About measures for enhancement of system of protection of intellectual property items

For the purpose of enhancement of system of protection of intellectual property items, considering that development of the sphere of intellectual property is major factor of integration of our country into the world community, and also consecutive realization of the tasks determined in the Strategy of actions by five priority directions of development of the Republic of Uzbekistan in 2017 - 2021:

1. Since April 1, 2021:

cancel the operating restrictions in the legislation on registration of trademarks and service marks only addressed to the legal entities and physical persons performing business activity proceeding from regulations of international treaties in the field of intellectual property;

implement the procedure for the accelerated examination giving opportunity of considerable reducing terms of state registration of intellectual property items. At the same time it is provided that preliminary search in the request submitted for capture under protection of intellectual property items is carried out by agreement of the parties.

2. Implement in activities of the Ministry of Justice (further - the Ministry) practice of application of methods of outsourcing in the course of conducting state examination of requests for intellectual property items.

3. Approve:

"Road map" on strengthening of protection of intellectual property and implementation of modern information and communication technologies according to appendix No. 1;

The program of practical works on development of the sphere of intellectual property (inventions, useful models, industrial designs, selection achievements) for 2021 - 2023 according to appendix No. 2.

Confer the personal responsibility on the first heads of the ministries, departments and other organizations, and also executive bodies on places for timely, high-quality and full implementation of the actions determined in "Road map" and the Program.

4. Establish procedure according to which:

the expenses of national exporters on registration abroad names of places of origin (geographical instructions) of goods performed till January 1, 2025 completely become covered at the expense of Fund of development of intellectual property of the Ministry of Justice;

state bodies and the state companies, research and highest educational institutions till June 1, 2021 carry out complete inventory of the objects belonging to them (copyright, the related rights and industrial property) intellectual property with their display in financial accounting;

in 2021-2022 national registration of trademarks of subjects of entrepreneurship - exporters, and also performing activities in the field of agricultural industry and workmanship in which general goods turnover the share of export constitutes more than 60 percent is carried out free of charge;

in the course of state registration of subjects of entrepreneurship promotion of state registration also of trademarks and service marks is carried out;

The Chamber of Commerce and Industry and the Ministry in all administrative units of the republic at least once a year for persons beginning business activity hold national forums and master classes in explanation of benefits of possession of own brand with participation of owners of the known national brands recognized in Uzbekistan and world scale.

5. Agree with the offer of the Agency and Ministry of innovative development on start till October 1, 2021 of the "Patent platform" under the Agency directed to rendering assistance to state bodies, state companies, research and highest educational institutions in the correct accounting of the intellectual property items belonging to them, introduction in economic circulation of the rights to them, commercialization of results of scientific activities.

Determine that:

in this platform information on security documents of inventions, useful models, industrial designs, selection achievements, trademarks, service marks, names of places of goods origin is in detail displayed;

the platform is conducted electronically in real time, connection of subjects of entrepreneurship to it is carried out on voluntary and free basis.

6. Determine that:
