About approval of Changes in Rules of the retail market of electrical energy

According to the laws of Ukraine "About the market of electrical energy" and "About the National commission performing state regulation in spheres of power and utilities" the National commission performing state regulation in spheres of power and utilities DECIDES:

1. Approve Changes in the Rules of the retail market of electrical energy approved by the resolution of the National commission performing state regulation in spheres of power and utilities of March 14, 2018 No. 312, which are attached.

2. Declare invalid the resolution of the National commission performing state regulation in the field of power, of February 27, 2014 No. 170 "About approval of the Procedure for sale, accounting and calculations for the electrical energy made from energy of sunlight by power generation facilities (the generating installations) of private households", registered in the Ministry of Justice of Ukraine on May 26, 2014 for No. 539/25316 (with changes).

3. This resolution becomes effective from the date of, its promulgation following behind day on the official website of the National commission performing state regulation in spheres of power and utilities.

Changes in Rules of the retail market of electrical energy

I. In the Section I:

1. In Item 1.1.2 of Chapter 1.1:

 In paragraph three the word "distributions" to replace 1) with the word of "collection";

  The paragraph the fifteenth to state 2) in the following edition:

"the agreement on joint use of technological power networks - the arrangement of two parties which establishes content and regulates legal relationship between the operator of system and the main consumer whose networks are located in the territory of licensed activities of the operator of system during transportation of electrical energy by technological power networks of the main consumer (including power networks of producers, which reserve food is provided from networks of the operator of system, and consumers (the main consumers), which electroinstallations are attached to power networks of such producers, and their subconsumers) concluded in the standard form approved by the Regulator according to which payment of the cost of services in use of technological power networks of the main consumer determined by the technique approved by the Regulator is provided;";

3) in Item 1.2.3:

 state paragraph two in the following edition:

"The operator of system within the territory of implementation of licensed activities provides distribution of electrical energy by own networks and technological power networks of other owners which do not perform function of the operator of system (including power networks of producers which reserve food is provided from networks of the operator of system, and consumers (the main consumers) whose electroinstallations are attached to power networks of such producers, and their subconsumers), by the conclusion with these owners of agreements on joint use of technological power networks on the basis of the standard agreement (appendix 1 to these rules).";

5) the second offer of Item 1.2.5 to state in the following edition: "The operator of system signs the agreement of the electrosupplier on provision of services on distribution/transfer of electrical energy which contents is determined by the operator of system on the basis of the Standard agreement of the supplier of electricity about provision of services by distribution/transfer of electrical energy which is appendix 4 to these rules and consists with each electrosupplier who addresses the operator of system.";

  Item 1.2.13 to state 6) in the following edition:

"1.2.13. In case of provision of electroinstallation or its part provided that the transferred equipment provides complete functional cycle (производство/передачу/распределение/потребление to electrical energy), to other subject according to the lease agreement, leasing, access to infrastructure, etc. and obuslovlivaniye by such agreement of transfer of appropriate authority to this subject concerning settlement of contractual relations the relevant agreements according to requirements of these Rules shall be signed with participants of the retail market concerning power supply of the provided electroinstallation or its part between the specified subject and the corresponding participants of the retail market. If the provided equipment does not provide complete functional cycle (производство/передачу/распределение/потребление to electrical energy) or the specified powers are not conferred by the relevant agreements, the agreements provided by these rules are signed with the owner (asset holder) of electroinstallation, and compensation condition of expenses of the owner (asset holder) on power supply of the specified equipment shall be provided in the lease agreement, leasing, access to infrastructure and so forth.";

II. In the Section II:

1. In Chapter 2.1:

"2.1.4. In case of availability at the owner of networks (the consumer or the producer) on one platform of measurement of points of connection to different operators of system of distribution the service provision agreement on distribution of electrical energy is signed with that operator of system from whom it is more connection on degree of tension.

If tension steps on points of connection of the consumer from operators of system are equal, the agreement is signed with the operator of system from whom large volumes of electrical energy arrive.

In case of availability at this owner of networks (the consumer or the producer) of the subconsumer (subconsumers) between the operator of system who provides transportation of electrical energy it to the owner of networks and the owner of networks signs the agreement on joint use of technological power networks.

Transportation of the amounts of electric power which arrived to the owner of power networks and his subconsumers is paid for rate of the operator of system with which at the owner of networks the agreement on joint use of technological power networks, by the owner and his subconsumers respectively is signed.
