About registration by residents of currency agreements

Based on subitems 2. 2, 2.5 Items 2 of Article 6, parts one of subitem 2.3 of Item 2 of article 8 of the Law of the Republic of Belarus of July 22, 2003 No. 226-Z "About currency control and currency exchange control" and the paragraph of the ninth Articles 26, parts one of article 39 of the Bank code of the Republic of Belarus DECIDES: Board of National Bank of the Republic of Belarus

1. Approve the Instruction about registration by residents of currency agreements it (is applied).

2. Determine that:

2.1. the currency agreements signed before entry into force of this resolution under which obligations are not fulfilled in full are registered before making by the resident or according to its order the third parties of the actions directed to execution since July 9, 2021 of obligations under the currency agreement or no later than seven working days from the date following receipt date since July 9, 2021 of money under the currency contract for the account opened for resident in bank of the Republic of Belarus or foreign bank if during the specified period the resident or according to its order the third parties does not make the actions directed to obligation fulfillment under the currency agreement.

Information on obligation fulfillment on the currency agreements specified in part one of this subitem is not submitted concerning the actions directed to obligation fulfillment under such currency agreements, made till July 9, 2021;

2.2. in case of registration of the currency agreement under which till July 9, 2021 the transaction in bank of the Republic of Belarus was registered the registration number of the transaction assigned by this bank is specified.

3. This resolution becomes effective since July 9, 2021.

Chapter 1. General provisions

1. This Instruction determines the list of currency transactions when which carrying out the currency agreement is subject to registration, the extreme size of the amount of obligations under the currency agreement in case of which exceeding the currency agreement is subject to registration, and also order of registration of currency agreements by residents and submissions by them of documents and other information on obligation fulfillment on the registered currency agreements.

2. For the purposes of this Instruction following terms are used in the following values:

the web portal – the information resource for registration of currency agreements posted on the website of National Bank on the global computer Internet to the address https://rvd.nbrb.by/nbrbResidentUi/#/;

the actions directed to obligation fulfillment under the currency agreement – carrying out by the resident or according to its order the third parties of payments (transfers), transfer (obtaining) of currency values, goods, unsolved information, exclusive rights on intellectual property items, property rights, property in lease, including in finance lease (leasing), accomplishment (acceptance) of works, rendering (obtaining) services, entering of money deposit into authorized capital of the legal entity – the resident, the legal entity – the nonresident, attraction (provision) of money in the form of the credit, loan, purchase (sale) of securities, the property carried by the legislation of the Republic of Belarus to real estate (further – real estate), creation of object of shared-equity construction, placement of money in deposits (deposits), donation (donation) of money;

personal account of resident – component of the web portal by means of which information on the currency agreement necessary for its registration, documents and other information on change of the currency agreement, obligation fulfillment on the currency agreement are represented search and receipt of information on the registered currency agreements are performed;

registration number of the currency agreement – the unique registration number assigned to the currency agreement on the web portal;

registration of the currency agreement – set of actions for representation on the web portal of information on the currency agreement which comes to the end with assignment to the currency contract of registration number with use of software and hardware and technologies;

the user's guide "Resident" – the document posted on the website of National Bank on the global computer Internet, determining operating procedure with the software of the web portal, including registration of users and creations of personal account of resident.
