About modification of the Labor code, the Land code, the Civil code, the Code of civil procedure, the Family code, the Criminal code, the Tax code, the Code of penal procedure, the Code about execution of punishments, the Electoral code, the Housing code, the Customs code, the Town-planning and construction code and the Migratory code of the Azerbaijan Republic

Being guided by Item 1 of part I of article 94 of the Constitution of the Azerbaijan Republic, in connection with execution of the Law of the Azerbaijan Republic "About the rights of persons with disability" Millie the Majlis of the Azerbaijan Republic decides:

Article 1

1.1. at the end of the Item "N" of part 1 of article 12 to replace point with semicolon and to add in this part with the Item "about" of the following content:

"o) providing according to the Law of the Azerbaijan Republic "About the rights of persons with disability" occupations of persons with disability labor activity on an equal basis with other persons.";

1.2. in the paragraph 3 parts 3 of Article 14 and the Item "about" part 2 of Article 38 of the word "disabled people or persons with limited opportunities of health aged to 18 years" shall be replaced with words "persons with disability, including with limited opportunities of health aged to 18 years";

1.3. under Article 16:

1.3.1. in part 1 to add with the fourth paragraph of the following content:

"The refusal in execution of an employment agreement with person with disability because of disability, promotion on work, the termination of the employment contract and transfer into other work (profession, position) without its consent, except as specified, when the condition his health interferes with accomplishment of the professional obligations by it or threatens health and safety of other persons, it is not allowed.";

1.3.2. in part 2 to "disabled people" shall be replaced with words the word to "persons with disability";

1.4. in the paragraph to "regulations" to add 5 parts 1 of article 54 after the word with words ", to standards of workplaces, and in relation to persons with disability established also according to the Law of the Azerbaijan Republic "About the rights of persons with disability";

1.5. in paragraph 2 of Article 66 of the word "become disabled people" shall be replaced with words "at which disability is established";

1.6. regarding 3rd Article 69 the word "pension" shall be replaced with words "retirement pension";

1.7. in the second offer of part "Note" of Article 74 of the word "group of disability of the corresponding degree" shall be replaced with words "disability degree"

1.8. in the paragraph "to persons who sustained labor injuries or occupational disease" shall be replaced with words 6 parts 2 of Article 78 of the word to "persons having disability as a result of production accident or occupational disease";

1.9. under Article 79:

1.9.1. in the paragraph shall be replaced with words 7 parts 1 of the word "disabled person of the I group" "with disability of the I degree";

1.9.2. add with part 3 following of content:

"3. Except as specified liquidations of the company, irrespective of term, termination by the employer of the employment contract signed with persons with disability which are on treatment in rehabilitation organizations and other subjects of rehabilitation and also with the worker specified in article 24.1 of the Law of the Azerbaijan Republic "About the rights of persons with disability" is not allowed.";

1.10. regarding the 2nd Article 91 of the word "disabled person of the 2nd group" shall be replaced with words "disability of the 2nd degree";

1.11. regarding 3rd Article 94 and the second offer of part 3 of article 232 after the word "disability" to add with the words "including";

1.12. regarding the 2nd Article 98 the word "Disabled person" shall be replaced with words "Faces with disability";

1.13. regarding the 2nd Article 119 to replace the word "groups" with the word "degrees", and words "to disabled people and" - words "to persons with disability, including";

1.14. in the Item "g" of part 1 of Article 130 to replace the word "groups" with the word "degrees", and the word to "disabled people", - words "to persons with disability, including";

1.15. to state the Item of part 4 of Article 131 in the following edition:

"g) persons with disability.";

1.16. 5 parts 3 of Article 133 to state the paragraph in the following edition:

"to persons with disability;".

3.3. in Article 1165.1 of the word "organizations for elderly," shall be replaced with words disabled people and children with limited opportunities of health "organizations of social servicing for aged, persons with disability, including children with limited opportunities of health aged to 18 years";

3.4. in Article 1181.1 of the word "houses for disabled people, children with limited opportunities of health, elderly" shall be replaced with words "organizations of social servicing for aged, persons with disability, including children with limited opportunities of health aged to 18 years";

Article 4

4.2. in Article 105.2 after the word "disability" to add with the words "including";

4.3. repeal Article 180.4.

7.1.1. in Article 102.2.4 the word of "disabled people" shall be replaced with words "persons with disability in communication";

7.1.2. in Article 102.3 of the word of "disabled people of the II group" shall be replaced with words "persons with disability of the II degree", the word of "disabled people" - words of "persons with disability in communication" and the word of "persons" - the word of "children";

7.1.3. in Article 102.4.4 of the word to "the disabled person of the I group" shall be replaced with words to "person with disability of the I degree";

7.2. in the first part of Article 106.2 of the word "Disabled People or Children with Limited Opportunities of Health Public" shall be replaced with words "Faces with disability non-governmental", words "disabled people and with limited opportunities of health to 18 years" - the words "with disability" and in part 2 of this Article of the word "disabled people or persons with limited opportunities of health to 18 years" - words "persons with disability, including children with limited opportunities of health to 18 years";

7.3. in Article 199.1 of the word "disabled people, children with limited opportunities of health public" shall be replaced with words "persons with disability non-governmental".

8.4. under Article 229:

8.4.1. in the name of Article 229 and Article 229.3 of the word "mute, deaf, blind" shall be replaced with words "with limited capabilities of sight, hearing and speech";

8.4.2. in Article 229.1 of the word "mute, deaf or blind" shall be replaced with words "with limited capabilities of sight, hearing and speech";

8.5. in Article 233.6 of the word "mute, deaf, blind" shall be replaced with words "with limited capabilities of sight, hearing and speech".
