I ORDER:

1. Bring in the order of the Minister of Energy of the Republic of Kazakhstan of December 3, 2015 No. 685 "About approval of Rules of calculation and placement on Internet resource by the single purchaser of service price on ensuring readiness of electric power for execution of loading" (it is registered in the Register of state registration of regulatory legal acts for No. 12474, it is published on January 8, 2016 in information system of law of Ad_let) the following change:

The rules of calculation and placement on Internet resource the single purchaser of service price on ensuring readiness of electric power for execution of loading approved by the specified order to be reworded as follows according to appendix to this order.

2. To provide to development department of power industry of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of calculation and placement on Internet resource the single purchaser of the price of service in ensuring readiness of electric power for execution of loading

Chapter 1. General provisions

1. These rules of calculation and placement on Internet resource are developed by the single purchaser of the price of service in ensuring readiness of electric power for execution of loading (further - Rules) according to subitem 70-20) of article 5 of the Law of the Republic of Kazakhstan of July 9, 2004 "About power industry" (further - the Law) and determine procedure of payments and placements on Internet resource by the single purchaser of the price of service in ensuring readiness of electric power for execution of loading.

2. In these rules the following basic concepts are used:

1) the single purchaser - the legal entity determined by authorized body, performing centralized purchase of service in maintenance of readiness of electric power and centralized rendering service in ensuring readiness of electric power for execution of loading according to the procedure, provided by the Law;

2) the system operator - the national company exercising centralized supervisory control, ensuring parallel work with power supply systems of other states, maintenance of balance in power supply system, rendering system services and acquisition of support services at subjects of the wholesale market of electrical energy and also transfer of electrical energy on national power grid, its maintenance and maintenance in operational readiness;

3) authorized body - the state body performing management in the field of power industry;

4) forecast demand for electric power - the document developed by the system operator determining forecast sizes of the consumption of electric power of subjects of the wholesale market of electrical energy, maximum in year, and necessary reserves of electric power of single electric utility system of Kazakhstan;

5) service in maintenance of readiness of electric power - the service rendered by the power making organizations to the single purchaser in maintenance of readiness of the electric power of the generating installations certified in accordance with the established procedure for execution of loading;

6) service in ensuring readiness of electric power for execution of loading - the service rendered by the single purchaser in ensuring readiness of the electric power of the generating installations in single electric utility system of the Republic of Kazakhstan certified in accordance with the established procedure for execution of loading;

7) the centralized biddings by electric power - the process directed to the conclusion of service provision agreements on maintenance of readiness of electric power between the power making organizations and the single purchaser in electronic system of trade.

Other concepts and determinations used in these rules are applied according to the legislation of the Republic of Kazakhstan in the field of power industry.

Chapter 2. Procedure of payments of the price of service in ensuring readiness of electric power for execution of loading the forthcoming calendar year

3. Calculation of the price of service in ensuring readiness of electric power for execution of loading (further - the price of service in providing) the forthcoming calendar year is performed by the single purchaser on the basis:

1) weighted average price on service in maintenance of readiness of the electric power which developed by results of the centralized biddings by electric power;

2) weighted average price on service in maintenance of readiness of electric power of all purchase agreements of service in maintenance of readiness of electric power concluded by the single purchaser with winners of tenders for construction of the generating installations which are again put into operation and also with winners of biddings with the operating power making organizations which signed the investment agreement on upgrade, expansion, reconstruction and (or) updating with authorized body, and also with the operating power making organizations which part combined heat and power plants are;

3) the forecast requests for consumption which are power supplying, the power transferring organizations and the consumers who are subjects of the wholesale market;

4) forecast demand for electric power for the forthcoming and next calendar years;

5) the positive financial result confirmed with the audit report on activities of the single purchaser in the market of electric power in the year preceding year in which calculation of the price is perfromed.

4. The price of service in providing for the forthcoming calendar year is calculated by the single purchaser to within whole by the following formula:

C - the price of service in providing for the forthcoming calendar year, in tenge for one MW a month;

j - the sequence number changing from 1 to m;

m - total quantity of the current agreements about purchase of service in maintenance of readiness of electric power signed between the single purchaser and the power making organizations;

Pj - the amount of service in maintenance of readiness of electric power specified for the forthcoming calendar year in j-volume the current agreement about purchase of service in maintenance of readiness of electric power in MW;

Tsj - the price of service in maintenance of readiness of electric power specified for the forthcoming calendar year in j-volume the current agreement about purchase of service in maintenance of readiness of electric power in tenge for one MW a month;

M12 - duration of calendar year, in months;

- others, in addition to purchase costs of service in maintenance of readiness of electric power, economically reasonable costs of the single purchaser forthcoming calendar year connected with rendering service in ensuring readiness of electric power for execution of loading forthcoming calendar year in tenge;

- the positive financial result confirmed with the audit report on activities of the single purchaser in the market electric capacities in the year preceding year in which calculation of the price, in tenge is perfromed.

The financial result for calculation  is created proceeding from gross result from activities of the single purchaser for purchase of service in maintenance of readiness of electric power and rendering service in ensuring readiness of electric power less:

actual the incured operating costs of the single purchaser, but not above the costs considered in case of price approval for the corresponding year;

uncovered development costs of the preliminary feasibility statement by request of authorized body;

settlement corporate income tax;

- the amount on i;

i - the sequence number changing from 1 to n;

n - total quantity of the power supplying, power transferring organizations and the consumers who are subjects of the wholesale market according to the corresponding forecast demand for electric power for the forthcoming and next calendar years developed by the system operator current calendar year according to the order of the Minister of Energy of the Republic of Kazakhstan of February 27, 2015 No. 152 "About approval of Rules of the organization and functioning of the market of electric power" (further - Rules of the organization and functioning of the market of electric power) (it is registered in the Register of state registration of regulatory legal acts for No. 10612);

P abs.i - the electric power of consumption, maximum forthcoming calendar year, specified in the corresponding forecast request for consumption i-that the power supplying, power transferring organization and the consumer who is the subject of the wholesale market sent to the system operator current calendar year according to Rules of the organization and functioning of the market of electric power.

Chapter 3. Procedure for placement on Internet resource of the price of service in providing the forthcoming calendar year

5. The single purchaser annually till December 1 places the price of service in providing for the forthcoming year on the Internet resource together with confirmatory calculations.

The confirmatory calculations specified in part one of this Item are placed on Internet resource of the single purchaser with disaggregation of all components of the formula specified in item 4 of these rules.
