1. Approve Regulations on the Archive agency under the Public registration service under the Government of the Kyrgyz Republic according to appendix.

2. To the public registration service under the Government of the Kyrgyz Republic to bring the decisions into accord with this resolution.

3. Recognize invalid:

- the order of the Government of the Kyrgyz Republic "About the Archive agency under the Public registration service under the Government of the Kyrgyz Republic" of February 5, 2010 No. 72;

- Item 1 of the order of the Government of the Kyrgyz Republic "About modification and amendments in some decisions of the Government of the Kyrgyz Republic" of March 28, 2014 No. 185;

- Item 1 of the order of the Government of the Kyrgyz Republic "About modification of some decisions of the Government of the Kyrgyz Republic" of September 5, 2016 No. 481.

4. To impose control of execution of this resolution on department of construction, transport and communications of Government office of the Kyrgyz Republic.

Regulations on the Archive agency under the Public registration service under the Government of the Kyrgyz Republic

1. General provisions

1. The archive agency under the Public registration service under the Government of the Kyrgyz Republic (further - the Archive agency) is the subordinated division of the Public registration service under the Government of the Kyrgyz Republic (further - Service) performing activities in the field of archiving of the Kyrgyz Republic.

2. The archive agency in the activities is guided by the Constitution of the Kyrgyz Republic, the laws of the Kyrgyz Republic, presidential decrees of the Kyrgyz Republic, resolutions and orders of the Government of the Kyrgyz Republic, orders and orders of Service and this Provision.

3. The archive agency is legal entity, has property on the right of operational management, separate balance, settlement accounts in system of Treasury, seal with the image of the State Emblem of the Kyrgyz Republic with the name in the state and official languages.

- develops and submits for consideration of Service of the offer on the development strategy and enhancement of the legislation in the field of archiving, and also to implementation of the state information resources for the subsequent introduction by Service for consideration of the Ministry of Justice of the Kyrgyz Republic;

- provides provision of the state services to physical persons and legal entities, including with use of modern information technologies;

- participates in ensuring forming, storage, use and safety of the state information resources;

- determines requirements for ensuring safety and the state accounting of archive documents;

- establishes procedure for use of documents of National Archive Fund of the Kyrgyz Republic in the Public Records Offices;

- participates in development of target development programs of archiving;

- provides forming of National Archive Fund of the Kyrgyz Republic;

- provides completing of the Public Records Offices with documents of the state value;

- provides conducting examination of the archive documents including relating to private property;

- will organize work on giving to documents of National Archive Fund of the Kyrgyz Republic of the status "especially valuable" and "unique";

- performs centralized state accounting of documents of National Archive Fund of the Kyrgyz Republic irrespective of the storage location of documents and patterns of ownership;

- gives within the competence to state bodies, organizations, the organizations, the companies instructions for elimination, obligatory for execution, of the revealed shortcomings of ensuring safety, use of documents of National Archive Fund of the Kyrgyz Republic and the organization of documents of clerical work;

- provides provision of the retrospective document information which is stored in the Public Records Offices;

- performs the publication of documents of National Archive Fund of the Kyrgyz Republic, publishes scientific, popular scientific, scientific and methodical, reference books, information materials on archiving and clerical work;

- conducts and coordinates research and methodical work in the field of archive science, document science, archaeography;

- agrees to the methodical documents developed by state bodies, organizations, the organizations, the companies concerning archiving and the organization of documents in clerical work;

- develops standard normative and methodical documents concerning archiving and the organization of clerical work, obligatory for use in work by state bodies, organizations, the organizations and the companies;

- issues the conclusions about conditions and the storage location of archive documents by reorganization and liquidation of state bodies, organizations, organizations and companies;

- determines structure of organizations - sources of completing of the Public Records Offices and documents which are subject to storage in the Public and departmental archives;

- studies, generalizes and extends work experience of domestic and foreign archive organizations, holds scientific and practical conferences, meetings, seminars;

- approves industry lists of documents with indication of storage durations;

- carries out together with state bodies, organizations, the organizations and the companies of action for enhancement of activities of services of clerical work and departmental archives, including reviews of condition of clerical work and activities of departmental archives;

- will organize preparation and advanced training of employees of the Public and departmental archives;

- considers addresses, claims, statements and proposals of citizens and legal entities;

- performs international cooperation on the questions carried to competence of the Archive agency.

