About modification of the Procedure for providing the quality standards of electric utility service and provision of compensations to consumers for their non-compliance

According to the laws of Ukraine "About the market of electrical energy", "About the National commission performing state regulation in spheres of power and utilities" the National commission performing state regulation in spheres of power and utilities DECIDES:

1. Make changes to the Procedure for providing the quality standards of electric utility service and provision of compensations to consumers for their non-compliance approved by the resolution of the National commission performing state regulation in spheres of power and utilities of June 12, 2018 No. 375, having been reworded as follows it which is applied.

2. This resolution becomes effective from the date of, its promulgation following behind day on the official website of the National commission performing state regulation in spheres of power and utilities except the subitem 21 of Item 2.3 of Chapter 2 of the Procedure for providing the quality standards of electric utility service and provision of compensations to consumers for their non-compliance which becomes effective since July 1, 2021.

Procedure for providing the quality standards of electric utility service and provision of compensations to consumers for their non-compliance

1. General provisions

1.1. This Procedure determines the list of the general and guaranteed quality standards of electric utility service and governs the relations connected with electric utility service according to the general and guaranteed quality standards, consumer protection and provision by the electrosupplier or the operator of system of distribution (further - OSR), or the operator of system of transfer (further - SMALLPOX) compensations for non-compliance with the guaranteed electric utility service quality standards to consumers or customers (in case of non-compliance with the guaranteed quality standards during accession to power networks of the electroinstallations intended for consumption of electrical energy).

1.2. This Procedure is applied to subjects of managing which obtained the license for implementation of economic activity on delivery of electrical energy to the consumer, distributions of electrical energy or transfer of electrical energy.

1.3. In this Procedure terms are used in such values:

the guaranteed electric utility service quality standard - the minimum level of quality of provision of services of the operator of system or the supplier of electricity which shall be provided to the consumer in amount and the terms determined by the current legislation and for which non-compliance compensation is provided to the consumer;

date of non-compliance with the guaranteed electric utility service quality standard - the next day after the expiration of deadline of rendering service to the consumer (customer)/performance of works taking into account determined by this Procedure and the legislation of Ukraine of terms of their rendering / accomplishment;

the general quality standard of electric utility service - the quality level of provision of services by the operator of system or the electrosupplier which the operator of system or the electrosupplier for the consumers in general shall provide;

compensation for non-compliance with the guaranteed electric utility service quality standards - sum of money which is provided to the consumer in case of non-compliance with system by the operator or electrosupplier of the guaranteed electric utility service quality standards by reduction to the consumer of cost of services in the sizes established by this Procedure;

the incorrect account - the bill for electrical energy which is made out the consumer by the electrosupplier (in case of planned payments or advance payment - the account with final settlement) in which the cost, price/rate and/or data on amount of the consumed electrical energy received from means of commercial accounting of electrical energy of the consumer from service providers of commercial accounting are incorrectly specified (further - to the BUNCH).

Accounts are not considered incorrect:

exposed on the amounts determined in the settlement way by value of average daily amount of consumption in case of non receipt of meter readings from the consumer in the terms established by the current legislation

exposed on the amounts determined by results of control survey of means of commercial accounting or remote reading of the counter

with the incorrect data concerning amount of the consumed electrical energy transferred by the consumer, created by the consumer, in particular, in "personal account" of the consumer on the official website of the supplier of electricity;
