About the Procedure for normative money value of lands for nonagricultural appointment (except lands in borders of settlements)

According to the Land code of Ukraine, the Law of Ukraine "About assessment of lands" and the resolution of the Cabinet of Ministers of Ukraine of 30.05.97 of N525 "About the Technique of Normative Money Value of Lands of Nonagricultural Appointment (except Lands of Settlements)" (with changes) we ORDER:

1. Approve the Procedure for normative money value of lands for nonagricultural appointment (except lands in borders of settlements) it (is applied).

2. To heads of department of the market and assessment of lands, differentiations of lands of the state-owned and utility property and Legal management of Kalnichenko of A. G. Goskomzem of Ukraine to provide to Gorbatovich S. M. provision of this order on state registration in the Ministry of Justice of Ukraine.

3. The order of the State committee of Ukraine on land resources, the Ministries of agro-industrial complex of Ukraine, the State committee of construction, architecture and housing policies of Ukraine, the State committee of forestry of Ukraine, the State committee of Ukraine on water economy, Ukrainian academy of agrarian sciences of August 29, 1997 N 86/19/148/86/76/88 "About the Procedure for money value of lands for nonagricultural appointment (except lands of settlements)", registered in the Ministry of Justice of Ukraine on October 14, 1997 for N 477/2281, to declare invalid.

Procedure for normative money value of lands for nonagricultural appointment (except lands in borders of settlements)

1. General provisions

1.1. This Procedure is developed according to the Land code of Ukraine, the Law of Ukraine "About assessment of lands", the Technique of the normative money value of lands of nonagricultural appointment (except lands of settlements) approved by the resolution of the Cabinet of Ministers of Ukraine of 30.05.97 of N525 (with changes).

1.2. The procedure regulates the mechanism of normative money value of lands of nonagricultural appointment behind borders of settlements: industries, transport, communication, power, defense and other appointment; lands of natural and reserved and other nature protection, improving, recreational and historical and cultural appointment; lands of forest and water funds.

1.3. The normative money value of lands is used for determination of the size of the land tax, the state fee in case of exchange, inheritance and donation of the parcels of land according to the law, the rent for land the site of the state-owned and utility property, losses of agricultural and forestry and landscape production.

1.4. Objects of normative money value of lands of nonagricultural appointment are the parcels of land which are used for functional purpose irrespective of to what category they are referred.

1.5. Reference of lands to category of lands on functional use is performed according to the Instruction for filling of the state statistical reporting under quantitative accounting of lands (the NN form 6-zy, 6a-zy, 6b-zy, 2-zy) approved by the order of Goskomstat of Ukraine of 05.11.98 of N 377, of Ukraine registered in Ministry of Justice 14.12.98 for N 788/3228, according to the types of economic activity specified in references which provide to legal entities bodies of the state statistics.

1.6. Capitalization of normative annual average economic effect or investment income from use of the parcels of land of the corresponding functional purpose is the basis for normative money value of the parcels of land of nonagricultural appointment behind borders of settlements.

1.7. Information base for normative money value are data of the state inventories (land, forest, water); land management, forest management, town-planning and project technical documentation, inventory count of lands.

1.8. The normative money value of the parcels of land which are placed in the territories which underwent to radioactive pollution owing to the Chernobyl catastrophic crash is determined taking into account the coefficients given in appendix 1 (tab. 1. 1) to this Procedure.

1.9. The organization of works on normative money value of the parcels of land of nonagricultural appointment (except lands in borders of settlements) is performed by the State committee of Ukraine on land resources, Republican committee of the Autonomous Republic of Crimea on land resources, regional and Sevastopol city head departments, district departments of land resources.

1.10. The normative money value of the parcels of land which stay in inventory is determined by category of lands to which they are carried according to appropriate sections of this this Procedure and the Procedure for normative money value of lands for agricultural purpose and settlements.

2. Normative money value of lands of the industry, transport, communication, power, defense and other appointment

2.1. The investment income from target use of the parcels of land and the performed improvement of their arrangement is put in basis of calculation of normative money value of lands of the industry, transport, communication, power, defense and other appointment.

2.2. The normative money value of lands of the industry, transport, communication and power is determined by formula

The normative money value of the parcel of land is subject to indexation according to the resolution of the Cabinet of Ministers of Ukraine of 12.05.2000 N 783 "About carrying out indexation of money value of lands".

2.3. The investment income of the parcel of land without land improvements (R), is determined according to tab. 1.2 (appendix 1).

2.4. The normative amount of gross output (TP) is calculated further as the work of production costs (Z) and coefficient of normative profitability of 1,15. Value of production costs is accepted according to the financial statement of the company for that year which preceded year of assessment.

2.5. Value of coefficient of profitability rate (K) which нр determines amounts of expenses on expanded reconstruction of production is accepted at the 0,12 level.

2.6. The coefficient which considers functional use of the parcel of land (K) is determined according to tab. 1.3 ф (appendix 1).
