About modification and amendments in the order of the Minister of Defence of the Republic of Kazakhstan of January 24, 2017 No. 28 "About approval of Rules of military accounting of persons liable for call-up and recruits"

I ORDER:

1. Bring in the order of the Minister of Defence of the Republic of Kazakhstan of January 24, 2017 No. 28 "About approval of Rules of military accounting of persons liable for call-up and recruits" (it is registered in the Register of state registration of regulatory legal acts at No. 14881) the following changes and amendments:

in Rules of military accounting of the persons liable for call-up and recruits approved by the specified order:

"9. From January to March of the current year, citizens of the male Republic of Kazakhstan which in year of addition to the draft site performs seventeen years are subject to initial statement on military accounting in area MOVA (the city of regional value).

The subsequent statement on military accounting is performed according to Item 89 of these rules.

Removal of the citizen from military accounting in case of change of residence is performed area MOVA (the city of regional value) after statement of the citizen on military accounting at the new place of residence.

To the citizens who are subject to addition to draft sites medical examination according to the Rules of conducting military-medical examination and Regulations on the commissions of military-medical examination in Armed Forces of the Republic of Kazakhstan approved by the order of the Minister of Defence of the Republic of Kazakhstan of December 21, 2020 No. 716 is carried out (further – Rules of military-medical examination) (are registered in the Register of state registration of regulatory legal acts for No. 21869).";

The validity to military service is determined in case of their appearance in MOVA.

For transfer of the above-stated citizens of military age from military accounting of recruits on accounting of persons liable for call-up for the signature area MOVA (the city of regional value) the statement from the book of protocols of the district (city) draft commission, the book of protocols of the draft commission and accounting card of the recruit is submitted to the chief.

The personal record of the recruit with minutes abstract of the district (city) draft commission is submitted to records department of persons liable for call-up for the statement of the military ID.

About transfer of the recruit from military accounting of recruits on accounting of persons liable for call-up the corresponding mark in the accounting and alphabetic book is made.";

"82. The Ministry of Defence of the Republic of Kazakhstan through MOVA (further - the service provider) renders the following state services:

issue to recruits of certificates of addition to draft sites and duplicates of certificates;

issue of military IDs or their duplicates (temporary certificates instead of military IDs) to officers, sergeants, soldiers of inventory;

statement and removal from military accounting of persons liable for call-up and recruits;

issue of references to the citizens leaving the Republic of Kazakhstan on the permanent residence;

provision of data on confirmation of passing of military service.";

statement and removal from military accounting of persons liable for call-up and recruits in appendix 33 to these rules;

issue of references to the citizens leaving the Republic of Kazakhstan on the permanent residence in appendix 35 to these rules;

provision of data on confirmation of passing of military service in appendix 36 to these rules.

85. Data on identity documents, on the birth, on scrap, on the birth of children, on registration at the place of residence or the place of temporary stay of uslugopoluchatel, the employee of the State corporation the service provider receives from the corresponding state information systems through lock of "the electronic government".

In case of the address on the portal, except the listed documents the service provider in addition receives the digital photo of 30x40 mm in size in the form of the graphical file.";

"86-1. Service providers receive digital documents from service of digital documents through the realized integration on condition of the consent of the owner of the document provided by means of the "electronic government" of subscriber number of cellular communication of the user registered on the web portal by transfer of the one-time password or departure siding of the short text message as the answer to the notification of the web portal of "the electronic government".";

87, 88 and 89 to state Items in the following edition:

"87. For receipt of the state service "Issue to recruits of certificates of addition to draft sites and duplicates of certificates" uslugopoluchatel submit the application in form according to appendix 37 to these rules.

The term of rendering the state service constitutes 5 (five) working days.

The service provider in day of receipt of documents performs their acceptance, registration and transfer for execution to the executive in charge.

Consideration by the contractor of document package on compliance of the requirements established by these rules preparation of result of the state service for the signature to the head is performed within 3 working days.

The refusal in rendering the state service is performed, in cases:

establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them;

discrepancies of uslugopoluchatel and (or) the provided materials, supplied and the information necessary for rendering the state service, to requirements, the established these rules;

lack of entry in the book of protocols of the draft commission, in case of primary address of the uslugopoluchatel who did not pass addition in January – March in year of execution to it seventeen years;

lack of the resolution on imposing of administrative punishment on uslugopoluchatel for categories of citizens: when losing the certificate of addition; in case of spoil of the certificate of addition.

In cases of the motivated answer about refusal in rendering the state service in absence reason of the resolution on imposing of administrative punishment, the uslugopoluchatel needs to be in local body of military management for the place of military accounting for consideration of question of administrative prosecution.

88. For receipt of the state service "Issue of Military IDs or Their Duplicates (Temporary Certificates instead of Military IDs) to Officers, Sergeants, Soldiers of Inventory" uslugopoluchatel submit the application in form according to appendix 38 to these rules.

The term of rendering the state service constitutes:

in the cities of republican and regional values, the capital – 7 (seven) working days;

in areas – 5 (five) working days.

The service provider in day of receipt of documents performs their acceptance, registration and transfer for execution to the executive in charge.

Consideration by the contractor of document package on compliance of the requirements established by these rules preparation of result of the state service for the signature to the head is performed in 2 (two) working days prior to the expiration of rendering the state service.

Are result of rendering the state service issue of the military ID or their duplicate (the temporary certificate instead of the military ID) to officers, sergeants, soldiers of inventory, or the motivated answer about refusal in rendering the state service.

The refusal in rendering the state service is performed, in cases:

establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them;

discrepancies of uslugopoluchatel and (or) the provided materials, supplied and the information necessary for rendering the state service, to requirements, the established these rules;

lack of entry in the book of protocols of the draft commission for category of citizens: exempted from places of detention; not reached 27 years which are subject to transfer on military accounting of persons liable for call-up for health reasons; reached 27 years which did not pass military service in communication by provision of draft deferments; citizens of military age at whom one of relatives (the father, mother, the brother or the sister) died, died or became the disabled person of the first or second group on duty during passing of military service; having academic degree; priests of the registered religious associations;

lack of the resolution on imposing of administrative punishment on uslugopoluchatel for categories of citizens: when losing the military ID; in case of spoil of the military ID.