5. Rights and obligations of the Archive agency

8. The archive agency has the right:

- issue orders within the competence;

- request and receive from state bodies, organizations, the organizations and the companies, irrespective of the patterns of ownership, and also from citizens of the information about structure and amount which are available for them documents of National Archive Fund of the Kyrgyz Republic, conditions of their storage and use;

- consider at meetings of collegiate organs of the Archive agency questions of work of departmental archives and the organization of clerical work in state bodies, organizations, the organizations, the companies;

- constitute protocols on violations within the competence and impose penalties according to the Code of the Kyrgyz Republic about violations;

- change terms of temporary document storage of the state part of National Archive Fund in the organizations - completing sources by the conclusion of agreements;

- make in Service offers on creation and liquidation, reorganization of the Public Records Offices according to article 19 of the Law of the Kyrgyz Republic "About National Archive Fund of the Kyrgyz Republic";

- create constants and the temporary interdepartmental commissions for consideration of questions of archiving and the organization of clerical work;

- act on its own behalf within the delegated powers as the claimant or the defendant in courts;

- perform other actions within the competence, necessary for realization of functions of the Archive agency.

9. The archive agency shall:

- take necessary measures for safety of the property transferred on the right of operational management;

- provide for all working safe working conditions and bear responsibility in accordance with the established procedure for the damage caused to their health and working capacity;

- fulfill the obligations according to the signed agreements.

6. Organization of activities

10. The archive agency is headed by the director appointed to position and dismissed by the Prime Minister of the Kyrgyz Republic on representation of the chairman of Service.

11. In the Archive agency there is deputy director appointed to position and dismissed by the chairman of Service according to the Law of the Kyrgyz Republic "About the public civil service and municipal service".

12. Functional obligations of the director, his deputy are determined by the chairman of Service.

13. The structure and the staff list of central office of the Archive agency affirm the chairman of Service.

14. Director of the Archive agency:

- performs management of the Archive agency, the central, regional, city and territorial Public Records Offices;

- bears the personal responsibility for accomplishment of the tasks and functions assigned to the Archive agency;

- issues, within the competence, the orders obligatory for execution by the staff of the Archive agency, the central, regional, city and territorial Public Records Offices;

- approves structure and the staff list of subordinated and territorial subdivisions of the Archive agency;

- makes in Service offers on enhancement of the organization of archiving in the Kyrgyz Republic;

- determines functional obligations of staff of the Archive agency;

- represents the interests of the Archive agency in state bodies and other organizations;

- makes offers in Service on structure and the staff list of central office of the Archive agency;

- issues powers of attorney on representation of interests of the Archive agency in judicial and other state bodies;

- imposes authority punishments on the staff of the Archive agency, the central, regional, city and territorial Public Records Offices;

- encourages the caused a stir staff of the Archive agency, the central, regional, city and territorial Public Records Offices, and also makes offers in Service on assignment to the employees rewarding with departmental and state awards of the Kyrgyz Republic;

- disposes of means and manages property of the Archive agency;

- performs other powers following from tasks and functions of the Archive agency.

15. Under the Archive agency are effective:

- Archive council for consideration of questions of archiving and the organization of activities of the public archive institutions requiring joint decision;

- Scientific and methodical council for consideration of questions of scientific and methodical work in the field of archive science, document science and archaeography;

- The central expert survey board for consideration of the questions connected with determination of structure of documents of National Archive Fund of the Kyrgyz Republic, examination of value of documents and their selection on the state storage.

Structure and regulations on Archive council, Scientific and methodical council and Central expert survey board affirm the director of the Archive agency.

7. Liquidation and reorganization

16. Liquidation and reorganization of the Agency are performed according to the legislation of the Kyrgyz Republic.
