About introduction of amendments to the Law of Ukraine "About the higher education" concerning the procedure of election of the head of institution of higher education

The Verkhovna Rada of Ukraine decides:

I. Bring in the Law of Ukraine "About the higher education" (Sheets of the Verkhovna Rada of Ukraine, 2014, No. 37-38, of Art. 2004; 2020, No. 24, Art. 170) following changes:

1. In Article 42 part three:

after the paragraph of the ninth to add with three new paragraphs of the following content:

"If two or more persons (candidates) took part in elections, and any of them did not gain more than 50 percent of votes of persons having the right to participate in elections for the seventh calendar day after holding the first round the second round of elections is held.

Voting bulletins in the second round join two persons (candidates) who in the first round got the maximum number of votes.

The elected head of institution of higher education person (candidate) who gained more than 50 percent of votes of persons having the right to participate in elections, and in case of holding the second round - more than 50 percent of votes of persons who took part in vote is considered".

With respect thereto the tenth and eleventh to consider paragraphs respectively paragraphs the thirteenth and fourteenth;

in the paragraph the thirteenth words and figures "With person (candidate) who gained more than 50 percent of votes of persons having the right to participate in elections" shall be replaced with words "With person (candidate) chosen as the head of institution of higher education according to requirements of this Law";

after the paragraph of the thirteenth to add with two new paragraphs of the following content:

"If person (candidate) chosen according to this Law as the head of institution of higher education did not undergo special testing, except persons elected heads of institutions of higher education being legal entities of private law, the founder (founders) or the representative it (them) the body (person) within seven calendar days after the end of special check announces new contest for post of the head of institution of higher education.
