About the contract for realization of the right of development of the project documentation and construction of apartment apartment houses

Based on the paragraph of the sixth subitem 1.17 of Item 1 of article 21 of the Code of the Republic of Belarus about architectural, town-planning and construction activities the Council of Ministers of the Republic of Belarus DECIDES:

1. Establish standard form of the contract for realization of the right of development of the project documentation and construction of apartment apartment houses according to appendix.

2. Determine that:

2.1. construction of apartment apartment houses is performed on condition of the conclusion between local executive and administrative organs and builders (customers) of contracts for realization of the right of designing and construction of apartment apartment houses (further – agreements);

2.2. agreements are signed before adoption by local executive and administrative organs of decisions on withdrawal and provision of the parcel of land and (or) about permission of carrying out project and prospecting works, asset constructions;

2.3. the obligation according to the conclusion the builder (customer) with local executive and administrative organ of the agreement is subject to specifying:

in the decision on holding the auction if the parcel of land is provided by results of auction;

in the notification on results of consideration of the application on provision of the parcel of land if the parcel of land is provided without holding the auction.

3. This resolution becomes effective since September 26, 2020.
