About introduction of amendments to resolutions of the Cabinet of Ministers of Ukraine of October 21, 2015 No. 835 and of November 30, 2016 No. 867

The Cabinet of Ministers of Ukraine decides:

1. Bring in resolutions of the Cabinet of Ministers of Ukraine of October 21, 2015 No. 835 "About approval of the Regulations on data sets which are subject to promulgation in the form of open data" (The Official Bulletin of Ukraine, 2015, No. 85, of Art. 2850; 2018, No. 15, Art. 506; 2019, No. 43, the Art. 1484) and of November 30, 2016 No. 867 "Some questions of promulgation of public information in the form of open data" (The Official Bulletin of Ukraine, 2016, No. 97, Art. 3146; 2019, No. 43, the Art. 1484) changes which are applied.

2. To provide to the ministry of digital transformation:

1) creation and functioning of the Center of competences in the field of open data "Action. Open data";

2) representation in three-months time to the Cabinet of Ministers of Ukraine of offers relatively:

requirements to the publication of data sets from the Sections "All Managers of Information (According to Competence)" and "Local government bodies" of the list of data sets which are subject to promulgation in the form of open data;

the list of data sets which are of high value;

3) in six-months time:

development and representation for consideration of the Cabinet of Ministers of Ukraine of the draft of the strategy of development for the sphere of open data in Ukraine and the actions plan on its realization;

after approval of the list of the data sets which are of high public interest, development together with the interested bodies of requirements to structure and the publication of the data sets which are of public interest.

Changes which are made to resolutions of the Cabinet of Ministers of Ukraine of October 21, 2015 No. 835 and of November 30, 2016 No. 867

1. In Regulations on data sets which are subject to promulgation in the form of open data, No. 835 approved by the resolution of the Cabinet of Ministers of Ukraine of October 21, 2015:

Item 1 to state 1) in the following edition:

"1. This Provision determines requirements to format and structure of data sets which are subject to promulgation in the form of open data, frequency of updating and procedure for their promulgation, and also the list of such data sets.

Promulgation of data sets in the form of open data is performed by the following principles:

openness by default - ensuring promulgation by managers of all public information in the form of open data which is in their ownership, except information which is carried by the law to information with limited access, and also information which is not subject to publication according to the Law of Ukraine "About access to public information";

efficiency - ensuring timely updating of public information in the form of open data on the Single state web portal of open data, and also its promulgation in primary (non-aggregated) form;

availability of use - ensuring promulgation of public information in the form of open data in machine-readable format, and also ensuring its further free and free use;

interoperability - ensuring promulgation of public information in the form of open data with the publication in data set of single identifiers of objects, information on which contains in this data set;

permanent applicability - ensuring use of public information in the form of open data public authorities and local government bodies when implementing of the powers by them;

inclusivity of development - ensuring support with managers of information and assistance to creation of new information resources and services on the basis of public information in the form of open data.";

2) in Item 2:

the fifth to state the paragraph in the following edition:

"machine-readable format - the format of data structured thus which gives the chance to identify, transform and obtain specific data, including the separate facts and their internal structure, without participation of the person;";

add Item after the paragraph of the tenth with paragraphs of the following content:

"data set of high value - data set which contains socially necessary information which reuse constitutes considerable effect for development of society, the state, economy and protection of the surrounding environment;

set of dynamic data (data in real time) - data set which contains information which constantly changes and is instantly updated more than once a day. Set of dynamic data (data in real time) is provided only through the application programming interfaces (API);

information audit - process of the analysis by the manager of information concerning availability, condition, formats, management processes and use of all information which is in its ownership. Carrying out information audit is obligatory and the minimum is performed once a year.

The technique of carrying out information audit affirms the central executive body which provides forming and realization of state policy in the field of open data.

Results of information audit of the manager of information are subject to the obligatory publication on the Single state web portal of open data.".

"3. Managers of information according to this Provision load in the form of open data the data set determined in the list of data sets which are subject to promulgation in the form of open data, according to appendix.

Managers of information shall publish in format of open data all public information in the form of open data which is in their ownership and concerns specific data set.";

convenience and safety of use.

The instruction and technical documentation of the application programming interface are published on the Single state web portal of open data.";

"15. The manager of information independently chooses frequency of updating of data sets which are in its ownership and are published if other is not stipulated by the legislation.

During the choice of frequency of updating of data sets, the manager of information shall provide the greatest possible frequency of their updating and maintenance in urgent condition on the Single state web portal of open data.

Managers of information such frequency of updating of data sets can be chosen:

for the data sets promulgated by means of the application programming interface - more than once a day;

for data sets which have planned frequency of updating - more than once a day; daily; weekly; monthly; quarterly; every half-year; year.

In case of entering into data sets of unplanned changes updating of such sets on the Single state web portal of open data is performed within three working days from the moment of introduction of such changes.";

Paragraph two of Item 24 to state 9) in the following edition:

"The document of the manager of information on determination of the responsible person (persons) of the manager of information is published on the Single state web portal of open data and the official website of the manager of information no later than the working day following behind day after its edition.";

10) to add the Provision with Item 27 of the following content:

"27. The publication of data sets in spheres of justice, legal proceedings, health care, ecology and environment protection, transport and infrastructure, finance and taxes is the priority direction of realization of state policy in the field of open data.";

Information on structure (organizational structure) of the manager of information

Standard rates which affirm and are subject to promulgation according to the law, the manager of information

Lists of national standards for the purposes of application of technical regulations

Reports, including on satisfaction of requests for information

The register of the data sets which are in ownership of the manager of information

Administrative data in value of the Law of Ukraine "About the state statistics" which gather (are processed) and are subject to promulgation according to requirements of the law by the manager of information

Lists of the regulatory legal acts, acts of individual action (except intra organizational) adopted by the manager of information, drafts of regulatory legal acts
