According to paragraph one of subitem 1 of article 25 of the Federal Law of August 15, 1996 to No. 114-FZ "About procedure for departure from the Russian Federation and entry into the Russian Federation" <1>, article 16 of the Federal Law of July 25, 2002 to No. 115-FZ "About legal status of foreign citizens in the Russian Federation" <2>, Item 1, the subitem 11 of Item 11, the paragraph to the sixteenth the subitem 49 of Item 11, the subitem 3 of Item 20 of the Regulations on the Ministry of Internal Affairs of the Russian Federation approved by the Presidential decree of the Russian Federation of December 21, 2016 No. 699 <3>, and the order of the Government of the Russian Federation of May 16, 2011 "About development and approval of administrative regulations of implementation of the state control (supervision) and administrative regulations of provision of the state services" <1> I order to No. 373:

1. Approve the enclosed Administrative regulations of the Ministry of Internal Affairs of the Russian Federation on provision of the state service in registration and issue of invitations to entry into the Russian Federation of foreign citizens and stateless persons.

2. To heads (chiefs) of divisions of central office of the Ministry of Internal Affairs of the Russian Federation, territorial authorities of the Ministry of Internal Affairs of the Russian Federation at the regional and district levels to organize studying of this order and to provide accomplishment of its requirements by the authorized officers participating in rendering the state service in registration and issue of invitations to entry into the Russian Federation foreign citizens and stateless persons.

3. Declare invalid the order of the Ministry of Internal Affairs of Russia of September 21, 2017 No. 735 "About approval of Administrative regulations of the Ministry of Internal Affairs of the Russian Federation on provision of the state service in registration and issue of invitations to entry into the Russian Federation of foreign citizens and stateless persons" <2>.

I. General provisions

Subject of regulation of Administrative regulations

1. The administrative regulations of the Ministry of Internal Affairs of the Russian Federation of foreign citizens and stateless persons <1> determine terms and the sequence of ministerial procedures (actions) of Head department concerning migration of the Ministry of Internal Affairs of the Russian Federation <2>, divisions concerning migration of territorial authorities of the Ministry of Internal Affairs of Russia at the regional and district levels by provision of the state service in registration and issue of invitations to entry into the Russian Federation <3>, and also order of interaction of GUVM Ministry of Internal Affairs of Russia and divisions concerning migration of territorial authorities of the Ministry of Internal Affairs of Russia <4> with structural divisions of the Ministry of Internal Affairs of Russia, territorial authorities of the Ministry of Internal Affairs of Russia, the organizations and divisions of system of the Ministry of Internal Affairs of Russia, with federal executive bodies, territorial authorities of federal executive bodies, executive bodies of subjects of the Russian Federation, local government bodies, the organizations by provision of the state service in registration and issue of invitations to entry into the Russian Federation <5> foreign citizens and stateless persons <6>.

Requirements to procedure for informing on provision of the state service

Information on questions of provision of the state service is placed in the federal state information system "Single Portal of the State and Municipal Services (Functions)" <4>, on the official site of the Ministry of Internal Affairs of Russia and the official sites of territorial authorities of the Ministry of Internal Affairs of Russia at the regional level on the Internet <5>, on places, located in available to acquaintance, information stands of divisions concerning migration, and also it is provided by the staff of law-enforcement bodies of the Russian Federation, federal government civil servants and employees of territorial authorities of the Ministry of Internal Affairs of Russia at the regional and district levels <6> by phone or on personal acceptance.

From the date of acceptance of request about provision of the state service the applicant has the right to data on the course of its provision by phone, on personal acceptance or with use of the Single portal, in case of giving of request about provision of the state service in electronic form with use of the Single portal.

5. On the Single portal the following information is placed:

5.1. The exhaustive list of the documents necessary for provision of the state service, the requirement to execution of the specified documents, and also the list of documents which the applicant has the right to provide on own initiative.

5.2. Circle of applicants.

5.3. Term of provision of the state service.

5.4. Results of provision of the state service, procedure for receipt of the document which is result of provision of the state service.

5.5. The amount of the state tax collected for provision of the state service.

5.6. The exhaustive list of the bases for refusal in provision of the state service, and also about lack of the bases for suspension of the state service.

5.7. About the applicant's right to pre-judicial (extrajudicial) appeal of actions (failure to act) and the decisions made (performed) during provision of the state service.

5.8. Forms of the petition for issue of the invitation to entry into the Russian Federation for the inviting organization (appendix No. 1 to Administrative regulations), petitions for issue of the invitation to entry into the Russian Federation for physical persons <1> (appendix No. 2 to Administrative regulations) and models of their filling.

6. The refusal in the acceptance of the petition and other documents necessary for provision of the state service, and also refusal in provision of the state service is not allowed if the petition and documents necessary for provision of the state service are submitted according to information on terms and procedure for provision of the service published on the Single portal.

Information on the Single portal on procedure and terms of provision of the state service based on the data containing in the federal state information system "Federal Register of the State and Municipal Services (Functions)" <2> is provided to the applicant free of charge.

7. The information access about terms and procedure for provision of the state service is performed without use of the software which installation on technical means of the applicant requires the conclusion of license or other agreement with the owner of the software providing collection of payment, registration or authorization of the applicant or provision of personal data by it.

8. Information on readiness of the document which is result of provision of the state service, the applicant has the right to receive if technically possible by means of the Single portal irrespective of method of giving of request about provision of the state service. Data on readiness of the document contain information from departmental segment of the Ministry of Internal Affairs of Russia of the state system of migration and registration registration, and also production, registration and control of the circulation of identity documents <1>.

9.1. When implementing preliminary record by means of the Single portal, telephone communication or by the personal address the applicant is given access to the schedule of work of division concerning migration, and also with dates and intervals of time of acceptance, available to making an appointment, possibility of record in any date and time, free for acceptance, within the schedule of reception of citizens established in division concerning migration.
