ORDER OF THE GOVERNMENT OF THE KYRGYZ REPUBLIC

of January 4, 2006 No. 1

About approval of Regulations of the Government of the Kyrgyz Republic

(as amended on on February 19, 2009)

According to article 20 of the Constitutional law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve the enclosed Regulations of the Government of the Kyrgyz Republic.

2. To the ministries, state committees, administrative departments and local public administrations:

- accept these Regulations to management and strict execution;

- in a month to bring the decisions into accord with this resolution;

- organize work in central offices and structural divisions of the ministries, the state committees, administrative departments and local public administrations work on studying of provisions of these Regulations.

3. Recognize invalid:

- the order of the Government of the Kyrgyz Republic of November 1, 2001 No. 676 "About approval of Regulations of the Government of the Kyrgyz Republic";

- the order of the Government of the Kyrgyz Republic of December 15, 2001 No. 788 "About entering of amendment into the Regulations of the Government of the Kyrgyz Republic approved by the order of the Government of the Kyrgyz Republic of November 1, 2001 No. 676 "About approval of Regulations of the Government of the Kyrgyz Republic";

- the order of the Government of the Kyrgyz Republic of March 25, 2002 No. 163 "About entering of amendment and change into the order of the Government of the Kyrgyz Republic of November 1, 2001 No. 676 "About approval of Regulations of the Government of the Kyrgyz Republic";

- the order of the Government of the Kyrgyz Republic of April 19, 2002 No. 234 "About entering of amendment into the Regulations of the Government of the Kyrgyz Republic approved by the order of the Government of the Kyrgyz Republic of November 1, 2001 No. 676 "About approval of Regulations of the Government of the Kyrgyz Republic";

- Item 1 of the order of the Government of the Kyrgyz Republic of August 5, 2002 No. 526 "About modification and amendments in some decisions of the Government of the Kyrgyz Republic";

- the order of the Government of the Kyrgyz Republic of October 3, 2002 No. 674 "About modification of the Regulations of the Government of the Kyrgyz Republic approved by the order of the Government of the Kyrgyz Republic of November 1, 2001 No. 676 "About approval of Regulations of the Government of the Kyrgyz Republic";

- Item 3 of the order of the Government of the Kyrgyz Republic of October 27, 2003 No. 687 "About modification and amendments in some decisions of the Government of the Kyrgyz Republic";

- the order of the Government of the Kyrgyz Republic of February 23, 2004 No. 94 "About entering of amendment into the Regulations of the Government of the Kyrgyz Republic approved by the order of the Government of the Kyrgyz Republic of November 1, 2001 No. 676 "About approval of Regulations of the Government of the Kyrgyz Republic";

- Item 37 of the order of the Government of the Kyrgyz Republic of August 17, 2004 No. 622 "About modification and amendments in some decisions of the Government of the Kyrgyz Republic".

4. To impose control over the implementation of this resolution on the Office of the Prime Minister of the Kyrgyz Republic.

Regulations of the Government of the Kyrgyz Republic

I. General provisions

1. These Regulations according to the Constitution of the Kyrgyz Republic, the Constitutional law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic", other laws of the Kyrgyz Republic, presidential decrees of the Kyrgyz Republic establish rules of the organization of activities of the Government of the Kyrgyz Republic for realization of its powers.

2. The government of the Kyrgyz Republic (further - the Government) is the supreme body of the executive government of the Kyrgyz Republic.

The government directs activities of the ministries subordinated to it, the state committees, administrative departments, local public administrations, other executive bodies, and also activities of local government bodies in case of investment with their state powers.

3. The government is the collegiate organ constituting single system of executive bodies in the Kyrgyz Republic and resolving all issues of public administration, except for the powers referred by the Constitution of the Kyrgyz Republic to competence of the President of the Kyrgyz Republic and Jogorku Kenesh of the Kyrgyz Republic.

Activities of the Government are based on the principles of legality, collective nature, publicity and openness, providing rights and freedoms of man and citizen, responsibility for the activities to the people and the President of the Kyrgyz Republic and are performed according to the Constitutional law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" and these Regulations.

4. The main activities of the Government are determined by the Prime Minister of the Kyrgyz Republic (further - the Prime Minister).

The Prime Minister will organize work of the Government, conducts meetings of the Government, gives instructions to members of the government, heads of other executive bodies, controls and requests their reports on the done work on accomplishment of orders of the President of the Kyrgyz Republic to the Government and resolutions of Jogorku Kenesh of the Kyrgyz Republic.

5. The government on the basis and in pursuance of the Constitution of the Kyrgyz Republic, the laws of the Kyrgyz Republic, decrees and orders of the President of the Kyrgyz Republic and orders of the President of the Kyrgyz Republic issues resolutions and the orders obligatory to execution in the Kyrgyz Republic.

The government issues acts in the form of the resolution and the order. Regulatory legal acts of the Government of the Kyrgyz Republic are adopted in the form of resolutions.

Acts of the Government are signed by the Prime Minister, and during absence of the Prime Minister - the First vice-Prime Minister of the Kyrgyz Republic (further - the First vice-Prime Minister) or the vice-Prime Minister of the Kyrgyz Republic (daleevitse-Prime Minister) its replacement, become effective and are subject to publication according to the procedure, established by the legislation of the Kyrgyz Republic.

The president of the Kyrgyz Republic signs the orders of the Government accepted at the meeting of the Government which was taking place under its presidency. The specified resolutions shall be vised by the Prime Minister and the corresponding members of the government.

6. The government within the powers will organize execution of the Constitution of the Kyrgyz Republic, the laws of the Kyrgyz Republic, acts of the President of the Kyrgyz Republic and the Government, the international treaties which became effective in accordance with the established procedure and exercises systematic control of their execution by executive bodies, takes measures for elimination of violations of the law of the Kyrgyz Republic.
