typographical error and (or) mistake in the documents issued as a result of provision of the state service.
21. The result of provision of the state service goes (is issued) to the Applicant within 3 working days from the date of its signing by the Head of Rosprirodnadzor or the deputy manager of Rosprirodnadzor (the head of territorial authority of Rosprirodnadzor or the deputy manager of territorial authority of Rosprirodnadzor).
22. The current of term of provision of the state service stops if application for provision (renewal) of the license is issued with violation of the requirements established by part 1 of article 13 of the Federal Law No. 99-FZ and (or) the documents specified regarding 3rd article 13 of the Federal Law No. 99-FZ are provided not in full. Within 3 working days from the date of reception of an application about provision (renewal) of the license the licensing body hands to the license applicant (licensee) the notification on need of elimination in the 30-day time of the revealed violations and (or) submission of documents which are absent, or directs such notification the registered mail with the assurance of receipt or at the choice of the license applicant (licensee) in electronic form signed by the strengthened qualified digital signature of the licensing body, the method providing delivery confirmation of such notification and its obtaining by the license applicant (licensee).
23. In case of the receipt of the statement and documents provided by parts 8 and 9 of Article 13, parts 3, of the 7 and (or) 9 article 18 of the Federal Law No. 99-FZ, the body of the decision on provision (renewal) of the license licensing acceptance term or about refusal in its provision (renewal) it is estimated from the date of receipt in the licensing body of properly issued application for provision (renewal) of the license and in full the documents attached to it.
24. In case of non-presentation by the license applicant (licensee) in the 30-day time of properly issued application for provision (renewal) of the license and (or) in full the documents attached to it earlier submitted application for provision (renewal) of the license and documents attached to it are subject to return to the license applicant (licensee).
25. Placement of data from the register of licenses on the Website is performed within 10 working days from the date of acceptance by Rosprirodnadzor (territorial authority of Rosprirodnadzor) of the relevant decision.
26. The list of the regulatory legal acts regulating provision of the state service with indication of their details and sources of official publication is posted on the Website, in the Federal register and on the Single portal.
27. The documents necessary for provision of the state service, statements for provision of the license, renewal of the license, cancellation of the license, provision of the duplicate of the license, provision of data on the specific license, for correction of the made mistakes and (or) typographical errors in the documents issued as a result of provision of the state service and the documents (the copy of documents) enclosed to applications and data are (further - declarative documents).
28. For receipt of the license Applicant represents to Rosprirodnadzor (territorial authorities of Rosprirodnadzor) the statement for provision of the license (appendix 1 to Regulations) in which the following data are specified:
1) the complete and reduced (in the presence) names, including trade name (in the presence), and form of business of the legal entity, the place of its stay, the address of places of implementation of the licensed type of activity which the Applicant, the state registration number of record about creation of the legal entity and data of the document confirming the fact of entering of information about the legal entity into the Unified State Register of Legal Entities with indication of the location address of the body which performed state registration, and also phone numbers and (in the presence) e-mail addresses of the legal entity intends to perform;
